    Tinubu will present 2024 Budget to NASS in November – Senator Adeola

    The Senate on Wednesday, October 25, said President Bola Tinubu, would present the 2024 Appropriation Bill to a joint session of the National Assembly in November for passage before the end of the year.

    The chairman of the Senate Committee on Appropriation, Senator Solomon Adeola, gave this hint in an interview with journalists after the inaugural meeting of the committee.

    Senator Adeola who represents Ogun West Senatorial district, said the National Assembly is expecting the federal government to present the Medium Term Expenditure Framework and Fiscal Strategy (MTEF-FSP) next week for proper scrutiny.

    Adeola also hinted that his panel had invited the Minister of Finance and Coordinating Minister of the Economy, Wale Edun, for a meeting on Wednesday next week.

    He assured Nigerians that the National Assembly would try as much as possible to make sure that the 2024 budget comprises 55 percent capital expenditure.

    Adeola said the 10th Senate would maintain the January to December budget cycle, which the 9th National Assembly started.

    He said: “I want you to take cognizance of the fact that there is a change of government prior to now and as of May 29, 2023, a new Government is in place.

    “I want you to take cognizance of the change of government on May 29.  There is a teething problem because there is a change of government.

    “The new administration has a new mantra that encapsulates its vision and there must be challenges.

    “We will do a thorough job on the budget. Our job is to verify the budget to meet the expectations of the people. We will look into it thoroughly.

    “We are expecting the MTEF next week and immediately we receive the document, the Committee on Finance will go into work and look into it.

    The Finance Minister and the Minister of Budget and Planning are working round the clock.

    “I assure you that we won’t break the tradition, we will have the budget as at when due. We will keep to the tradition of the January to December budget cycle.

    “It has to do with the nomination of the project to the budget document that will meet the yearnings and the needs of the people, I would not regard that as padding. It is still part of the government document we look into and it has an expectation. The budget is an estimate but implementation is another thing. So I don’t believe in budget padding.”

    Tinubu calls for synergy within housing agencies

    President Bola Tinubu has called on all federal agencies within the housing ecosystem to work in synergy to achieve his vision for Housing and Urban Development.

    The Minister of Housing and Urban Development, Ahmed Dangiwa informed the leaderships of the Federal Mortgage Bank of Nigeria (FMBN), the Nigeria Mortgage Refinance Company (NMRC), Family Homes Fund Limited (FHFL), and the Federal Housing Authority (FHA) during a multi-agency meeting in Abuja.

    Dangiwa said the president expects them to be innovative, think outside the box, and create ideas that match the massive housing problem the government seeks to solve.

    He said the meeting became necessary as part of efforts to ensure all federal agencies within the housing ecosystem work in synergy to achieve the vision of President Bola Ahmed Tinubu for Housing and Urban Development.

    He said: “Under Mr President’s Renewed Hope Agenda for Housing, the government expects all federal housing agencies to work with the clear understanding that at the core of what they do is providing housing to Nigerians.

    “Even though you may differ by name, the end result of your operations, no matter how technically different the institutional framework that guides you, is enabling access to decent and quality housing for all Nigerians across all income segments.

    “The Nigeria Mortgage Refinance Company (NMRC), on the other hand, has a significant role to play in developing the housing market and building a robust housing finance market through its mortgage refinancing operations that are designed to boost liquidity in the housing market. So, clearly, our problem is not the lack of institutions. We have them. But as we speak, we must all be humbled by how little we have collectively and individually done to address the housing problems of our country.

    “If we consider the state of the housing market, the systemic challenges we still confront, the estimated size of the housing deficit, the prevalence of slum dwellings, the cost of land acquisition, interest on mortgage loans, among several other challenges, and how little progress we have made to tackle them, we can all agree that we have fallen short of expectations.

    “We intend to navigate the challenges and succeed despite them. That is what we expect from all agencies. The government expects you to innovate, think outside the box, and be bold in your plans. Let your initiatives, solutions, and ideas match the massive housing problem we seek to solve. We, on our part, will provide all the necessary support you need to succeed.”

    The Managing Director/Chief Executive Officer of Nigerian Mortgage Refinance Company, Kehinde Ogundimu, said the agencies are working on acquiring aggregate, unified data on the Nigerian housing sector.

    He said the data which would be a repository for the sector can be used in key decisions as all agencies in the sector would be made to submit the housing data to the collective and unified portal.

    Ogundimu further urged the Minister to set up a standing Committee for the aggregate data and added that the agencies would be working with states to adopt the initiative.

    Susan T Buffet Foundation has pledged to directly fund President Bola Tinubu‘s health sector reinvigoration programmes, especially on preventable maternal and child deaths.

    The Foundation said its plan is to directly align with the priorities and with the strategy of the Federal government

    Susan T Buffet Foundation Director, Prof Senait Fisseha made the disclosure at the Kuchingoro Primary Health Care Centre, Abuja on Wednesday, October 25, where she was received by the minister of the Federal Capital Territory (FCT), Nyesom Wike, and the coordinating minister of health and social welfare Prof. Ali Pate and the Kuchingoro community.

    Fisseha said the international community is not unaware of the efforts of the Nigerian government on the health sector which was a major reason behind the resolve of her foundation to collaborate with the government.

    The Mandate Secretary for Health Services and Environment, Adedolapo Fasawe, who represented the FCT Minister reiterated the government’s determination to reposition healthcare service delivery in the FCT while revealing that the investigation into circumstances surrounding the death of Ms. Greatness Olorunfemi who was alleged to have died within the premises of the Maitama General Hospital

    She said the recommendations of the panel would not be compromised.

    UPDATED: Tinubu appoints Oyebamiji, Ukeyima as heads of NIWA, Shippers Council

    President Bola Tinubu has appointed Alhaji Munirudeen Oyebamiji as Managing Director of the National Inland Waterways Authority (NIWA).

    The president also approved the appointment of Akutah Ukeyima as the Executive Secretary of the Nigerian Shippers’ Council (NSC).

    In a statement issued on Wednesday by Special Adviser to the President on media and publicity, Ajuri Ngelale, both appointments, which are domiciled in the Federal Ministry of Marine and Blue Economy, were on the recommendation of the Minister of Marine and Blue Economy, Adegboyega Oyetola.

    The statement further said that the President had charged the new appointees to faithfully executive their duties, in line with the policies and programs outlined by the Minister of Marine and Blue Economy.

    He said: “President Bola Tinubu has approved the appointment of two new Chief Executive Officers in Parastatals and Agencies under the Federal Ministry of Marine and Blue Economy in line with the recommendations of the Honourable Minister, H.E. Adegboyega Oyetola:

    Tinubu urges Senate to confirm Aliyu as ICPC chairman, two members of FJSC

    President Bola Tinubu on Wednesday, October 25, urged the Senate to consider and confirm the nomination of Musa Aliyu, a lawyer and Attorney-General of Jigawa state, for appointment as the chairman of the Independent Corrupt Practices and Other Related Offences Commission (ICPC).

    The president also asked the red chamber to confirm Saka Bolaji Suleiman and Prof Gaji Dantata as members of the Federal Judicial Service Commission (FJSC).

    The requests of the President were contained in two separate letters addressed to Senate President Godswill Akpabio and read at plenary by Deputy Senate President Jibrin Barau who presided.

    Tinubu said: “In compliance with the provision of section 3, subsection 6 of the Corrupt Practices and Other Related Offenses Commission, ICPC, Establishment Act 2000,

    “I am pleased to present for confirmation, by the Senate, the appointment of Mr. Musa Aliyu as Chairman of the Independent Corrupt Practices and Other Related Offenses Commission, ICPC.”

    The appointment of Aliyu, according to a statement by the Special Adviser), Media and Publicity to the President, Ajuri Ngelale, last week, was sequel to the request of the outgoing chairman of the commission, Bolaji Owasanoye, whose statutory tenure still remains over three months, “to proceed on pre-end of tenure leave beginning on 4 November 2023”.

    Owasanoye’s tenure is statutorily due to expire on February 3, 2024.

    In a similar vein, the President said: “In accordance with the provision of section 154 of sections 1 and 3, paragraph 12 of Part 1, of the third schedule of the Constitution of the Federal Republic of Nigeria, 1999, as amended, I am pleased to present for confirmation by the Senate the appointments of the under-listed two persons as members of the Federal Judicial Service Commission.

    “Commissioner, number one, Saka Bolaji Suleiman, and number two, Professor Gaji Dantata.”

    Barau referred the two executive requests to the Committee of the Whole for further legislative work.

    President Bola Tinubu has approved N18 billion for the Group Life Assurance benefits and other entitlements for families of fallen heroes of the Nigerian Armed Forces.

    Tinubu announced the approval on Wednesday, during the Launch of the Emblem Appeal for the 2024 Armed Forces Remembrance Day at the State House, Abuja.

    The President also assured of his administration’s continued support to the nation’s armed forces by repositioning the forces.

    U.S. court rejects request for ‘FBI’s report’ on Tinubu

    The United States Court of the District of Columbia has refused a request by one Aaron Greenspan seeking to compel US security agencies to promptly release to him information, including documents relating to President Bola Ahmed Tinubu.

     Judge Beryl A. Howell, in a ruling on Monday, declined Greenspan’s request on the grounds that he failed to satisfy the relevant conditions for the grant of such a prayer for a temporary relief, as contained in the emergency hearing motion, which he filed on Friday.

     Greenspan had, in June, filed the civil suit, with number: 23 – 1816 under the Freedom of Information Act (FOIA), against the Executive Office for U.S. Attorneys (EOUSA), Department of State (DOS), Federal Bureau of Investigation (FBI), Internal Revenue Service (IRS), Drug Enforcement Administration (DEA), and the Central Intelligence Agency (CIA)

     He alleged that the defendants – EOUSA, DOS, FBI, IRS, DEA and the CIA, violated the FOIA by “failing to issue determinations within the statutory deadline,” “failing to conduct reasonable searches for records,” and “failing to produce records responsive to” his FOIA requests.

     Greenspan had, in an FOIA request to the EOUSA, sought for “records from the Northern District of Illinois and/or Northern District of Indiana involving charging decisions for the following individuals – Bola Ahmed Tinubu (President of Nigeria as of 2/2023” and “Mueez Adegboyega Akande (deceased as of 11/16/2022.”

    He claimed that EOUSA, in a letter denying his request, invoked FOIA Exemptions 6 and 7, which protect from disclosure of information that would constitute unwarranted invasions of personal privacy and information compiled for law enforcement purposes that may constitute an unwarranted invasion of the personal privacy of a third party.

     A hearing was subsequently scheduled for October 31 for the defendants to present their responses.

    Greenspan however, returned to the court on Friday to file the emergency motion, upon learning that the Nigerian Supreme Court will hear on October 23 the appeals by the presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar and that of the Labour Party (LP), Peter Obi against the September 6 judgment of the Presidential Election Petition Court (PEPC), which affirmed President Tinubu’s victory in the last presidential election and dismissed the petitions by Atiku and Obi.

    He told the court, among others, that his request for prompt release of the documents, even before the hearing scheduled for October 31 was because ”the Nigerian Supreme Court will hear an appeal of a judicial tribunal’s decision confirming Mr. Tinubu as President of Nigeria on Monday, October 23, 2023.”

    Greenspan claimed that the Nigerian Supreme Court deliberately moved the hearing of the appeals by Atiku and Obi to yesterday to render his suit before the U.S court nugatory, contending that the documents he requested for “would likely be directly relevant to the foreign proceedings in Nigeria.”

    Judge Howell, in the ruling on Monday, held among others, that Greenspan failed to establish that he is likely to succeed on the merits; that he is likely to suffer irreparable harm if the preliminary relief he sought was not granted; that the balance of equities tips in his favour, and that the relief he seeks is in the public interest.

    The judge, who also noted that Greenspan has not established that the purported documents and information he wants the court to compel the defendants to produce actually exist, further held that ”neither a preliminary injunction nor a temporary restraining order is appropriate in this case. 

    “Given that the FOIA request is for records that, if any exist, may be of a highly sensitive and private nature, and that the subject of those documents – Bola A. Tinubu – has had no opportunity to protect his privacy interests in any such records, the balance of equities militates strongly in favour of denying this emergency motion.”

    He held that the position of the law is that, in such a case, the plaintiff bears the burden of proving that he/she is likely to succeed on the merits of the case.

      Judge Howell added: “In plaintiff’s underlying FOIA request and complaint, he seeks documents relating to purported federal investigations into the President of Nigeria, Bola Ahmed Tinubu.  

    “As previously noted, EOUSA originally denied plaintiff’s FOIA request, invoking FOIA Exemptions 6 and 7(c), which protect information that would constitute unwarranted invasions of personal privacy and information compiled for law enforcement purposes that may constitute an unwarranted invasion of the personal privacy of a third party.

     ”Plaintiff has failed even to attempt to argue how his request may overcome those exemptions and achieve a likelihood of success on the merits. This failure to address this important factor in his emergency motion weighs strongly in favour of denying his motion.”

     The judge also found that the plaintiff failed to demonstrate that he was going to suffer actual and real irreparable injury if the relief he sought was not granted, rather than a mere possibility or theoretical injury.

    He added that the “plaintiff falls far short of satisfying this standard. He (plaintiff) has not supplied the court with any indication of a concrete, actual threat that he will suffer in the absence of an injunction. While his emergency motion states that a Nigerian Supreme Court hearing is scheduled to occur in the coming days, plaintiff cites no injury he will suffer that is in any way traceable to the relief requested in this motion.

    “Granting plaintiff’s emergency motion would essentially allow him to jump the line ahead of other requests deemed similarly time-sensitive under FOIA’s expedition standards. The inherent tradeoffs implicated in ordering an agency to produce records in a specific FOIA request ahead of others by granting a preliminary injunction thus, must be considered in evaluating the balance of the equities, and weigh heavily in favour of denying such injunctive relief.

    “Plaintiff has not made any representation to the court that the balance of equities tips in his favour or that the granting of his motion would further the public interest. For the foregoing reasons, it is hereby ordered that plaintiff’s emergency motion for a hearing to compel immediate document production is denied,” the judge said.

    Meanwhile, President Tinubu’s lawyers have filed a motion before the court, seeking to be made a party to enable them defend the President in the suit.

    Generally, information that is not on the public record cannot be obtained through the FOIA. 

    They include information kept in FBI or CIA files that are usually classified.

    FOIA also jealously guards privacy, such as those relating to financial or health records.

    For instance, the Privacy Exemption makes personnel, medical, and similar records inaccessible through FOI requests.

    Such information cannot be disclosed without a “clearly unwarranted invasion” of privacy.

    Privacy is an important value in the United States, both sociologically and legally. 

    Another such exemption protects “pre-decisional documents”. 

    For instance, if a U.S. government investigation is stalled and no action is taken, the papers attached to that process would be “pre-decisional.”

    Tinubu reappoints PTAD ES, Ejikeme

    President Bola Tinubu has reappointed Dr. Chioma Ejikeme as the Executive Secretary of PTAD.

      She resumed at the Directorate’s headquarters in Abuja for a second term of four years on Monday.

    The Executive Secretary (ES) at a hybrid meeting with the management and staff of PTAD reiterated her commitment to their welfare  and the Directorate’s mandate.

    She expressed her appreciation to the staff for supporting her during her first term, noting that the successes she recorded were due to their diligence, dedication, and commitment.

    She commended the Senior Management Team led by Mr. Sulayman Shelleng for consolidating on the gains recorded by the Directorate.

    Ejikeme pledged to deepen relationships with the staff members and solicited their support to achieve more goals.

    Also, pensioners have praised Ejikeme’s reappointment, describing it as a welcome development.

    A pensioner, Comrade Nasir Lawan, congratulated the ES, saying it’s good that she is back.

    “We need to have a more direct and faster line of communication between pensioners and the directorate since we cannot come to Abuja for simple matters. The zonal offices are not helping matters.”

    Mikekun added: “Congratulations, madam. We thank God that you have the opportunity to conclude on Nitel/mtel issue.”

    Jibrin Abubakar said: “Congratulations, madam. May Allah make it easy for you and your generations. Please, don’t forget our 36 code. We have lots of responsibility.’’
