…Directs investigation of rights violations by squad

Following persistent complaints and reports on the activities of the Special Anti-Robbery Squad (SARS) that border on allegations of human rights violations, Acting President Yemi Osinbajo, SAN, has directed the Inspector General of Police (IGP) to, with immediate effect, overhaul the management and activities of SARS.

Any unit that will emerge from the process, he said, should be intelligence-driven and restricted to the prevention and detection of armed robbery and kidnapping, and apprehension of offenders linked to the stated offences.

According to him, the new unit that will emerge should not venture into any other assignment.

The operatives, he said, should also bear proper identification anytime they are on duty.

In the meantime, the Acting President has also directed the National Human Rights Commission to set up a Special Panel that will conduct an investigation of the alleged unlawful activities of SARS in order to afford members of the general public the opportunity to present their grievances with a view to ensuring redress.

  • Osinbajo’s sledgehammer

Last week Tuesday was a day the immediate past Director-General (DG) of the Department of State Services (DSS) Lawal Musa Daura will not forget in a hurry.

He went beyond his powers and saw the bitter part of the Acting President Yemi Osinbajo.

Daura had that Tuesday morning deployed armed and masked security operatives from the DSS to take over the National Assembly complex.

Initially, there was total blockage as lawmakers, journalists, management and staff were denied access.

These took place on a day principal officers of the Senate and the House of Representatives were scheduled to meet by 12 p.m. and to be followed by another meeting with the Chairman of the Independent National Electoral Commission (INEC), Prof Mahmood Yakubu.

Daura’s greatest sin on that Tuesday was his failure to get the permission of the Acting President before taking the action, which many Nigerians have described as anti-democracy.

Shocked by Daura’s action, Osinbajo summoned him and the Inspector General of Police (IGP), Ibrahim Idris to explain the National Assembly blockage.

Osinbajo didn’t hesitate to hit Daura with the ‘sledgehammer’, termination of appointment.

Shortly after their meeting, Daura’s appointment as the DG DSS was terminated while Idris exonerated himself from the drama and National Assembly blockage.

Osinbajo was said to have particularly taken the action against Daura to prevent derailing of the democratic governance in the country and also to distance the Presidency from Daura’s action.

The two quick statements issued that day by the Senior Special Assistant to the Acting President, Laolu Akande reads “The Acting President, Professor Yemi Osinbajo, SAN, has directed the termination of the appointment of the Director General, State Security Service, Lawal Musa Daura with immediate effect.

“Mr. Daura has been directed to hand over to the most senior officer of the State Security Service until further notice.

“Acting President Yemi Osinbajo, SAN, has described the unauthorized takeover of the National Assembly complex earlier today as a gross violation of constitutional order, rule of law and all acceptable notions of law and order.

“According to him, the unlawful act which was done without the knowledge of the Presidency is condemnable and completely unacceptable.

“By this statement, Professor Osinbajo is consequently assuring Nigerians that all persons within the law enforcement apparatus who participated in this travesty will be identified and subjected to appropriate disciplinary action.” he stated

Since last Tuesday, Osinbajo’s action has been commended by many stakeholders and well-meaning Nigerians.

Although some Nigerians believed that Osinbajo, who has remained very loyal to President Muhammadu Buhari, who is holidaying in London, must have sought for his opinion on the issue before sacking Daura.

The response of the Special Adviser to the President on Media and publicity, Femi Adesina, to questions from reporters the following day, disclosed that the Presidency, as a whole, supported the termination of Daura’s appointment.

He said, “What we will like to say for the umpteenth time is that the presidency is one. Whenever the President is proceeding on vacation he transmit power to the Vice President, who then become the Acting President. On this occasion he also did that.

“So the Acting President has all the powers of a President. Now it’s a matter then of decency and we know that the Acting President is a decent man.

“There is no tussle for power, there is no tough battle between him and the President.

“When something like what happened yesterday will happen, there then will be unanimity. There is no way there won’t be unanimity on that kind of decision.

“It’s not something that will be discussed with the press but know that there was unanimity in the decision.” Adesina stated

But some Nigerians, who felt that Osinbajo unilaterally took the decision out of frustration from the series of embarrassment to the Government and to his person as a church pastor, feared that his decision may be rescinded when the President returns from holiday in London.

They based their fears on the recent past when the appointment of the suspended Executive Secretary of the National Health Insurance Scheme (NHIS), Prof. Usman Yusuf, was reinstated by the President on the 6th of February 2018.

Osinbajo, who was also the Acting President when President Buhari was in London last year, had approved through the Minister of Heath, Prof. Isaac Adewole, the suspension of Yusuf on 6th of July, 2017 over allegations of fraud.

The Economic and Financial Crimes Commission (EFCC) was alleged to be investigating Yusuf for over N900 million fraud.

Yusuf, whose suspension was based on allegations of abuse of office, nepotism and insubordination, was accused of buying a brand new Toyota Sports Utility Vehicle with number plate, NHIS 12Y-01 FG, for N58m, without the express approval of the Health Minister  for items above N2.5 million.

But before EFCC and ICPC could finish their investigations and make their findings public, a letter purportedly issued by the office of the Chief of Staff to the President, Abba Kyari, reinstated Yusuf on the 6th of February 2018.

Some of the common factors between Daura’s and Yusuf’s cases are that they are both from the northern part of the country and the two cases happened while Osinbajo was Acting President when the President was in London.

But while the Yusuf’s case has to do with corruption allegations, Daura’s case borders on national security and threats of truncating democracy.

The fears that Daura may, at the end of the investigations, get soft landing, were further fueled by last Wednesday’s statement by the All Progressives Congress (APC).

The statement issued by the APC National Publicity Secretary, Mr. Yekini Nabena, reads in parts: “Following Tuesday’s incident at the National Assembly, our investigations have now uncovered the sinister plot hatched by the Senate President, Dr. Bukola Saraki, to foment violence in the legislative chamber all in a bid to stop his impeachment.

“Our investigations uncovered and noted the following: We are now aware that the timely intervention of the security operatives forestalled the planned violence which could have led to possible deaths, injuries, and destruction of property in the National Assembly on Tuesday.

“Why did the Senate President mobilise thugs to the National Assembly who almost lynched Hon. E.J. Agbonayinma, the only APC federal lawmaker present but for the timely intervention of security operatives.” it stated

Will Lawal Daura be recalled soon to head the DSS like Yusuf’s case, or given soft landing or prosecuted for the sins leveled against him?

Only time will tell how the Lawal Daura story will end.

  • National Assembly shut down: protesters defy rain to demand probe

Hundreds of protesters led by the Campaign for Democracy and the coalition of civil society groups today trooped out to protest what they call an affront on the institution of democracy in Nigeria through last Tuesday’s siege on the  National Assembly by men of the Department of State Services (DSS)
The protesters chanting SOLIDARITY and pro democracy songs marched through the Obafemi Awolowo Way Ikeja under heavy downpour,  to the Lagos state house of assembly.
Speaking through their leaders, Comrade Olufemi Lawson of the Campaign for Democracy and Omotaje Saint Jericho, the protesters described the seige on the National Assembly by men of the department of stshut downate security service as an attack  on democracy and an attempt to force a civilian “coup” on the country and abort the peaceful Democratic institutions in the country. They asserted that the legislature is the only institution in the arms of government that distinguishes a democracy, from other forms of government,  as other arms of government are often in existence,  even in a military rule.
They further said,  that just as in the days of the military rule, the civil society shall do all that is necessary in the interest of the defence of democracy and their protest will spread across the country to forestall any other attempt by any person or persons to challenge the Democratic institutions for selfish partisan reasons.
The group asked acting President Yemi Osinbajo, to immediately constitute a judicial panel, to unravel the masterminds of the siege on the National Assembly and bring whosoever is found culpable to justice, without any delay.
The groups called on all well meaning Nigerians and lover of democracy to come out and defend our nascent democracy and save it from the anti Democratic elements that has found themselves in power.
  • Saraki had no business with Daura, sacked DSS chief,

A former member of the All Progressives Congress (APC) Comrade Timi Frank has dismissed insinuations that the sacked Director General of the Department of State Services, Lawal Daura was sacked for working for Senate President, Bukola Saraki and asked Acting President, Yemi Osinbajo to order full investigations into the invasion of the National Assembly.

Frank said in a statement made available to newsmen in Abuja on Thursday that National Chairman of APC, Comrade Adams Oshiomohle, his deputy Niyi Adebayo, the Chief of Staff to the President Abba Kyari and the sacked DG of SSS, Lawal Daura should be held responsible for the deployment of armed SSS personnel that laid siege at National Assembly.

He said that at no time did the President of the Senate had anything in common with the former DG of SSS apart from official duty, adding that both the National Chairman of APC and the sacked DG SSS with other known cabals in the presidency actually planned the siege on the National Assembly.

“Sources close to the Clerk of National Assembly privy to his travel itinerary also revealed to us that the Clerk, based on the instruction given to him by those mentioned above, had no choice than to cancel his planned vacation.

“With this available information, I hereby call on Acting President Yemi Osinbajo if he is genuinely committed to get to the bottom of the siege at the National Assembly to consider above information given.”

  • NASS siege: Ohanaeze calls for thorough investigation

…Says action amounts to coup d’état

The Igbo Socio-cultural group, Ohanaeze Ndigbo, has called on the Federal Government to conduct a thorough investigation into Tuesday’s siege at the National Assembly by operatives of the Department of State Security (DSS).

The organisation, in a statement signed by its The President General of the Ohanaeze, Chief John Nnia-Nwodo, on Wednesday in Abuja, described the action of the security operatives as an equivalent of a coup.

He said all the characters that participated in the act either directly or indirectly be made to face the law in order to act as a deterrent to overzealous operatives.

Chief Nwodo, called on to the Acting President, Prof. Yemi Osinbajo, to go beyond the sacking of the former Director General of DSS, Lawal Daura and institute a high powered investigation to fish out all the culprits involved.

He said it was not possible for the DSS to carry out the siege alone without the involvement of the Nigeria Police.

Chief Nwodo doubted the noninvolvement of the Police on the siege and urged the VP to critically examine the role of the Police and its claim that it did not participate as possible after thought only after the ‘coup’ failed.

The Ohanaeze leader said the siege brought an enormous embarrassment to the country, urging the government not treat the matter with levity.

The statement reads: “If the state security can just wake up and seal up the National Assembly housing the country’s parliament they could go further one day to over throw government after discussing with some interest groups.

“As a constitutionally recognized arm of government with its own statutory responsibilities, if there is a disagreement within them, they should be allowed to resolve it themselves unless there is violence before the security can be involved.

Chief Nwodo noted that democracy would be better served if all the arms of government are allowed to operate without undue interference from each other.

  • Benue State Account freezing, unconstitutional, says NGF

Says EFCC action will shut down govt

Hails Osinbajo for DSS boss sack

Zamfara State Governor, Abdulaziz Yari on Wednesday said that freezing accounts of Benue State government by the Economic and Financial Crimes Commission (EFCC), was an attempt to shut down the state.

Yari, who is also the Chairman of the Nigerian Governors Forum (NGF), also described the action of EFCC as unconstitutional, and wrong especially as the state was still battling with security challenges.

He spoke with State House correspondents after meeting the Acting President, Yemi Osinbajo, at the Presidential Villa, Abuja.

He urged the Federal Government not to allow security agencies to become lawless.

He said “The freezing of any account of the state government whether Benue or anywhere is unconstitutional and is not right. That is shutting down government. Government must spend, most especially Benue that is facing insecurity challenges.

“Well, we don’t know why the EFCC took the action. But if indeed EFFC freezed the account, from my point of view, it is wrong.

“This government will not sit down and oversee unlawful operation from the security agencies. From what happened yesterday (Tuesday, Daura sack), everyone can understand that government is following due process and the laws of Nigeria.

“For one to just send security agencies to shut down the National Assembly, and the action that followed, that is what gave credit to this government by local and international community.

“Similar thing had happened in 2011 and 2014 respectively, but nothing was done about it, this time around, government said enough is enough. But the government of Muhammadu Buhari is following due process and will never oversee an unlawful activity by any security agency. So in the case of Benue, I believe something must be done.” he said

Also speaking to State House correspondents, Governor Umar Ganduje of Kano state condemned Tuesday’s invasion of the National Assembly by security agents, saying that the legislature must be allowed to operate according to law.

He said: “To use security agencies in trying to prevent them from doing their own normal legislative functions, i think it wrong.

“But I have to salute the acting President for taking immediate action in order to save the situation.

“The National Assembly is a very important institution and we not embarrass ourselves and allow foreigners to view us as undemocratic. It’s very important.

“The situation now has been corrected. It is something that  is unfortunate, we have to move forward.” he added

  • NASS invasion: Speakers’ Chairman commends Osinbajo’s intervention

Chairman, Conference of Speakers of State Legislatures of Nigeria, Mudashiru Obasa has commended the acting President, Professor Yemi Osinbajo, for his timely action on the invasion of the National Assembly by the men of the Department of State Security (DSS) on Tuesday.

Obasa reacted to the invasion in a press statement describing it as sacriligeous and inimical to the growth of democratic values and ideals.

Obasa who is also the Speaker of the Lagos State House of Assembly described Osinbajo’s action as very timely which has not only succeeded in cooling the already heated polity but has also brought credibility to the Federal Government both at home and abroad.

“The acting President has acted timely and this has confirmed that the Presidency has no hand in the invasion of the National Assembly. This has brought credibility to the government and show its sincere commitment to rule of law and justice,” Obasa said.

Obasa condemned the invasion describing it as a desecration of the sanctity of the Parliament. “The action of the DSS is condemnable because it’s a desceration of the sanctity of the Parliament. But the acting President has restored the pride of the Parliament through his timely action,” he said.

The Chairman of the Speakers Conference further reiterated that he and his colleagues had warned in the communique issued at the end of their meeting in Lagos at the weekend that the Nigeria Police and in essence other security agencies should be more professional and apolitical in the discharge of their constitutional responsibilities by desisting from invading and occupying legislative houses in the country.

“This invasion, coming barely 48 hours after our meeting, is sacrligeous and inimical to the growth of democratic values and ideals because the Parliament is the anchor on which Democracy stands. Any attempt to desecrate it, will have negative lasting impact on democracy,” he said.

Men of the DSS invaded the National Assembly and prevented staff and lawmakers from going into the complex early yesterday morning.

Professor Osinbajo in a swift reaction ordered the sack of the DSS Director General, Lawal Daura for what the Presidency described as unathorised action.
