    Reps vow to recover $30b accrued fees, bonuses from oil firms

    The House of Representatives has said it had taken steps to recover over $30 billion in accrued fees and bonuses from mergers of multinational oil companies operating in the country.

    In a resolution that followed a motion sponsored by the member representing Somolu Federal Constituency, Ademorin Kuye, the House asked its relevant committees to conduct an investigation into the issue and recover the money for the country.

    Kuye said the oil industry experienced several lateral mergers/buy-overs/takeovers of companies in the same oil and gas exploration, prospecting, production and marketing in the ‘90s.

    According to him, Section 2 of the Petroleum Act, 2014 – the extant law applicable under which the merger took place – provides that the oil exploration licences, oil prospecting licences and oil mining licenses may be granted to only Nigerian citizens or companies incorporated in Nigeria, implying that mergers that resulted in a corporate body not indigenous to Nigeria in their incorporation would exclude the new entity from the scope of companies that could be given a licence or lease under the Petroleum Act.

    Kuye explained that the June 1984 merger of Gulf and Chevron, which he said brought Chevron through the backdoor to inherit Gulf Oil operations in the country, was not approved until July 1991.

    The lawmaker said this only happened after careful consideration and bargaining that still shortchanged the country to the tune of $65 million at that time.

    He noted that other mergers between Exxon and Mobil to form ExxonMobil; Elf, Total and Fina to form TotalFinaElf, and between Chevron and Texaco to form ChevronTexaco, resulted in new entities and companies that should have been subjected to certain procedures and processes.

    The processes, Kuye said, are applications for assignment of interest in each block; payment of reserve value in each block; payment of a sign-on or signature bonus in respect of each block; fresh registration at the Corporate Affairs Commission (CAC); and fresh commitment to social, community and environmental policies in Nigeria that were not done.

    The lawmaker expressed concern that the mergers, though increased assets of foreign oil multinationals in the country, resulted in the layoff of hundreds of Nigerian professionals and brought some companies through the backdoor.

    He cited the example of Exxon and Fina, which he said were not physically present in Nigeria in their registered names and identities.

    Kuye also expressed concern that the proper sign-on of the oil block inherited as assets was not done, thus costing the country millions of dollars in signature bonuses and reserve value payments that should have been paid.

    He stressed that as a result of the anomaly, the country bled a revenue of over $30 billion in signature bonuses, reserve values and assignment fees of 43 oil blocks where merging companies operate.

     Bayelsa State Chapter of the All Progressives Congress (APC) have raised the alarm over plans by  the Peoples Democratic Party (PDP) in the state in cahoots with the state government   to cause a breach of the peace in Bassambiri-Nembe, a stronghold of the APC.

    A statement signed on Thursday in Yenagoa by the State Publicity Secretary, Mr. Doifie Buokoribo, revealed that as part of the plans, lawless men of the armed forces, and other outlaws from neighbouring states, have been allegedly mobilised with state resources to plant arms in some houses in the community to  cause mayhem.

    “The goal of this scorched earth policy is to make it extraordinarily difficult for electoral officials to gain access to the place, harass and intimidate our members and supporters, and ultimately prevent the November 11, 2023 elections from holding in Bassambiri-Nembe, our stronghold.

    “We consider this intelligence credible as the PDP is now desperate, knowing that the Bayelsa people are not with them. Their performance in office has been lamentably poor. Hence they are not campaigning on any known record of achievement. Instead the PDP is running from court to court, trying to stop the APC from being on the ballot. Not only are they threatening violence, they are actually visiting violence on our members in places like Opokuma, Odi and Kaiama in Kolokuma/Opukuma Local Government Council (Governor Diri’s local government)  and Sangana in Brass Local Government Council,” the statement said.

    He added that the APC is committed to a free, fair and credible election  which can only be guaranteed in an atmosphere of peace.

    Peoples Democratic Party (PDP) governors yesterday justified their backing of President Bola Ahmed Tinubu’s intervention in the Rivers State political crisis.

    They explained that the Nigeria Governors’ Forum (NGF) was desirous of the quick resolution of the conflict, adding that the president’s mediation became necessary to prevent its spread to other states. 

    As the NGF intensified its crisis resolution, Federal Capital Territory (FCT) Minister Nyesom Wike said he had no cause to interfere in the governance of Rivers, having served its people for eight years as governor.

    He maintained that his priority was limited to the protection of the political structures built since 2015.

    Governor Siminalayi Fubara, who had assured that the rift between him and the minister would be amicably resolved, secured another court injunction that put on hold the impeachment moves against him by the House of Assembly.

    Why we supported Tinubu’s mediation, by PDP governors

    PDP Governors’ Forum Chairman, Bauchi State Governor Bala Mohammed, defended President Tinubu’s intervention in the rift.

    He said contrary to criticisms by some PDP chieftains believed to be loyal to former Vice President Atiku Abubakar that its commendation of President Tinubu was “too patronising” and capable of leading the PDP into oblivion, the truce brokered by him was consistent with the NGF agenda.

    The Forum’s Director General, CID Maduabum, said in a statement that the action of the Bauchi governor was an act of courtesy.

    He added that Tinubu’s intervention in Rivers and his non-interference in the proceedings of the election tribunals were commendable.

    The Forum’s statement reads: “For the avoidance of doubts and to clarify the sequence of events, it was, in fact, the Chairman of the NGF, Governor Malam Abdul-Rahman Abdul-Razaq of Kwara State, an APC Governor, that took leadership in intimating Mr. President of the situation in Rivers State.

    “All the governors of 36 states supported the move. In particular, the Chairman of the PDP Governors’ Forum, Bala Mohammed, lent his weight and support to the move. 

    “It should be noted that Gov. Fubara is a member of the NGF and the Vice-Chairman of the PDP Governors’ Forum. President Tinubu agreed to intervene as requested.

    “It is most disingenuous for certain persons to lampoon the courtesies extended to Mr. President for his intervention. 

    “It should be noted that the events that played out in Rivers had national security implications; it had the potential to lead to a breakdown of law and order. 

    “Indeed, the Rivers State Police Command acknowledged as much in its statement issued on Wednesday, November 1, 2023.

    “Mr. President as the Commander in Chief of the Armed Forces, and effectively the Chief Security Officer of the nation, had to intervene to nip the crises in the bud. “Indeed, Nigeria’s history is replete with instances where a development in one state could snowball and affect the whole country. 

    “Rivers State is one of the major oil-producing states in Nigeria. A breach of the peace in Rivers State, considering its strategic value and importance, no doubt, could affect other states of the federation.

    “Indeed, it is a sign of good leadership and a high sense of duty that Gov. Mohammed summoned and held an emergency meeting of the Forum immediately after the Rivers State matter came up. We think that he deserves credit for this.”

    Flaying the attacks on Governor Mohammed, the Forum added: “There is no way Governor Mohammed, being a lover of peace in all parts of the country, could fold his hands and fail to act or appreciate the good efforts of the President in finding a solution to the crisis.

    “This further explains the shuttle diplomacy employed by the PDP Governors’ Forum led by Governor Mohammed in visiting and counselling the dramatis personae in the crises.

    “Those castigating the Chairman and other members of the PDP Governors’ Forum seem to have forgotten that the unity, peace and tranquillity of the country transcend politics and political leanings.

    “The Chairman of the PDP Governors’ Forum has not in any way done anything wrong by thanking the efforts of the President to resolve the crisis in Rivers.

    “Senator Mohammed is not trying and will not do anything to hand over the PDP, a leading and formidable opposition party, to the President, who was elected on the platform of another party.

    “The situation in Rivers on October 30 was not just a PDP affair.”

    Wike: We will defend party structures

    Wike, who received members of the Rivers State Caucus of the National Assembly in Abuja, said the onus was on stakeholders to defend the party structures.

    The federal legislators who visited his office in solidarity reiterated their loyalty to the minister. 

    Wike emphasised that any move aimed at destroying the political structures that were built since 2015 will be resisted.

    He said he was not interested in the governance of Rivers, stressing that his hands are full as FCT minister.

    He said: “I am not interested in the governance of Rivers. I am here as governor in FCT. I am interested in the political structure we’ve built over the years in Rivers.

    “Anybody who tries it will get the resistance of his life; anybody who puts his hands in Rivers political structures, what you see, you see.”

    The minister chided those who accused him of demanding 25 per cent from Fubara, saying that they were ignorant.

    He said: ‘’I was governor for eight years. I am now FCT minister, not just minister, and some will say that I am asking for 25 per cent; that is madness.”

    Wike said in life, people should learn to appreciate those who in one way or another contributed to their lives.

    He charged the legislators not to disappoint the state and the country.

    Wike stressed: “Those of you that God has given the opportunity, don’t disappoint your state, don’t disappoint Nigerians. 

    “When you make a mistake, we will call you to order. Take it in good faith; don’t say we are coming for kickbacks.”

    The leader of the delegation, Kingsley Chinda, House of Representatives Minority Leader, said: “We thank you for your invaluable support for all of us. You supported us all through the primaries. You are the reason why we are in the National Assembly today.”

    Chinda noted that in barely three months, Wike has changed the face of the FCT, reminiscent of his days as governor of Rivers.

    He also condemned the political crisis in the state, saying that it was unwarranted.

    Members of the Rivers State National Assembly Caucus that visited Wike were all three senators from Rivers State and 11 House of Representatives members.

    They are: Senators Barinada Mingi, Ipalibo Harry Banigo and Allwell Onyeso.

    The House members apart from Chinda are Honey Felix Nwike, Boniface Emerungwa, Blessing Emezureke, Victor Onozor, Fun Deakor, Solomon Bob, Kelechi Nworgu, Hart Cyril Goodwill and Allison Anderson.

    Impeachment: Another court restrains Rivers Assembly, others

    A Federal High Court in Port-Harcourt, Rivers State, restrained the House of Assembly from proceeding with the impeachment of the governor.

    Justice Phoebe Ayua issued the warning while ruling on an ex-parte motion filed in a suit instituted against the state Assembly and eight others by two members of the PDP in the state – Amadi Madubuochi and Goya Oluka.

    The judge gave the ruling after listening to Eric Omare, counsel for the applicants/plaintiffs.

    The lawyer argued that the move to impeach Fubara was unlawful because the legislators had not established any wrongdoing against him.

    In a copy of the enrolled order, Justice Ayua said: “An order is made directing that all parties on record respect the court and should not take any step concerning the subject matter in this matter, since the matter is already before this court (sub judice), pending the hearing and determination of the motion on notice.”

    Justice Ayua also ordered that the respondents be notified about the pending suit, marked: FHC/PH/CS/234/2023 and motion on notice for interlocutory injunctions.

    He adjourned till November 9 for a hearing of the motion on notice.

    Respondents/defendants in the suit are the Rivers State House of Assembly, the Speaker, Deputy Speaker, the Chief Judge, the Commissioner of Police, the Director of Department of State Services (DSS), the Governor, the Deputy Governor of Rivers State and the Inspector General of the (IGP).

    Uzodimma faults NLC claim on Ajaero

    Imo State Governor Hope Uzodimma yesterday shed light on the crisis rocking the Nigerian Labour Congress (NLC) in his state.

    He blamed it all on NLC President Joe Ajaero who he accused of “mixing partisanship with Labour affairs”.

    The governor spoke to the crisis during an interview with State House reporters in Abuja after receiving the ruling All Progressives Congress (APC) flag from President Bola Ahmed Tinubu as candidate in the November 11 poll.

    Uzodimma was in the company of the party’s stand bearers Timipre Sylva (Bayelsa) and Usman Ododo (Kogi). The duo also got the APC flags from the President.

    Ajaero, who was in Owerri on Wednesday to mobilise workers for a “shut down”  of Imo, was attacked at the Sam Mbakwe Airport before security operatives moved in “to take him to a protective custody”.

    The NLC rejected the police claim on protection for Ajaero, saying the police were part of his attackers.

    Uzodimma accused Ajaero of being unable to distinguish his role as a national Labour leader and being a partisan Imo State indigene. 

    As the Chief Security Officer (CSO) of the state, the governor said he intervened to stop the dissolution of the state chapter of the NLC, whose tenure he said had not expired.

    On why Ajaero was attacked in the state, Uzodimma said: “I wanted you people to be very careful because there is an attempt to mix up partisan politics or an attempt to blackmail my government, but I can tell you that my people are already aware of that.

    “That was why the NLC (Imo State chapter) addressed a new conference that what their national leadership is doing is not correct and that they are not going to do any strike or protests and in the process, they decided to dissolve them to put in a caretaker.

    “Of course, I’m the Chief Security Officer and I have a responsibility to intervene. I encouraged the national leadership not to dissolve a management team that their tenure has not expired and that was what they did.

    “I don’t interfere with Labour matters, but I have convinced my workers in Imo State to believe in me and that trust is what opposition parties are trying to fight.

    “But, I can assure you that Imo people already have taken that decision.

    Labour, FMC differ on treatment claim

    The management of the Federal Medical Centre (FMC), Owerri, disagreed with Lanour union’s claim that Ajaero will be flown abroad to treat the injuries he sustained because he could not be treated in the facility.

    NLC Public Relations Officer (PRO) Benson Upah said Ajaero will be travelling overseas to treat the injuries he sustained during the botched workers protest.

    Upah claimed that Ajaero was first taken to the police hospital where he was given first aid treatment but because there were no facilities to treat him there, he was taken to the FMC.

    The Labour official said: “What happened was that at 3.30pm on Wednesday, we were able to make contact with him. The police rushed him to the police hospital but there were no facilities there to treat him; from there to the FMC where they found out that he needed Ultrasound and Optical Coherence Tomography to scan his eyes, as well as another machines to scan his brain and ear.

    “The FMC couldn’t handle all these and our conclusion is to fly him out of the country where his condition can be handled.”

    But the FMC spokesman, Dr. Josy Achonu, counter the claim by the Labour official. He insisted that the hospital has full accreditation for all its departments.

    Mrs. Achonu said: “All our departments including the Ophthalmology department have full accreditation.”

    She further informed that every consultant was around to treat Ajaero, adding that the hospital bills were written off on the orders of the Chief Medical Director.

    She said: “All consultants were present to treat him and he was treated free of charge. Our MD gave a directive that his bill be offset. So, he was given the best of treatment and even the NLC members have come to the hospital to thank us.”

    Dangote Industries Limited (DIL) yesterday warned against linking the firm to any form of economic sabotage.

    It gave the warning following claims, suggesting that the company is being probed for an alleged illegal foreign exchange deals and money laundering.

    In a statement, DIL described the allegation as “spurious and a rehash of a similar report peddled out of malice by a competitor masquerading as a concerned Nigerian in 2016.”

     The statement, signed by the management of DIL, reemphasised that foreign exchange for its numerous projects were sourced strictly from Interbank Foreign Exchange market in compliance with the CBN approvals.

     For instance, DIL explained that in all its transactions, “Letters of Credit” were established for the construction of the various operational plants and for the purchase of heavy equipment and spares required for the take-off of the Dangote Cement plants.

     ”The terms and conditions for payments on the transactions were clearly spelt out in the Letters of Credit instruments and in line with International Chamber of Commerce – Universal Customs & Practice for Documentation Credit – UCP 600. It is also crucial to note that the Letters of Credit in favour of Sinoma International Engineering Co Ltd (a Chinese Government owned company), being the major contractor who accounted for over 75 per cent of these expenditure were paid against the presentation of all relevant shipping documents. There was no single payment that was made through any Dubai company owned by us,” the statement noted.

     DIL explained its forex dealings thus: “all FX purchased in respect of our African Projects expansion were fully utilised for what they were meant for. The projects for which the FX was utilised are visible for everyone to see. It is on record that some of these projects were commissioned by Nigerian top-ranking government officials and in attendance were Chief Executives of various banks, Captains of Industries and the Presidents of the host countries supported by their Senior Government Officials.”

     The company further stated that funds invested in its expansion project across African countries are legitimate capital investments in those countries and the repatriation of FX in sum of $576 million so far has helped to boost foreign Exchange earnings in Nigeria and stabilise the FX Market. Besides, DIL emphasised that it had always funded the construction of her various plants from Interbank FX Market in line with the CBN directives and relevant periodic progress reports were submitted to the banks for onward submission to the Central Bank of Nigeria.

     ”The regulations of the host countries require in most cases that payment to some local vendors, contractors and supplies are done locally for regulatory and tax purposes. Subsequently, funds for pre-operational expenses and purchase of other local construction materials are transferred to our Project Accounts in the host countries for payment to vendors in line with the countries’ regulations. All these transactions were well documented and approved. This has enabled us repatriate FX into Nigeria. All the payments made in respect of our various African Projects can be further verified, having been audited over the years by our auditors, Messrs Deloitte & Touche and KPMG in course of their statutory audits,” the DIL statement said, adding that “specifically, CBN gave us approvals between 2010 to 2018 to purchase FX totaling $3.755billion from the Interbank market for the funding of our various African Projects out of which we have utilised only 47.70 percent of the approvals in the total sum of N1.791billion.”

    Federal Capital Territory (FCT) Minister Nyesom Wike has promised to provide infrastructure before allocating land in the territory.

    Wike spoke yesterday when he hosted the Chief Judge of the Federal High Court, Justice John Tsoho, who urged him to consider the judiciary in the allocation of land in the FCT.

     The minister noted that there is no economic sense in allocating land to people in areas that are not accessible.

    Wike, who affirmed his respect for the Judiciary and the Legislature, said he believed in the equality and independence of the three arms of government.

    The minister said President Bola Ahmed Tinubu had mandated him to provide land to key officials in the three arms, assuring that he was developing a template that would see the allocation done in phases.

    He said: “Like you rightly said, I believe that the three arms of government must work together, even though independently. I believe that no arm of government should be treated lesser than the other.

    “Without the judiciary, our democracy cannot survive. Nigerians are talking about the judiciary today because of the role you play. So, whatever is required to strengthen the judiciary is not over-demanding.

    “Before now, the President had given me the go-ahead to allocate land to the Legislature, the Executive, and the Judiciary. What remains now is how it should be done, because the number is much. What we have decided to do is to do this in phases. All cannot be done at the same time. 

    “Some allocations were done in the past but, unfortunately, some of the places are inaccessible. I think it is baseless allocating land where people have no access, that is, infrastructure. It does not make any sense. So, we will allocate land to you in places that are accessible.”

    Justice Tsoho hailed Wike for his continued support to the judiciary.

    The judge recalled that as Rivers State governor, Wike prioritised the welfare of judicial officers.

    He said Wike’s great antecedents in Rivers must have earned him this current position.
