    Court dismisses eighth suit seeking to disqualify Tinubu, APC

    The Federal High Court in Abuja has dismissed a suit seeking to disqualify the All Progressives Congress (APC) and its presidential candidate, Asiwaju Bola Tinubu, from next year’s general election.

    Justice A.R Mohammed, in a judgment delivered on December 23, struck out the suit for being a misjoinder of causes of action.

    The judge further held that the plaintiffs lacked the locus standi to institute the suit having not participated in the presidential primaries complained of.

    The suit, filed by Menuma Suleiman and three others on July 7, 2022 as Suit No: FHC/ABJ/CS/ 1094/ 2022, is the eighth suit seeking to exclude Tinubu and the APC from the presidential race.

    The plaintiffs listed the Independent National Electoral Commission (INEC), the APC, Tinubu, the National Assembly and the Attorney-General of the Federation/Minster of Justice as the 1st to 4th defendants.

    They sought the following reliefs:

    A declaration that Section 29(5) of the Electoral Act, 2022 is ultra vires the 4th Defendant (NASS) and therefore unconstitutional, null, void and of no effect whatsoever.

    An order striking out/striking down Section 29(5) of the Electoral Act, 2022 and the body of existing and extant laws of the Federal Republic of Nigeria same being ultra vires the fourth and fifth defendants (AGF) is unconstitutional, null, void and of no effect whatsoever.

    A declaration that the third defendant (Tinubu) has presented a forged certificate to the iNEC for the purpose of seeking to be elected into the office of the President of the Federal Republic of Nigeria.

    A declaration that the third fefendant stands disqualified from participating in the 2023 Presidential election as candidate of the second defendant (APC) having presented a forged certificate to the INEC for the purpose of seeking to be elected as President of Nigeria.

    An order of disqualifying the third defendant from contesting or participating in the forthcoming 2023 presidential general election as a candidate of the second defendant.

    Section 29 (5) provides:- “Any aspirant who participated in the primaries of his political party who has reasonable grounds to believe that any information given by his political party’s candidate in the affidavit or any document submitted by that candidate in relation to his constitutional requirements to contest the election is false, may file a suit at the Federal High Court against that candidate seeking a declaration that the information contained in the affidavit is false.”

    In defence of the suit, the law office of Babatunde Ogala (SAN) & Co on behalf of APC filed a Counter-Affidavit in opposition to the Originating Summons and a Notice of Preliminary Objection on five grounds.

    They are that the originating process is incompetent, the plaintiffs lacked locus standi, the suit discloses no cause of action, the suit is statute barred, and is an abuse of court process

    When the matter came up for hearing on December 23, 2022, the APC’s counsel Julius O. Ishola of Babatunde Ogala & Co, adopted the Notice of Preliminary filed and prayed the Court to dismiss/strike out the suit for want of jurisdiction.

    But the plaintiffs’ counsel opposed him and filed a written address and adopted same in praying the Court to dismiss the objections and proceed to determine the suit on its merit.

    Justice Mohammed agreed with learned counsels to both the 2nd and 3rd Defendants and struck out the suit for being a misjoinder of causes of action.

    The judge further held that the Plaintiffs lacked the locus standi to institute the suit having not participated in the presidential primaries complained of.

    This judgment brings the number of cases that have so far been dismissed against Tinubu’s presidential candidature to eight.

    President Muhammadu Buhari has urged Nigerians to vote for those who will maintain the momentum created by his administration.

    He promised to continue working towards leaving lasting legacies.

    The President also wished Nigerians a merry Christmas.

    He said in his Christmas message: “Until my last day in office, I will continue to provide political and material support to sub-national governments, the Armed Forces, institutions and individuals working wholeheartedly for the peace, unity, stability and progress of Nigeria.

    “The advances we have made so far on the economic front, especially in infrastructure; food security, anti-corruption, security, energy sufficiency, among others, will need to be built on.”

    He urged Nigerians to vote wisely.

    “This joyous season has coincided with the period of campaigns to usher in a new administration.

    “I urge you to be circumspect and vote for those that will maintain the momentum we have created for the greater good of the country.

    “It is another opportunity to show the rest of the world that Nigeria is indeed ready to consolidate its democratic credentials as has been noted in international circles.

    “Let the peace and joy that pervade this period continue well into the new year up to the elections in February and beyond.

    “I want to assure Nigerians that those who violently seek to disrupt the peace of our nation have lost the battle.

    “For me and my family, this year’s celebration is unique. It is my last as your elected President.

    “Twenty-two weeks from now, this administration will hand over to another.”

    Buhari: those who called me Jubril of Sudan mischievous

    President Muhammadu Buhari has described those who spread the rumour of him being replaced with a Jubril Aminu from Sudan as mischievous.

    He spoke at a get-together by family and associates to mark his 80th birthday.

    It was held in the Old Banquet Hall of the Presidential Villa in Abuja on Friday night.

    In the aftermath of President Buhari’s prolonged hospitalisation in London, it was claimed that he died in the process of being treated and was replaced by a body double.

    He left the country for treatment in London in May and returned in August 2017 after 103 days.

    President Buhari said he would continue to do his best in service to Nigeria despite criticisms from some quarters that he has not done enough.

    At the special birthday event, a documentary was aired on his life from childhood, where he declared that he was not bothered by the claim that he died long ago and is not the real Buhari.

    Responding to a question in the documentary on whether the claim affected him, he said he heard the rumour but was not distracted.

    President Buhari said: “Yes. People said I am somebody from Sudan. I didn’t bother with the name. Some Nigerians have mischievous ways of explaining themselves.

    “No. It’s not funny because those who made those statements, they just want to be cheeky. They want to distract attention from the main issue.

    “Our main issue is to do the infrastructure, make people aware that they need to work hard to live well; they just enjoy life without earning the respect of their community and so on.”

    On what he will miss the most after leaving office in May next year, the President simply said “nothing much”.

    “I wonder if I am going to miss much. I think I’m being harassed.

    “I believe I’m trying my best but still my best is not good enough because there are people around that think that they can intimidate me to get what they want, instead of going through certain systems to earn whatever they want to earn and they are same people who want to be clever by half,” he said.

    While proposing a toast for the celebrant, Vice President Yemi Osinbajo described the Nigerian leader as a forthright, good and kind man, as well as an exemplary leader.

    He praised President Buhari for leading the nation with great courage, determination and commitment.

    “I invite your excellences, ladies and gentlemen, to join me in proposing this toast to an exemplary leader, a forthright and honest man, a good and kind man, and a man who has led this country with great courage, determination and commitment for so many years.  

    “We pray that the almighty God will preserve his life for very many years to come and that he will live all of these many years in good health, peace, joy and with the love of all of our country men,” he said.

    Presidential candidate of the All Progressives Congress (APC), Asiwaju Bola Tinubu, who also graced the occasion, thanked President Buhari for sacrificing a lot for the progress of Nigeria.  

    “You have been at the helm of the affairs of this country at a critical time. We have seen a life of commitment, dedication, patriotism and honesty. Mr President, you have done well for your country. Our nation has seen the difference, the leadership that you demonstrate,” he said.

    He said President Buhari belongs to the class of leaders who came and served their country with commitment, dedication patriotism and honesty. 

    He likened him to leaders like Charles De Gaulle of France, Franklin Roosevelt of the United States of America (USA) and Winston Churchill of the Great Britain.

    Tinubu, accompany by his running mate Senator Kashim Shettima, said: “The leadership you have demonstrated reminded me of the speech you gave at the Primary Convention when you won the nomination.

    “You thanked the people with all humility and said even if you had the money, you would not have paid, but that is because they know who you are, a man of integrity, great commitment, transparent and a exceptional humility.”

    Tinubu prayed that “God will continue spare you to see the history as you want it for the country, the ship of this nation will be on the right course. You will live long to enjoy a nice evening of democracy that you brought about. 

    “When you talk of PVC, card reader, transparency and honesty in the electoral process, like you did, we can only promise not to let you down. Enjoy 80 till you celebrate other birthdays,” he said.

    Also eulogising the President, former Ogun State governor, Senator Ibikunle Amosun, described the President as a man with an impeccable character and somebody that loves Nigeria.

    “He is a man whom all of us; even his adversaries will agree that this is a man with a flawless character, a man with a good heart, very compassionate, very committed and a good listener. 

    “Somebody that loves his family, Nigeria; he is a nationalist. President Muhammadu Buhari will always think about others. In his own little way and even in his humorous way, he will always not just think about himself.

    “He is somebody tha is not bothered about all these worldly things he is already a contented human being,” he said.

    Ebonyi State Governor, David Umahi described President Buhari as a detribalised person that means well for Nigeria.

    “Let me say here that the President is a very highly detribalised personality.

    “He is a man that loves this nation. Every time you meet him, he laments about the level of patriotism of our people.

    “You will see a man that has passion for the people of this country, a man that loves every section of this country,” he said.

    The governor thanked President Buhari for completing the second Niger bridge, which is now facilitating the movement of people and goods to the Eastern part of the country this yuletide season.

    The President’s eldest daughter, Fatima Buhari, who spoke on behalf of her siblings and the entire family, used the occasion to thank her father for investing in their future by giving them the needed training and caring for their wellbeing.

    “We are deeply honoured to be here celebrating the 80th birthday of our beloved father.

    “I thank almighty Allah for his mercy and grace, for giving our beloved father long life and good health.

    “Baba is someone who money cannot buy. That is one thing we know and he taught us that. He taught us humility, loyalty, integrity, dignity and honesty and he has a very good sense of humour.

    “He gave us everything a parent will give his child; love, care, good education, shelter and many more,” she said.

    There were good will messages from traditional rulers, who all eulogized President Buhari as a man of integrity and a huge sense of humour.

    The Minister of Information and Culture, Lai Mohammed, led other members of the President’s cabinet as they presented a giant birthday card, as the rejoiced with him on his 80th birthday.

    Governors who also graced the occasion were Aminu Masari of Katsina State and Atiku Bagudu of Kebbi.

    Flood: doctors seek govt’s support for loss of hospitals, homes

    Association of Nigerian Private Medical Practitioners (ANPMP) has pleaded for support for members who suffered losses from recent flood disasters across the country.

    It called on the government to find solution to the frequent flood disasters.

    ANPMP, at a briefing by its President Kay A. Adesola and Secretary General, Dr. Ned Okoro, said it has raised and distributed about N10million to affected members, which is far from enough.

    The statement reads: “We wish to call on the Federal Government of Nigeria to show mercy and support for the members of ANPMP who lost their hospitals or homes due to the recent flood.

    “Some actually lost both hospital and home, ending up in the Internally Displaced Persons’ camps.

    “It’s been quite an overwhelming event as the harsh situation in the country has been worsened by this disaster.

    “These our members who are victims, are among those of us that have refused to join the ‘Japa phenomenon,’ staying back to cater for the health need of our people.

    “These flood victims are part of the private healthcare providership that contribute about 70 per cent of the health care delivery in the country.

    “The members of the association, ANPMP, have stressed themselves to raise about N10,000,000bonly which has been distributed to the affected members but this remains a little drop into the ocean of need.

    “We use this medium to reach out to President Muhammadu Buhari; the Minister of Humanitarian Affairs, Disaster Management and Social Development, Sadiya Umar Faruoq; and various governmental and non-governmental organisations to extend supportive milk of humanity to these colleagues who have suffered so much losses and are finding things so tough as an aftermath of the flood disaster.

    “We also seize this opportunity to appeal to the Federal Government of Nigeria to seek and put a final solution to this perennial occurrence of flood disaster across the land.”

    Third-party vehicle insurance now N15,000, says NAICOM

    Third-party vehicle insurance will cost N15,000 from January 1.

    Holders of third party insurance policy can now claim as much as N3 million if involved in an accident.

    This is because the National Insurance Commission (NAICOM) has increased premium rate on all classes of motor insurance, including motorcycles with effect from January 1, 2023.

    A circular titled, “New Premium Rates For Motor” signed by NAICOM’s Director, Policy and Regulation, Mr. Leo Akah, to all insurance institutions, announced the increment in insurance premiums and claims.

    The country’s cheapest and the most popular class of insurance – the third-party policy – has been increased to N15,000 per annum from N5,000, a 200 per cent jump.

    Holders of comprehensive motor insurance policies will be expected to pay not less “than five percent of the sum insured or the price of the vehicle after all rebates and discounts”.

    The highest cost in the new rates is N100,000 for a commercial truck/general cartage which also fetches the policyholders N5 million claims in the event of an accident.

    Motorists who fail to comply with the new premium rates have been promised “appropriate regulatory sanctions”.

    NAICOM in the circular stated that the new rates on third-party insurance policies covers Ecowas Brown Card.

    The approved rates include N20,000 premium for own goods motor insurance for which policy holders are entitled to collect N5 million claims in the event of an accident.

    The new premium rate on a staff bus is N20,000 while the insured can collect N3 million claims in the case of an accident.

    Commercial vehicles such as trucks/general cartage can now apply for N5 million claims limit for a new premium rate of N100,000; special types of insurance have a claims limit of N3 million after paying the new premium of N20,000.

    Tricycles (keke NAPEP) owners will pay N5,000 insurance to enjoy N2 million claims while motorcycle insurance premium is now N3,000 with a claims limit of N1 million.

    The implication of this new rates to the industry is that insurance companies will harvest more premium income from motor insurance business from 2023 going forward.

    According to an insurance expert Badejo Ademuyiwa, “until recently, the motor insurance class has been the major earner of income for some insurance underwriters and this new development will swell their income”.

    NAICOM, in its third quarter report said: “The insurance industry earned a total of N77.7 billion from motor insurance in a period of six months covering April to September 2022.

    “The class of business fetched the industry N32.4 billion between April and June and another, N45.3 billion between July and September.”

    With this development, premium income from motor insurance is expected to improve the earnings of the industry operators by 200 per cent following the addition of N10,000 to the cheapest third party which currently stands at N5,000.

    She said she would not be compelled to accept polygamy.

    Yul, on Wednesday, shared May’s photo, begging her to forgive him for marrying a second wife.

    He said he did not intend to replace May.

    He claimed he had apologised to her many times for venturing into polygamy.

    The father of five reasured his first wife of his unending love for her.

    Responding to her hubby, the mother of four said her decision to forgive her hubby was also in a bid to safeguard her mental health and inner peace.

    She wrote: “I strongly believe that mistakes are a major part of human existence. It is our response to these errors that count.

    “In other words, forgiveness is one thing, and righting a wrong is another.

    “This is also a passionate appeal to put an END to the constant ‘show’ on the social media space where our kids are growing into unless it is absolutely necessary.

    “Let’s prevent our lovely children from all the incessant drama series that might take a toll on them directly or indirectly amongst their peers.

    Nwaanyi Ike, Dalla Dalla, Irora Iya debuts on Africa Magic

    Africa Magic has added three new indigenous series to three of its channels in Nigeria. The indigenous series will premiere on Africa Magic Igbo, Africa Magic Hausa, and Africa Magic Yoruba.

     ‘Nwaanyi Ike,’ which launched on February 1, is a 26-episode series directed by Victor Okpala and Richard Abagana Nwosu. ‘Nwaanyi Ike’ follows the polygamous Okeke family and the drama that ensues after their father’s death. Chaos ensues in a polygamous family after the sudden death of their patriarch, as the first daughter, convinced that she is upholding her father’s legacy, wages war with her only brother and further divides the family.

     ‘Dalla Dalla’ premieres on February 13. The series follows yet another polygamous family, but with different circumstances. Set in the North, the story is about hunger for things beyond one’s reach. The main character, Farouk, receives a keepsake of $120,000.00 from his close friend Hamisu to keep it secret. In an unexplained turn of events, someone murders Hamisu and leaves Farouk with a windfall that no one knows about, or so it seems.

     ‘Irora Iya’ will premiere on March 1, 2023, and it tells the story of a teenage girl who gets pregnant after secondary school, runs away from home, and tries to abort her baby. However, the doctor, who secretly works for an infant trafficker, cajoles her into seeking refuge with the trafficker.

     Speaking on the series, Dr. Busola Tejumola, Executive Head of Content and West Africa Channels, MultiChoice, said, “We are delighted to present our viewers with these new indigenous series. They explore captivating storylines delivered by a great ensemble of cast and crew that will keep viewers glued to their screens and on the edge of their seats.
