    BREAKING: Reps to appeal judgement on Section 84(12), petition NJC

    The House of Representatives has decided to appeal the judgement of the Federal High Court sitting in Umuahia, asking the Attorney General of the Federation to delete section 84(12) from the electoral act amendment bill recently signed into law by President Muhammadu Buhari.

    Members of the House expressed disappointment and displeasure with the judgement, which they said was aimed at ursurping the powers of lawmaking conferred on them by the 1999 Constitution as amended.

    They also resolved to petition the National Judicial Council(NJC) about the conduct of the judge who gave judgement against the National Assembly even when they were not necessary parties to the suit.

    They also asked the Attorney General of the Federation not to tamper with the law as made by the National Assembly pending the determination of all appeals related to it.

    Speaker Femi Gbajabiamiala said the Executive or an appointee of the Executive cannot by the provision of the Constitution delete even a punctuation mark on any law as that would amount to usurping the powers expressly conferred on the National Assembly.

    He said it was curious the judgement was given when the Plaintiff did not show any injury that he will suffer if the section is not deleted, adding that the plaintiff is neither a political appointee nor a public servant.

    Court okays contempt proceedings against Amaechi

    A Federal High Court in Abuja has directed the initiation of contempt proceedings against the Minister of Transportation, Rotimi Amaechi following complaint that he flouted an earlier order made by the court.

    Justice Donatus Okorowo gave the directive on Wednesday on being informed that Amaechi allegedly violated an order for the maintenance of status quo issued on January 22 this year in a suit filed by a group, the Incorporated Trustees of Citizens Advocacy for Social and Economic Rights (CASER), challenging Amaechi’s handling of the process of appointing operators of the International Cargo Tracking Note (ICTN) in Nigeria.

    In the suit, CASER alleged among others, that the Amaechi has manipulated the appointment process to the benefit of two local and inexperienced firms – Medtech Scientific Ltd and. Rozi International Nigeria Ltd.

    Listed with Amaechi as defendants in the suit are the Bureau of Public Procurement (BPP), the Attorney General of the Federation (AGF), Medtech Ltd and Rozi Ltd.

    At the resumed hearing of the suit marked: FHC/ABJ/CS/1587/2021 on Wednesday, plaintiff’s lawyer, Abdulhakeem Mustapha (SAN) told the court that Amaechi defied the order for the maintenance of status quo and continued with the appointment process and currently on the verge of completing the process of appointment.

    Mustapha added: “He (Amaechi) has taken fundamental steps on the subject matter of this suit, and we have documents to be placed before the court to establish that he has ignored the order of the court completely.

    “In order to protect the sanctity of this honourable court, we have issued Form 48 against the Minister of Transportation. With the commencement of this committal process, which takes precedence over any other matter, we urge this court to suspend further proceedings in the substantive suit,” he said.

    Mustapha said having issued Form 48 on the Minister, he was in the process of filing motion on notice to commit the minister to prison.

    In response, Amaechi’s lawyer, Omosanya Popoola admitted receiving a letter notifying him of the issuance of Form 48 on his client.

    Popoola said his client is a law abiding citizen and he was yet to be served with the Form 48.

    Lawyer to BPP, Akin Olujinmi (SAN) said his client has also not been served with the Form 48 personally as required by law.

    Olujinmi argued that there was no motion for committal before the court, adding that the plaintiff’s law has to file affidavit to establish his allegations that the defendants, including Amaechi had violated the court’s order.

    Lawyer to the AGF, Mohammed Sheriff aligned himself with the submissions by lawyers to Amaechi and BPP that proceedings in the main suit should not be halted.

    Ruling, Justice Okorowo agreed to suspend proceedings in the main suit, noting that: “Once the issue of contempt is raised, the court must suspend proceedings.

    “The court will not close its eyes when being told that its orders are being flouted. We have to suspend proceedings for the court to ascertain the veracity of the allegations.”

    The judge then directed plaintiff’s lawyer to proceed to file a motion on notice, with an affidavit to establish the facts of the alleged violation of court’s orders, which must be filed and served before the next adjourned date.

    The court has scheduled ruling for May 9 on the application filed by a firm, Antaser Nigeria Limited to be made a party in the suit.

    Antaser’s lawyer, James Ogwu Onoja (SAN) told the court that his client was a necessary party in the case because it sought to participate in the bidding process, but was unlawfully excluded.

    CASER stated, in an affidavit supporting the substantive suit, that the purported procurement process, leading to the appointment of the fourth and fifth defendants (Medtech and  Rozi) as companies providing ICTN services shows that it was riddled with non-compliance with the known procurement procedures as stipulated in the law.

    The plaintiff claimed that President Muhammadu Buhari “was misguided in granting an anticipatory approval for a direct appointment of the fourth and fifth defendants’ companies.

    “The approval by Mr. President cannot waive the procurement process stipulated under the Public Procurement Act.

    “The steps of the first and second defendants (Transport Minister and BPP)  by opting for selective bidding and or direct procurement method amount to a willful violation of due process and a desperate design to circumvent the provisions of the Procurement Act by abandoning the demands of fairness, competitiveness, accountability and transparency as envisaged by the Act.

    “The failure of the relevant agencies to follow due process and appoint qualified companies contributed immensely to the failure of the ICTN project in the year 2010 and 2015.

    “The appointment of the fourth and fifth defendants without due process will further worsen the already threatened security and fragile economy of this country.”

    The plaintiff is praying the court for among others,

    *A a declaration that in view of the mandatory provisions of sections 40(1), 24 & 25 of the Public Procurement Act 2007, it is ultra vires the powers of the 1st defendant to seek Mr. President’s anticipatory approval for due process “no objection” from the 2nd defendant for the appointment of the 4th defendant as technical partners to the 5th defendant to provide international cargo tracking note in the country.

    *A declaration that Mr. President was misled by the 1st defendant in granting the anticipatory approval dated 19th august, 2021 to enable the 1st defendant request for due process “no objection” from the 2nd defendant for the appointment of the  4th defendant as technical partners to the 5th defendant to provide international cargo tracking note contrary to the mandatory provisions of sections 40(1), 24 & 25 of the public procurement act, 2007.

    *An order nullifying the entire process of appointing the 4th and 5th defendant as operator of the international cargo tracking note in the country.

    *An order stopping the proposed and imminent appointment of the 4th and 5th defendants as the operators of the International Cargo Tracking Note (ICTN) in Nigeria in view of the clear breach of the provision of Public Procurement Act, 2007.

    *An order of mandamus directing the first and second defendants (Transportation Minister and BPP)  to conduct an international competitive bidding to ensure the proper selection of the service provider for the International Cargo Tracking Note (ICTN) in Nigeria.

    2023: Ortom, Ishaku, Ugwuanyi, 34 others in PDP zoning committee

    The leadership of the Peoples Democratic Party (PDP) has nominated three Governors Samuel Ortom (Benue), Darius Ishaku (Taraba) and Ifeanyi Ugwuanyi (Enugu) as members of its 37-member committee to determine the zoning of the party’s 2023 presidential ticket.

    The decision to set up the committee was taken at the party’s National Executive Committee (NEC) meeting on March 16, 2022.

    The committee will also work out modalities for the sharing of positions of Senate President, Speaker of House of Representatives, Secretary to the Government of the Federation (SGF) and other leadership positions in the two chambers of the National Assembly among the six geopolitical zones.

    In a statement on Wednesday by the National Organising Secretary of the PDP, Umar Bature, the party also listed other members to include former governors Ayo Fayose (Ekiti), Sule Lamido (Jigawa), Ahmed Makarfi (Kaduna), Liyel Imoke (Cross River), Boni Haruna (Adamawa), Ibrahim Dankwabo (Gombe), Ibrahim Shema (Katsina), Ibrahim Idris (Kogi) Attahiru Bafarawa (Sokoto) and Jonah Jang (Plateau).

    Other members include Chief Tom Ikimi (Edo), Mao Ohuabunwa (Abia), Emmanuel Ibokessien (A/Ibom), Prof. A. B. C. Nwosu (Anambra) Sen. Abdul Ningi (Bauchi), Boyelayefa Debekeme ( Bayelsa) and Sanusi Daggash (Borno).

    Reps Minority Leader Ndudi Elumelu (Delta), Amb. Franklin Ogbuewu (Ebonyi), Mohammed Abdulrahman (FCT), Chief Fidelis Izuchukwu (Imo), Amb. Aminu Wali (Kano), Kabiru Tanimu Turaki, SAN (Kebbi) and Kawu Baraje (Kwara) are also listed.

    Also on the list are Chief Olabode George (Lagos), Mike Abdul (Nasarawa), Prof Jerry Gana (Niger), Hon. Daisi Akintan (Ogun), Dr. Omotayo Dairo (Ondo), Prof. Adewale Oladipo (Osun), Sen. Hosea Ayoola Agboola (Oyo), Austin Opara (Rivers), Adamu Maina Waziri (Yobe) and impeached Zamfara Deputy Governor, Mahadi Aliyu Gusau.

    The party said the committee will be inaugurated on Thursday (tomorrow) at the Abuja national secretariat of the PDP at 11am.

    The non-service of the application by the Attorney General of the Federal (AGF) on the suspended Deputy Commissioner of Police (DCP), Abba Kyari stalled hearing on Wednesday before a Federal High Court in Abuja in the extradition proceedings against Kyari.

    At the mention of the case on Wednesday, lawyer to Kyari, Nureini Jimoh (SAN) told the court that his client was not yet served with the extradition application filed by the AGF.

    AGF’s lawyer, Pius Akutah, the Head of the Central Authority Unit (CAU) at the Federal Ministry of Justice, confirmed that the applicant was yet to effect service on the respondent.

    Akutah said the applicant could not serve before now because of Kyari’s involvement with the National Drug Law Enforcement Agency (NDLEA).

    He assured the court that the applicant would effect service on the respondent (Kyari) by March 24 and prayed the court for an adjournment.

    Jimoh, who did not object to the application for adjournment, said he was entitled, under the court’s rules, to 14 days, from the date of service, to file a response.

    Justice Inyang Ekwo has adjourned till April 27 for hearing.

    Sokoto Governor Aminu Tambuwal has visited former Military President, General Ibrahim Badamosi Babangida and former Head of State, General Abdulsalami Abubakar at their residences in Minna.

    Tambuwal, who arrived Minna on Tuesday evening, first met with Babangida at his Uphill residence.

    He had a closed-door meeting with him for about an hour before going to visit Abdulsalam at his residence opposite IBB’s house.

    He spoke with the former Head of State for about 30 minutes.

    Speaking to newsmen after the meeting, Tambuwal said that he was in Minna as part of his consultative tour in his bid to vie for the presidency under the Peoples Democratic Party (PDP).

    Tambuwal noted that the 2023 elections may not be based on zoning, asking the PDP to work towards winning the elections rather than being fixated on zoning.

    He explained zoning was a deliberate action by the political class that was midwived to address a particular concern at that period, which was June 12.

    He urged political parties to jettison zoning and throw up candidates for Nigerians to decide and elect.

    “Zoning was a deliberate action by the political class of this country midwived by the government at the centre to address a particular concern, the June 12.

    ” How come when we saw the advent of COVID-19, we were not applying HIV drugs to COVID-19? The power shift in 1999 was to the south-west to assuage a particular situation.

    “Go back to the history of democracy in Nigeria. In 1979, NPN had Shagari, NPP had Azikiwe, UPN had Chief Awolowo, GNPP had Waziri Ibrahim and PRP had Aminu Kano.

    “There was no zoning. When you go to 1992/1993, SDP had Abiola, NRC had Bashir Tofa, there was no zoning.

    “This is to show to you that when you go back to our history, it will show to you that zoning has not been the main issue.

    “The main issue is that political parties throw up candidates and Nigerians decide on who to elect for their president.

    “The zoning arrangement made was not meant to completely erode the constitutional rights of the citizens. Our party is yet to decide but it has never been the main issue,” he argued.

    On the consensus candidate for PDP, Tambuwal explained that engagement was on and there have been series of meetings between Senator Bukola Saraki, Governor Bala Mohammed and himself adding that it is a work in progress.

    “We are engaging ourselves. First, we have agreed that it is about this country and not about an individual’s ambition.

    “We have agreed that there is a need to come together to know the tension and make sure that we work as a team. It is a work in progress and we will meet again and further the conversation,” he said.

    The North-South divide in the Peoples Democratic Party (PDP) over zoning of the 2023 Presidential ticket is widening.

    Presidential aspirant Aminu Tambuwal, Sokoto State governor, said yesterday that instead of talking about zoning, the party should give the ticket to the candidate that can win the election.

    But Southwest leaders of the main opposition at a meeting hosted in Ibadan by Oyo State Governor Seyi Makinde insisted that the South should produce the presidential ticket.

    Leading lights of the PDP in the zone attended the meeting.

    Their position is in sync with that of Southsouth governors and leaders expressed on Monday at their meeting in Uyo, the Akwa Ibom State capital.

    “The PDP should give the ticket to the Southsouth zone which is its stronghold,” Rivers State Governor Nyesom Wike, told the meeting.

    Thirteen PDP governors were meeting last night in Umuahia, the Abia State, with the issue of zoning likely on the agenda.

    The PDP’s main decision-making organs – the National Caucus, the Board of Trustee (BoT), and the National Executive Committee (NEC) – met in Abuja but failed to agree on which zone should produce its standard-bearer.

    It raised a 37-member body to give a report within two weeks on the vexed zoning issue.

    Tambuwal, speaking at a meeting with former principal officers of the national and state assemblies, as part of his consultation, said the party leadership and stakeholders would have to choose between zoning of its presidential ticket and winning the election.

    Calling for unity of purpose, he said no single zone can win the presidential election all alone.

    He urged those clamouring for zoning to consider the demographic composition of the country and the trend in past election results.

    But, one of PDP’s founding fathers, Chief Olabode George described Tambuwal’s proposal as “illogical”, adding that “it puts the cart before the horse” with the argument that the party should win the election before talking about sharing of offices.

    Tambuwal explained further that what should be paramount to the PDP was the need to adopt the best strategy to dislodge the ruling All Progressives Congress (APC) in 2023 and resolve the issue of power-sharing afterwards.

    Tambuwal recalled that it was such strategic planning that enabled the APC to win the presidential election in 2015.

    The governor observed that part of the APC strategy at the time was to give its presidential ticket to Gen. Muhammadu Buhari from Katsina State.

    He said the APC would have lost the 2015 presidential election if it had given the ticket to someone from the South, particularly the Southsouth zone.

    Tambuwal said: “APC took their ticket to Katsina in 2015 where the last President of PDP, Umaru Yar’ Adua, died in office in 2010.

    “That was five years later, out of strategic thinking, with Bola Tinubu and the rest of them; I was part of it. We said we were looking for how to move. We must get power before we share it.

    “I deliberately took APC ticket to Katsina to give President Muhammadu Buhari. Yes. Atiku contested, Rabiu Kwankwaso contested. Sam Nda Isaiah and Rochas Okorocha, contested.

    “But we knew where we were going. Because we were determined to win. Let me tell you, had the APC given that ticket to someone from the south, in particular the Southsouth, we couldn’t have won.

    “Go and check the election results of 2007. Buhari had 11 million votes in 2003. But in 2007, he got seven million votes against Yar’Adua because they are from the same Katsina.

    “I am giving you this analysis so that together, as leaders of our party, PDP, who are working towards winning an election, not zoning, not winning tickets.

    “Yes, we can share tickets and everybody can take his piece and go to his zone. But you must plan to win the election. That’s the reality of it. It’s not anybody’s making where we come from.

    “I didn’t make myself to come from Sokoto, a Fulani man. No, it’s God.

    “God could have decided for me to be born somewhere else not in Nigeria. So we must accept these realities as a party and work with these realities to win the election.

    “After that, we come down and say okay, let’s share power. Win election first. Don’t win zoning o! Win the election and they will come and share power.”

    Speaking on television, George said: “Listening to governor Tambuwal on zoning, I think in a nutshell, he has put the cart before the horse. How do you win an election first, when you come back to zoning? That sounds illogical.

    “The founding fathers of this party sat back in 1998, looked back from the First Republic on the real mitigating factors for this unnecessary friction in this country. They then decided to divide Nigeria into six geopolitical zones and shared the six top positions – the president,  the vice president, the senate president, the speaker, Secretary to the government and the chairman of the political party in the land across the zones.

    “This was so because in the first republic the majority had their ways while the minorities were the onlookers. And that created so much tension and friction that led us to the first coup, the civil war, led us to all kinds of instability in the system. Our founding fathers having experienced all that, they then gave us a model. That was a special gift to the future generation.

    “This sharing formula was meant to instill connection within the system, which is necessary for any political system. On that basis, no zone was left put and that guaranteed the oneness, the unity and involvement of every part of Nigeria.

    “If you now say let us go for the election and let the best man emerges and thereafter we share based on zoning. That sounds illogical.

    “What we are saying now is that we should adhere to the constitution of our party clearly stated that Zoning and rotation must be the kernel of our party. And if the spinal cord in the human body is cut, you are either paralyse or dead.”

    To ensure a rancour-free convention, President Muhammadu Buhari will meet with the seven chairmanship aspirants today.

    The ruling All Progressives Congress (APC) will on Saturday, hold its convention at Eagles Square, Abuja.

    Contrary to the push for a consensus candidate by the President, seven aspirants are in the race to lead the party.

    President Buhari is believed to be rooting for Senator Abdullahi Adamu, a former Nasarawa State governor as party chairman.

    However, the APC Senate Caucus’ declined to endorse Adamu.

    Besides, it was learnt leaders of the legacy parties that formed APC also refused to back Adamu.

    As part of its convention plan, Caretaker Chairman Mai Mala Buni is expected to brief the APC senators today.

    A source said last night that the President may use today’s meeting with chairmanship aspirants either to restate his consensus position or allow an open race for the highest office.

    There were speculations that the President may have backed out of his support for Adamu because the legacy parties would not support him.

    Besides Adamu, who was pioneer chairman of the Nigeria Governors Forum (NGF), other aspirants are ex-Governor Umar Tanko Al-Makura (Nasarawa State); Malam Saliu Mustapha; Sen. Sani Mohammed Musa and Mohammed Etsu (Niger State); ex-Governor George Akume (Benue) and a former chairman of the NGF Abdulaziz Yari (Zamfara).

    Yari, Mustapha, Al-Makura and Musa met yesterday in Abuja. But details of their discussions were unknown.

    A source said: “Worried by the bickering over APC chairmanship, the President has invited aspirants to a meeting on Wednesday at the Presidential Villa.

    “I think the session might address how to have a rancour-free convention. The President may also sell his consensus agenda to the aspirants if they will accept.

    “The aspirants have refused to step down for each other, leading to cracks among APC governors and leaders.

    “In the case of Nasarawa and Niger states, there are four aspirants leading to deep-seated political crises in the two states.”

    Also, there is pressure on the President not to anoint any aspirant. The legacy parties, which formed APC, were said to be opposed to the alleged preference for Adamu as the next APC national chairman.

    “There are strong feelers that the President may back out of the Adamu project in view of the preponderance of opposition against him.

    “Most APC governors are really not keen on Adamu’s choice.”

    The source added: “Certainly, the Villa meeting may set the tone for the national convention. The outcome may define the chairmanship race.”

    A governor, who spoke in confidence, said: “The situation is still dicey. We have not been able to strike a common position on the choice of the next chairman of our party.

    “What I can tell you is that we will get to a bend where we have to be decisive. This may be on or before Friday.”

    On the meeting of the four aspirants in Abuja, the source said: “I think the meeting might be connected with presenting a common position when the chips are down.”

    A chieftain of defunct CPC from Kano State, Alhaji Farouk Abdulaziz, said the group was not in support of former Nasarawa governor because he was alien to the ideals of APC from its foundation.

    He added: “We have made our position known to the President and he promised not to support anyone for the position. As it stands, Adamu Abdullahi cannot claim he has full presidential backing.

    “We have nothing against him but we need someone who was part of the formation of our party from the beginning.  The party has ideals and only those who shared those ideals must lead our party.

    “It is now going to be an open contest; that is the beauty of democracy and Mr President insists that all the aspirants cleared for that position must face the delegates.”

    A source said the President’s decision not to back Adamu or any of the aspirants is to ensure a level-playing field, and that the best aspirant, who is the choice of the people, can emerge.

    “Some people who feel they are close to Mr. President sold the candidature of Senator Abdullahi Adamu to him. Somehow, others too who have Mr. President’s ears, have also told him the implication of using Adamu as APC national chairman.

    “So, Mr President having listened to both parties now said he is no longer interested in any consensus again. Let there be an open contest where the best person will emerge as the national chairman.

    “That is the reason all the aspirants have picked forms. Even those who were initially reluctant to contest, after it was reported that the President had endorsed Adamu, have collected the forms.

    “The President does not need any chairman for any personal ambition. Don’t forget, he is not contesting again and he has said he will retire to his farm after May 29.

    “All he wants is to leave a stronger APC behind, with a new leadership that can deliver the 2023 general elections to the party. He has no anointed candidate at all and he wishes all the aspirants the very best.”

    Deputy Senate President Ovie Omo-Agege said Buni would brief APC Senators today on preparation for the convention.

    Omo-Agege, who presided over plenary yesterday, conveyed notice of the meeting in a letter addressed to the Senate President, Ahmad Lawan, and signed by the Senate Leader, Yahaya Abdullahi.

    The Senate leader said Yari would also address the caucus.

    The Southwest zone of the People’s Democratic Party (PDP) yesterday aligned with the decision of Southern governors that the next President should come from the region.

    The zone also reaffirmed its position on restructuring the country in the interest of fairness, justice and equity.

    It expressed the desire for fair distribution of federal positions and appointments, pledging to support all efforts geared towards national cohesion.

    These are part of the communique of the extended zonal caucus meeting held in Ibadan, the Oyo State capital.

    The seven-point communique reads in part: “We the PDP in the Southwest believe in the corporate existence and unity of Nigeria

    “The unity of the Southwest is a non-negotiable issue. To this end, we demand that all dispute resolution mechanisms should be on the front burner.

    “The Southwest zone is in support of the Southern Governors Forum that the next president of the Federal Republic of Nigeria should come from the South.

    “The zone commends the only PDP Governor in the zone, Engr Seyi Makinde of Oyo State for his infrastructural and development strides in the zone.

    “The zone has agreed that we should do everything possible within our power to deliver Osun and Ekiti states to the party in their forthcoming offseason governorship elections.

    “The zone is desirous of fairness, justice and equity in the distribution of federal positions and appointment and will support all efforts geared towards national cohesion through equitable distribution of Federal positions and appointment amongst the geopolitical zones of the Federal Republic of Nigeria.

    “The Southwest zone reaffirms its position on restructuring of Nigeria.”

    Justifying the decision and content of the communique while fielding questions from reporters, ex-Ondo State Governor Olusegun Mimiko said: “What I will tell you is that there has been a consensus on all the point in the communique but I won’t tell you the nitty-gritty.

    “On the issue of zoning of the presidency, the Southern governors in their wisdom advocated that the position of the President should come to the South.

    “This meeting has endorsed that. We have also endorsed that Nigeria needs peace and we cannot stop at anything to ensure peace for our country. I think those are issues that are not controversial.”

    Asked if the call for zoning of the position would not pit a region against the other in view of the decision of some northern leaders of the party showing interest in the position, the former Ondo Governor said: “Matters of equity and justice cannot pit one side against another. It is inequity and injustice that can pit one side against the other.

    “What we are advocating is what the Southern governors advocated. So, this equitable and just position is one that can ensure peace for the country, not the other way round.”

    Some of the leaders at the caucus meeting include Makinde, former Governors Olagunsoye Oyinlola (Osun), Olusegun Mimiko (Ondo), Ayodele Fayose (Ekiti) and Chief George.

    Others are Deputy National Chairman (South), Ambassador Taofeek Arapaja; former Ekiti State Deputy Governor Olusola Eleka; PDP National Vice-chairman, Southwest, Olasoji Adaguodo; Senator Abiodun Olujimi, Senator Francis Fadahunsi, Oyo State PDP chairman, Dayo Ogungbenro; zonal secretary, Rahaman Owokoniran and Oyo Assembly Speaker, Adebo Ogundoyin.

    Tambuwal to PDP: Choose between zoning and winning

    In what appeared a repudiation of the zoning arrangement, Sokoto Governor, Aminu Tambuwal, has told the leadership and stakeholders in the Peoples Democratic Party (PDP) to choose between zoning of its presidential ticket and winning the election.

    The Governor, who is eyeing the presidential ticket of the PDP, also said that no single zone can win the presidency alone.

    Tambuwal’s position appeared a veiled response to the insistence by the Rivers State Governor Nyesom Wike, that the PDP presidential ticket be zoned to the Southsouth region.

    He spoke in Abuja on Tuesday during a meeting with former principal officers of the National Assembly.

    The meeting was in continuation of his consultative engagements to garner support for his aspiration.

    He urged those clamouring for zoning to consider the demographic composition of the country and the trend in past election results

    BREAKING: Court ruling on Electoral Act divides Senators

    Senators were apparently divided on Tuesday over a call for the Senate to debate a Federal High Court ruling that declared Section 84(12) of the Electoral Act as illegal.

    Trouble started when Senator George Sekibo from Rivers State, while relying on Orders 10 and 11 of the Senate Standing Rules, led his colleagues through the various functions of the three arms of government.

    He argued that the ruling by the Court, which nullified the action of the National Assembly was a bad precedent that must not be allowed to stand.

    He said if allowed to stand, future actions of the Parliament would be challenged in Courts by interested parties.

    Sekibo urged his colleagues to suspend other legislative activities earmarked for the sitting and debate the issue.

    He said: “This issue us very important. Those who went to court to challenge our action, didn’t include us as an interested party. We were not even aware that a matter was even in court.

    “Suddenly, we were told that a judgment was given and the Federal Government immediately gazetted it.

    “This is dangerous and we need to take a position immediately. This is important to guide against such occurrences.”

    The debate on the matter was however deferred to Wednesday by the Senate following divergent views on the said ruling.
