    BREAKING: Sacked Ganduje’s Media Adviser quits APC

    Special Adviser on Media Matters to Governor Abdullahi Umar Ganduje of Kano State, Salihu Tanko Yakasai, who was sacked for criticising President Muhammadu Buhari administration, on Monday announced his exit from the ruling All Progressive Congress (APC).

    Yakasai was suspended from office in October 2020 and sacked in February 2021, following his utterances against the government in power which he was part of.

    He alleged that during his struggles, he come under attacks but was fortunate to survive the “arrows and bullets.”

    “I survived arrows and bullets shot at me by evil forces in both the real and virtual worlds,” he stated during a press conference at the NUJ Press Centre, Kano, on Monday.

    “I have been a bonafide member of the All Progressive Congress (APC) party of Nigeria right from its inception almost a decade ago.

    “But I have reached a point in my life where I have decided to embark on a new political journey to ensure that I stick to my beliefs and principles.

    “It is in this light that, after due consultation with my political mentors, constituents, friends and family, I resolved to exit the APC. My membership of the party ceases from today, March 21, 2022,” he said.

    Yakasai said he served to the best of his ability during his days as Director-General of Media and Communications in Government House and later Special Adviser to the Governor on media, adding he has no regrets but came away with many lessons.

    “During the period I improved the image of the state government, and effectively networked with citizens groups to project a positive image of our state on the national scene,” he said.

    He narrated while projecting the image of government in the state and at the centre, he was equally mindful of the campaign promises made to the people as a party, which he stated “the APC leadership nationwide have fallen short of those promises.”

    He explained: “I travelled to different parts of the country to campaign for the party at the local, state and federal levels. I stuck out my neck, risked my life, gave my word and trust, and extended my belief in a party we thought in 2015 will usher in the leadership that will answer the cry of millions of Nigerians.

    “But as I solemnly committed myself in December 2000 when I made my first entry into partisan politics, I will not just speak truth to power, I will try and live the truth that I speak no matter the cost.

    “It was in that spirit that I vehemently criticised the PDP led government prior to 2015. It will be hypocritical of me today to keep quiet when our own APC government and party have underperformed.

    “I made several attempts to highlight some of these failures from the inside, but unfortunately amends were not made, and those in power were averse to my corrective steps. Consequently, l was suspended and sacked from office.”

    Yakasai said he remains grateful to Governor Ganduje for giving him a platform to serve for over five years.

    APC convention: Southwest picks Kekemeke, Omisore

    Six days to the All Progressives Congress (APC) convention, there is no consensus yet on who will be the national chairman.

    President Muhammadu Buhari is believed to be supporting Senator Abdullahi Adamu, but other aspirants have obtained forms and are campaigning.

    The Southwest geo-political zone has shared out the position allocated to it.

    The region has nominated Mr. Isaac Kekemeke (Ondo State) as its candidate for National Vice Chairman (Southwest) and Senator Iyiola Omisore (Osun) as National Secretary.

    Kekemeke is a former Secretary to the Ondo State government and one-time Attorney-General.

    Omisore was a two-time senator.

    Ondo State Governor Oluwarotimi Akeredolu, who is the coordinator of the Southwest Governors Forum, announced the nominations yesterday.

    He, however, warned against any plot by external forces to truncate the declared interest of the zonal leaders and stakeholders.

    He vowed that the zone would resist efforts to create division by attempting to impose aspirants for party offices.

    Akeredolu explained that APC stakeholders in the Southwest micro-zoned the positions that were brought to the region.

    Speaking through his Commissioner for Information and Orientation, Donald Ojogo, Akeredolu said Kekemeke’s aspiration was not just an Ondo project, but a Southwest project.

    He said: “He has paid his dues and that is exactly what Mr. Governor has rallied his colleagues to reciprocate.

    “Those who are peddling other stories such as national secretary outside Oyo and Osun axis are instruments in the hands of external forces desirous to create division among leaders in the Southwest to impose persons on the party.

    “For emphasis, what we are going for is national vice chairman with Kekemeke as our candidate and not the national secretary. Those outside the Southwest, who are attempting to micro-zone our offices for us in Southwest are only creating unnecessary confusion and any such of their permutations outside the decision of stakeholders in the Southwest should be ignored.”

    There was suspense yesterday, following the failure of the screening committee to commence its assignment. The committee is headed by Katsina State Governor Aminu Masari.

    The screening, which was billed to have taken place at the weekend at the Nicon Luxury Hotel in Abuja, was cancelled without any communication from the party.

    It was learnt that some committee members and aspirants that showed up at the screening had to leave when no information was forthcoming.

    It was, however, gathered that the delay in carrying out the screening was informed by the late submission of nomination forms by some aspirants.

    A source attributed the none take-off of the screening to moves by some blocs in the party pushing for the harmonisation of the two sub-committees constituted by Chairman Mai Mala Buni, and the one inaugurated by former acting chairman Governor Abubakar Sani Bello.

    The Buni committee had Governor Abdulrahman Abdulrazak as chairman while the committee inaugurated by Bello is chaired by Masari.

    It was further gathered that the harmonisation is billed to be carried out today to enable the committee to swing to action by tomorrow.

    But, another source said Masari has divided his committee into six subunits, with each of the units handling screening at each geo-political zone.

    The source said: “Each of the six will be sub-divided again into three. With Unit A handling the screening of National Working Committee (NWC) aspirants, Unit B will handle Non-NWC offices.

    “Unit C will handle zonal positions so that they can finish their job in one day and present their report to the Appeal Committee.”

    APC governors are still divided over the choice of chairman as of yesterday.

    The governors were also not at ease over the emergence of a list of some preferred candidates by Buhari.

    They have split into caucuses to come up with a Unity List for a second look by Buhari.

    The governors may, however, meet with the President during the week on the matter.

    Issues generating tension are as follows:

    *Whether or not to adopt consensus or open race for the national chairman

    *Opposition to the imposition of candidates.

    * Rejection of tinkering with micro-zoning at the last minute.

    *Need for the President to respect the inputs of the governors.

    *Preparation of a Unity List by governors to present to Buhari

    A source said: “Governors and party leaders have retired into caucuses on how to address some of these last-minute issues. The President prefers adoption of consensus for the offices; governors want outright open contest by aspirants

    “For instance, it was learnt that the President was trying to build consensus around ex-Governor Abdullahi Adamu for the office of the national chairman. But the former governor does not enjoy the backing of most APC governors.

    “Others in the list of favoured candidates are a former President of the Senate, Dr. Ken Nnamani (Deputy National Chairman, South); Farouk Adamu Aliyu (Northwest) for Deputy National Chairman (North); and Ifeolu Oyedele from Ondo State (National Secretary).

    “The governors are claiming that the President’s choices may alter the micro-zoning formula adopted in some geo-political zones.

    “There is disquiet in the North. The Deputy National Chairman (North) ought to come from the Northeast and not Northwest. Even Buhari’s strategist, Farouk Adamu Aliyu from Jigawa State in the Northwest, who is allegedly favoured by the Presidency, is not supported by Governor Abubakar Badaru and other governors in the zone.

    “In the Southwest, the governors in the geopolitical area met and zoned the National Secretary to Oyo/Osun axis and not Ondo State. What the governors ceded to Ondo State were the National Vice Chairman (Southwest) and Zonal Youth Leader.

    “There are many examples of the distortion of the micro-zoning formula in all the six geopolitical zones.”

    A governor said: “We want to work on a Unity List which can assist APC to consolidate and win the hearts of Nigerians in the 2023 elections.

    “We do not want imposition of candidates. We want them to emerge from the members of the party.

    “We believe that the President ought to seek the inputs of the governors. We will meet him before the convention with our advisory.”

     

    All is set

    Buni yesterday said that all is now set for the convention on Saturday.

    He said the activities of “the Protocols Sub-committee had instilled confidence in members that all is set for the biggest party in Africa to now hold its National Convention.”

    Buni, who was briefed by the Protocols sub-committee chairman and Governor of Kano State, Abdullahi Umar Ganduje, in Abuja at the weekend, noted that “the committee has gingered hitherto pessimistic party members that the convention is going to hold”.

    Ganduje, in a statement by his Commissioner for Information and co-opted member of the committee, Malam Muhammad Garba, quoted Buni as assuring that “the APC is organising a convention with a global outlook that calls for concerted efforts by all members.”

    Ganduje told Buni that recruitment of young men and women who will serve as protocol officers and ushers during the convention has been completed.

    “They recruits are receiving training, which is part of the responsibilities of the Protocols committee,” Ganduje added.

    Other members of the committee are the Niger Delta Affairs Minister, Senator Godswill Akpabio; Minister of State for Health, Senator Adeleke Mamora; Rep. Hafiz Kawu from Tarauni Federal Constituency; Abdullahi Shu’aibu, among others.

    Stepping down yesterday, Sheriff said: “I, Ali Modu Sheriff, will not offer myself for the contest on Saturday because it has been zoned out of my zone. I am from the Northeast.

    “Northcentral is made of Kogi, Kwara, Benue, Nasarawa, Plateau states. These are the places where the chairman will come out from. Borno State is Northeast of Nigeria.

    “Therefore, that’s the position as of today and I want you to communicate to all of our followership, men and women all over the country so that they don’t expect to see my name on the ballot paper.”

     

    APC senators divided over aspirants

    Sources said APC Senators are divided over the chairmanship race.

    The lawmakers appear to be in dilemma because of three of their colleagues who are in the race.

    They include Senators Tanko Al-Makura (Nasarawa), Sani Musa (Niger) and Abdullahi Adamu (Nasarawa).

    It was gathered that some senators are supporting the candidacy of Adamu, based on information that he is the choice of President Buhari.

    It was also alleged that the senators working for the emergence of Adamu as APC’s National Chairman, are also supporting the choice of the Minister of Transportation, Rotimi Amaechi, as a Presidential candidate.

    A senator said: “The game plan is to make Abdullahi Adamu the chairman of the party and Farouk Aliyu, a former House of Representatives member from Jigawa State, as the deputy.

    “They are working with some people in the presidency to ensure the emergence of Rotimi Amaechi as the APC presidential candidate.

    “Their plan is clearly against the wishes of the majority of the party members who believe that a man with his political structures should emerge as the candidate.

    “They have already met with the President and they claimed that the President had bought into their game plan.”

    Our reporter observed that some senators were at the Area 11 Garki, Abuja campaign office of Senator Adamu on Friday when the aspirant unveiled the newly renovated edifice.

    The senators who attended the ceremony and spoke on the occasion included, Deputy Senate President Ovie Omo-Agege; Senate Leader Yahaya Abdullahi; Chief Whip Orji Uzor Kalu; Adamu Aliero and Mohammed Ali Ndume, among others.

    Senator Ndume confirmed that he was supporting Adamu because of his competence and blunt attitude.

    He said: “I am supporting Abdullahi Adamu because he is the most qualified and courageous among other aspirants.

    “Adamu is somebody who cannot be influenced by money. He is not afraid to say anything in favour of whatever he believes in.”

    Senators Al-Makura, Musa and Adamu could not be reached for comments.

    However, Senator Musa said: “I respect those that are older than me and I also reciprocate the same gesture of respect to those that I am ahead of in terms of age.

    “I respect those that are my seniors. I will seize this opportunity to call on those that have been in this system to give those that are new, a trial so that we will come up with fresh ideas.

    “At 57, I should be able to steer the ship of APC and put it on the pedestal of success and of winning elections.”

    Tambuwal, Bala, Saraki ready for North’s consensus candidate

    Ahead of the May 29 Peoples Democratic Party (PDP) presidential primary, Sokoto State Governor Aminu Tambuwal, former Senate President Bukola Saraki and Bauchi State Governor Bala Mohammed have agreed to produce a consensus candidate among them.

    The three met at the Government House in Bauchi yesterday.

    Their decision comes a few days after former Vice President Atiku Abubakar obtained his nomination form.

    Saraki told reporters that Atiku would be consulted.

    He said: “Our concern for the hardship our people are going through is the reason for the meeting.

    “We’re also looking ahead towards 2023 because it’s very clear that PDP is the only viable option to rescue this country from its present situation.

    “That’s why we felt the need to hold this meeting because the stability and unity of this country are more important to us than our ambition.

    “We felt the need to work together because we believe the three of us here are committed and with a lot of reserve energy moving ahead. There is great hope for this country to move ahead.

    “The three of us have shown aspiration to lead this country but we have also come to realise that we are all capable of leading this country but at the end of the day, it’s only one person that will get the ticket.

    “That’s why we have resolved to work closely together to ensure a consensus arrangement emerge among the three of us moving forward.”

    It was learnt yesterday that the PDP will decide zoning after receiving and deliberating on the report of the committee it recently constituted for the purpose.

    Senate Minority Leader and Chairman, Senate Caucus of the PDP, Senator Enyinnaya Abaribe, disclosed this during a telephone chat with our correspondent in Abuja.

    The PDP had set up a 37-member committee to determine suitable zoning formula for all elective offices, particularly the Presidency, Senate President, and House of Representatives Speaker.

    Abaribe said: “The party just set up zoning committee and that zoning committee which is made up of one person from each state of the federation will come up with the zoning formula.”

    A former Ekiti State Governor, Mr Ayodele Fayose, said he would abide by whatever decision the PDP takes on zoning.

    Speaking through his media aide, Lere Olayinka, he said: “Fayose will not have a contrary opinion to that of the party leadership on which zone should produce our candidate for the 2023 presidency.”

    PDP National Secretary, Senator Samuel Anyanwu, also said the zoning decision was yet to be made.

    He said the party was waiting for the committee to turn in its report on the issue before a decision on it would be taken.

    “This is why we have set up the 37-man committee to advise us on the issue of zoning,” he said.

    However, a former PDP National Vice Chairman, Dr. Eddy Olafeso, believes it was too late for the party to zone the presidential ticket.

    He said southern governors were entitled to their opinion to demand a president from their regions.

    “If they decide to zone, we might come up with a presidential candidate that will not make any difference in the future of the country.

    “It is better advised to encourage every Nigerian to participate. If we have a good president, unfairness, inequity, nepotism will be a thing of the past,” he said.

    The Niger State Chairman of the PDP, Tanko Beji, is confident that the best candidate will emerge.

    Speaking when he hosted former Anambra State Governor Peter Obi at the PDP Secretariat in Minna, Beji said: “We Will provide an enabling environment for all aspirants at the state and federal levels.”

    The faction of the PDP led by Chief Bode George is set to meet to decide their position on zoning.

    A leader and chieftain of PDP, Chief Ebenezer Babatope, said: “I am a fanatical member of PDP and I belong to the faction of Bode George.

    “We are going to meet very soon to decide what to do with the presidential election, especially on zoning.”

    Those who have declared their intention to contest for president on the PDP platform from the Southeast are former Senate President Anyim Pius Anyim and renowned pharmacist and former Senator Sam Ohuabunwa.

    Obi said he was still consulting, while Rivers State Governor Nyesom Wike is rumoured to be interested.

    The Nigeria Police Force (NPF) on Sunday directed officers across the country to stop requesting Customs papers from drivers.

    Acting Force Public Relations Officer (FPRO), CSP Olumuyiwa Adejobi, issued the directive via his Twitter handle.

    Adejobi added that the issuance of tinted glass permits remains suspended.

    He said officers are only expected to stop such vehicles, search it as well as the occupants.

    “No policeman should demand your customs papers. Except they are on joint operation, but not just on mere routine checks.

    “We have suspended issuance of tinted glass permits, so we don’t expect our men to disturb Nigerians on this.

    The police spokesman further urged Nigerians to report personnel who delay them for this purpose.

    Ohanaeze Ndigbo Worldwide on Sunday decried what it described as the constant negative comments of River State Governor Nyesom Wike, saying they could wreck his political career.

    The foremost Igbo socio-cultural group’s comments followed its disagreement with Wike’s recent verbal assault against Governor Obaseki of Edo State.

    It also insinuated that Wike was somehow involved in the recent judicial travails of Ebonyi State Governor, David Umahi, but provided no proof for the allegation.

    Umahi was recently sacked by an Abuja High Court but has since appealed the decision, while an Ebonyi High Court ordered the governor to stay put.

    Ohanaeze warned that it would not forgive Wike if he does not back down on Umahi’s travails.

    It claimed that there is a “grand scheme and conspiracy” to remove the Umahi, describing it as ”a subversive and provocative invasion aimed at distracting the South East from the 2023 presidential election.”

    It stated this in a statement issued on Sunday by Secretary-General Ohanaeze Ndigbo worldwide, Mazi Okechukwu Isiguzoro.

    Isiguzoro said: “The verbal diarrhoea of Governor Nyesom Wike of Rivers State in all national issues is worrisome, and that will likely wreck his political career to a disastrous end.

    “Any governor who is instrumental to displacing a fellow governor will be assessed by Nigerians at the end of 2023. How can anyone derive happiness from other people’s agonies and tragedies?”

    Chairman of Caretaker/Extraordinary Convention Planning Committee (CECPC) of the All Progressives Congress (APC) and Governor of Yobe state, Mai Mala Buni, on Sunday said all is now set for the ruling party to hold its national convention.

    The APC National convention is scheduled to hold on March 26, in Abuja.

    He disclosed that the activities of the Protocols Subcommittee have instilled confidence in members that all is set for the biggest party in Africa to now hold its National Convention.

    Buni, who was briefed by the Protocols subcommittee chairman and Governor of Kano state, Abdullahi Umar Ganduje, at his residence in Abuja on Saturday night, noted that the committee has gingered pessimistic party members that the convention is going to hold on the slated date (March 26).

    Governor Ganduje, in a statement issued by his Commissioner for Information and co-opted member of the committee, Malam Muhammad Garba, quoted Buni as assuring that the APC is organising a convention with a global outlook that calls for concerted efforts by all members.

    Buni commended the Protocols subcommittee chairman, his vice and other members for doing a good job at the venue and ensuring that the party is organised ahead of the convention.

    He said “the subcommittee is second to the main Convention Planning Committee, in view of its importance, which informed the appointment of Governor Ganduje to chair it alongside other illustrious members who have track records of achievements in their respective endeavours.”

    He charged the committee to work in synergy with other committees, particularly with the Protocol Office, State House Abuja, in view of the fact that President Muhammadu Buhari and Vice President Yemi Osinbajo would be attending the convention.

    The protocols Subcommittee chairman, Governor Abdullahi Umar Ganduje, told Buni that recruitment of young men and women who will serve as protocol officers and ushers during the national convention has been completed.

    “The recruits are receiving training, which is part of the responsibilities of the Protocols committee.

    “The committee has also been working to come up with a programme of event for a successful convention of the party,” Ganduje explained.

    Ganduje thanked the chairman of the CECPC for finding him and other members of the committee worthy to serve.

    He pledged to work with the central planning committee and other subcommittees to ensure that a successful convention is held.

    Other members of the committee are Senator Godswill Akpabio, former governor of Akwa Ibom state and Minister of Niger Delta Affairs; Senator Adeleke Mamora, former Speaker, Lagos State House of Assembly and Minister of State for Health; Rep. Hafiz Kawu, Tarauni Federal Constituency; Head of Protocol unit of the APC; Abdullahi Shu’aibu, among others.

    Electoral Act: NASS seeks legal advice, may challenge court ruling

    The National Assembly is shocked by Friday’s judgment from the Federal High Court, Umuahia, voiding Section 84 (12) of the Electoral Act and ordering its deletion forthwith, The Nation gathered yesterday.

    Consequently, the legislative arm has started assembling a team of legal giants to study the judgment and advise it on the next line of action.

    No less shocked by the court’s pronouncement are several senior lawyers who, yesterday, questioned the premise on which the judgment was based and the circumstances that birthed it.

    But that is not the only issue with the act. The Independent National Electoral Commission (INEC) yesterday turned in its own assessment of the law, saying that some of its provisions are inimical to the electoral process.

    The commission said it would seek practice direction on how to deal with the identified problems.

    Investigation revealed that federal lawmakers were shocked that the Federal High Court voided and repealed Section 84(12) of the Act.

    Their grouses include the following:

    • The ruling amounts to the erosion of the independence of the Legislature.
    • Neither the two chambers of the National Assembly nor the Independent National Electoral Commission (INEC) was joined as a party to the application.
    • No court can delete or repeal an Act but could void it.

    *Since the ruling is still justiceable at the Court of Appeal and the Supreme Court, it is hasty for the Federal Government to gazette it.

    A principal officer of the National Assembly, who spoke on the issue with our correspondent, said: “We were shocked by the decision of the court in a case we were not a party to. The National Assembly is already seeking legal advice on the next steps.

    “Neither the two chambers of the National Assembly nor the Independent National Electoral Commission (INEC) was joined in a fundamental suit like this.

    “The decision of the Federal High Court will no doubt undermine the legislative powers of the National Assembly. It may also set a bad precedent.

    “More importantly, no court has the power to repeal an Act of the National Assembly.”

    Responding to a question, the principal officer added: “The lawmakers have the right to seek redress in the Court of Appeal and the Supreme Court.”

     

    Judgment a great error, says Falana

    Senior Advocate of Nigeria and human rights advocate, Femi Falana, called the court order that Section 84(12) of the amended Electoral Act be deleted as a great error.

    The contentious section stipulates that “No political appointee at any level shall be a voting delegate or be voted for at the convention or congress of any political party for the purpose of the nomination of candidates for any election.”

    Justice Evelyn Anyadike, in her ruling, said the section ought to be struck down as it cannot stand when it is in violation of the clear provisions of the Constitution.

    The said Sections 66(1)(f), 107(1)(f), 137(1)(f) and 182(1)(f) of the 1999 Constitution already stipulate that people employed in the public service of the federal or state government seeking to contest elections should resign at least 30 days to the date of the election.

    But Falana, in a statement yesterday, said the judge “fell into a great error.”

    His words: “Sections 66 (1) (f), 107(1) (f), 137 (1) (f) and 182 (1) (f) of the Constitution relied upon by his lordship require persons employed in the public service of either the Federal Government or State Governments.

    “Specifically, each of the aforesaid sections provides that ‘No person shall be qualified for election into the Senate or House of Reps if:

    (f) he is a person employed in the public service of the Federation or of any State and has not resigned, withdrawn or retired from such employment 30 days before the date of election.’

    “By virtue of section 318 of the Constitution, political appointees are not included in the list of persons employed in the public service. To that extent, section 84 (12) of the Electoral Act was annulled on a very faulty ground.

    “No doubt, the Judge would have dismissed the case if his attention had been drawn to the cases of DADA v. ADEYEYE (2005) 6 NWLR (Pt. 920) 1 at 19 ASOGWA v. CHUKWU (2003) 4 NWLR (Pt. 811) 540 OJONYE V. ONU & ORS (2018) LPELR-44223) where the appellate Courts have held that political appointees or political office holders are not public servants as provided for under the Constitution.”

     

    NASS should not leave it unchallenged —Ukweni

    Another senior advocate, Mba Ukweni, said the National Assembly should challenge the judgment at the Court of Appeal.

    He said: “If one wants to contest an election, you resign from your position. For instance, if somebody is working in INEC, you cannot run in an election after sometime. The law has a reason for that.

    “An elective office is different from appointment. It has been there and it doesn’t violate any person’s rights.

    “Rights are not absolute. I will want the National Assembly, if they are made a party to it, to challenge the decision.

    “If I were a party in the case, I would challenge it in the higher court to have a second look at that provision.

    “I have read that provision and it doesn’t appear to be in conflict with the constitution. Even the fundamental rights provided in the constitution are not absolute.

    “If anyone wants to contest in an election and is holding a certain public office, he should resign.”

     

    Ajulo: It’s a booby trap for APC

    Constitutional and human rights lawyer, Dr. Kayode Ajulo, said the judgment could not stand in the face of the law.

    He also predicted a higher risk for political office holders who may want to take advantage of it.

    He raised three observations thus:

    *The Judgment of the Court is per incuriam

    *Political appointees are not public servants

    *The National Assembly is a necessary party and has a right to set same aside on Appeal

    *Compliance with the judgment of the trial court is a booby trap for the ruling APC.

    He said: “While the position of our laws is clear to the effect that judgments of courts are valid until set aside on appeal no matter how erroneous they might be, however, considering the ratio decidendi of the decision of the court viz-a-viz the expediency and imminent consequence of the decision of the court on our political administration and party politics, it is therefore imperative to pensively dissect the judgment of the court in the light of the spirit of the Constitution and position of the Apex Court.

    “Let us get a point clear: it is undoubted that Courts of superior record by virtue of Section 6 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), have the power to declare an Act of the National Assembly unconstitutional, null and void to the extent of its inconsistency.

    “More so, plethora of authorities have established the principle that where a provision of an enactment by the legislature conflicts with the express provision of the Constitution, the said extant law shall be declared null and void.

    “That is the essence of Section 1(3) of the 1999 constitution as Amended. It provides that ‘If any other law is inconsistent with the provision of this constitution, this constitution shall prevail, and that other law shall, to the extent of the inconsistency, be void.’

    “It is however instructive to note that in cases where legislation is contested for being in conflict with provisions of the Constitution, the courts have only one duty: ‘to lay the article of the Constitution which is invoked beside the statute which is challenged and to decide whether the latter squares with the former… See the cases of  U.S. v. Butler et al (1936) 297 U.S 1 (and Marwa & Ors v. Nyako & Ors (1980) LPELR-2936 (SC).

    “In the case under review, the learned trial judge noted that the provision of Section 84 (12) of the Electoral Act is inconsistent with the provision of Sections 66 (1) (f), 107(1) (f), 137 (1) (f) and 182 (1) (f) of the Constitution.

    “Suffice to state that a pensive juxtaposing of the Sections of the Constitution relied upon by the learned trial judge require persons employed in the public service of either the federal government or state governments.

    “What is more, the provision of Section 318 of the Constitution as to who qualifies as a public servant is unambiguous. Similarly, decisions of Court abound on this clear position. See Dada V. Adeyeye (2005) 6 NWLR (Pt. 920), Ojonye V. Onu & ORS (2018) LPELR-44223) where the appellate Courts have held that political appointees or political office holders are not public servants as provided for under the Constitution.

    “It therefore implies that the decision of court, with respect, is per incuriam and the ratio of court cannot find coverage under the Sections of the Constitution cited by the learned trial judge to arrive at the decision.

    “Based on the doctrine of judicial precedents, it is quite apposite that the Appellate Court will set aside the decision of the trial court.

    “For those who have mind to think, the perdurable questions to ask include:

    *Why was the suit filed in far away Umuahia, Abia State?

    *Why were the National Assembly and Independent National Electoral Commission not joined as parties to the suit?

    “To answer these thought-provoking questions, attention must be readily drawn to the fact that the National Assembly who is the authority empowered by Section 4 and 228 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and the Independent National Electoral Commission who is empowered to regulate the conduct of election in Nigeria by virtue of Section 153 of the Constitution respectively ought to have been joined by the Plaintiff as necessary parties to the action.

    “While it is not the duty of a judge to force on a Plaintiff the party to be sued, however judicial authorities abound to the effect that where a judge considers that a necessary party has not been joined to an action, it can suo motu make an order for the joinder of such necessary party.”

    Ajulo said the swift reaction of the Federal Government and the office of the Attorney General of the Federation to the court ruling “leaves too much to be desired of the ruling All Progressives Congress.”

    Continuing, he said: “If the All Progressives Congress should rely on the ephemeral judgment of the Court and proceed to permit Political Appointees to vote and contest at its primaries and conventions, same is a disaster going somewhere to happen.

    “What readily comes to mind is the decision of the Supreme Court in Zamfara State where the Apex Court held that there were no validly elected candidates in the various elective positions in the state from the APC.

    “In lending my two cents, it is not a triumph neither is it time for drunk fanfare for the All Progressives Congress.

    “The leadership of the party must be very circumspect in preventing a repeat of what happened in Zamfara State.

     

    Judgment is in order —Akintola

    On his part, Chief Niyi Akintola (SAN) said the judgment was in order.

    He said: “The constitution guarantees us the right to vote and be voted for. That aspect of Section 84 which they (NASS) ought to have removed was what the President pointed out.

    “They should have known that the section that says that a political appointee should not contest should have been retained as against to vote and be voted for.

    “There are millions of Nigerians who are already disenfranchised by the constitution which says that you must have certain qualifications before you can become one thing or the other.

    “Some Nigerians are already disenfranchised by that provision. They should have limited it to that level. But to say that somebody cannot vote is where they shot themselves in the foot.

    “That is what is wrong with Section 84 that was struck down by the Abia division of Federal High Court, and I am in full agreement with that judgment.  You cannot deprive a Nigerian the right to vote.”

    Asked whether the National Assembly could challenge the decision, Chief Akintola said: “Let them go ahead. I don’t think there would be any changes. It is very clear. You have the right to vote.

    “Why should I say you should not vote because you are a political appointee?  No act of the National Assembly should be in conflict with the position of the constitution. Section 84 of the Act is in conflict with the constitution. Every other law should come under the constitution.

    “There is no absolute right for anybody. No society in the world grants absolute right to anybody.

    “The right to vote is quite different from the right to contest. That is where they shot themselves in the foot. The right to vote is constitutionally guaranteed. The right to contest is a different kettle of fish.

    “If you want to contest, you must resign 30 days before. It is a constitutional provision and no act of the National Assembly can override that.

    “If they want a change, they should go and first of all amend that section of the constitution before they can enact the law. And not when that provision is still in force.

    “They maintain their rights to vote. People are missing the two. There is no absolute right anywhere, but the right to vote is a fundamental right.“

     

    INEC raises poser over new law

    For the Independent National Electoral Commission (INEC), it is some other provisions of the Electoral Act that are receiving its attention for now.

    It said yesterday that the issues are capable of hampering the 2023 general elections if they are not dealt with immediately.

    INEC’s National Commissioner and Chairman Information and Voter Education, Festus Okoye, cited the removal of pre-election matters from the High Courts and the High Court of the FCT and domiciling same with the Federal High Court.

    He said: “Now we need to get back to the Chief Judge of the Federal High Court relating to having a practice direction that makes it possible for issues and cases to be determined where the cause of action arose so that we do not have the same situation where a political party will conduct its party primary in Anambra and then issues around the party primaries will be determined by a Federal High Court in Borno State.

    “We need to have a practice direction that enables some level of order and sanity to be embedded in the operations of the several Courts as we continue towards this contentious period in our electoral process.

    “The Electoral Act has just come into force and there are many issues that have been embedded in the Act. We also need to begin a robust training of our staff in relation to some of the issues embedded in the new Act.”

    He added:”One fundamental issue that bothers the Commission is since the new Electoral Act has changed the trajectory of collation and transmission of election results, we have noticed that violence has left the collation centres back to the polling units and the Commission is really concerned about that.

    “We are going to have a high level of discussion on how to protect our Staff, especially at the level of the polling units, because the political parties know that results are now transmitted directly from the polling units to the first level of collation, and that those transmitted results are going to be used for the purpose of collation, and that if there are discrepancies between the electronically transmitted and manually transmitted results, that the BVAS will be called into question in terms of interrogating it to know how many people were accredited.”

    The atmosphere of peace and tranquility that returned to Imo State recently was shattered on Saturday, when gunmen razed the country home of   the President General (PG) of Ohanaeze Ndigbo, Prof George Obiozor,  and Umuguma Police Headquarters in Oru East and  Owerri West local government areas respectively.

    Eyewitnesses said two police constabularies on duty were killed during the attack  on the police headquarters but the police spokesperson  in the state, Michael Abattam, a CSP, told The Nation that  no casualty was recorded.

    “The attack is true but there was no casualty and no police man was killed as at the time we received the report,” he said.

    The attack on the police headquarters was said to have started at about 4.45am with  heavy bombardment that resulted in loss of properties worth millions of naira.

    While people were busy lamenting the despicable attack, more than 10 hoodlums in a convoy, according to eyewitnesses, struck at the  Awo- Omanma home of Obiozor. “They were spotted throwing explosives at the  magnificent building,” an eyewitness said.

    The eyewitness said the PG was not at home when the attackers executed the dastardly act.

    The attackers were said to have stopped at the gate, throwing dynamites which ignited part of the building into the compound .

    Some residents told our correspondent that properties worth millions of naira were engulfed by the fire.

    One of the residents said ” the country home of Prof George Obiozor was burnt last night. The CCTV cameras captured the attack. Thank God Prof was not at home when they came.”

    When The Nation called his mobile line, Obiozor did not answer. National Publicity Secretary of Ohanaeze, Alex Ogbonnia, promised to get back to our correspondent when contacted but was yet to do so as of the time of filing this report. But one of the leaders of Igbo socio-cultural group who pleaded anonymity confirmed the incident.

    He called on the police to fish out those who carried out the arson.

    Police spokesperson in the state, CSP Michael Abattam, also confirmed the incident, saying that part of the house was destroyed.

    “Some bad boys went to the place to set the house ablaze. Nobody has been identified yet, but we are investigating it,” he said.

    People  who witnessed the attack on the police headquarters said there was massive exchange of fire that sent residents of the area scampering for safety.

    Our correspondent learnt that on arrival, the gunmen who came with guns and explosives immediately opened fire at the divisional headquarters after blocking the roads leading in and out of the station including the one close to the LGA council headquarters.

    No fewer than 12 vehicles parked at the police station and the roof of the station were burnt by the explosives used in attacking the station.

    An  eye witness said that the sounds of the weapons the attackers came with frightened them as they ran into bushes out of fear of being hit by stray bullets.

    A resident of the area, who craved anonymity, said the hoodlums were callous. “On arrival, they blocked the roads, threw their dynamites into the police station and opened fire. They now laid ambush to attack officers who ran out of the station for safety.

    “Unfortunately, two police constabularies by name Ifeanyi and Iyke were killed. Ifeanyi was from Umunkwo in Umuguma community here. He was a final year student at Imo State University in Owerri. I knew him. It is just one year now he was recruited. He was trying to scale the fence when they used machete to cut him. He was sliced. The young man died on the spot. This is very unfortunate.

    “The second victim, Iyke was from Avu community. They shot him at one of his legs as he fled. He was later found dead at a water stand where he possibly went to drink water. This is very unfortunate.”

    Our correspondent gathered that it took the efforts of fire fighters from Owerri to quench the inferno.

    Another eyewitness said ” fire fighters just quenched the fire now. The entire place is in a state of fear and confusion as we didn’t sleep last night. The sound of the guns and bombs were too frightening. The invasion was deadly.”

    The attack came few hours the Assistant Inspector General of police in charge of zone 9- Umuahia,  Isaac Akinmoyede, left the state after a one- day working visit.

    Uzodinma, Ngige, others condemn attacks

    Imo State governor, Sen Hope Uzodinma, Minister of Labour and Employment, Senator Chris Ngige, and other prominent Igbo leader have condemned the attacks.

    The Imo State government in in a statement  personally signed by Governor Uzodinma regretted that desperate politicians who believe in violence were yet to sheath their swords in spite of repeated appeal to that effect.

    Uzodimma described the attack on the country home of Prof Obiozor as cowardly and height of desperation.

    He vowed that the government was already working in concert with security agencies to identify and punish the perpetrators.

    He bemoaned the incessant resort to violence in settling political differences by some politicians in the state, and warned that the government would no longer condone such banditry.

    According to him, “the time of those who unleash this kind of mayhem in the state is over. We shall hunt them down to face the full weight of the law.”

    Uzodinma wondered why the bandits should attack the home of a man who is not a politician but a statesman working for the good of the entire Igbo race.

    He said it was shameful that both the sponsors and perpetrators of the violence deployed their malicious attack on an innocent man.

    While commiserating with Prof Obiozor on the burning of his home,he assured Imo people that government will continue to do all within its Constitutional power to protect lives and property in the state.

    Meanwhile, most prominent personalities in the Imo state kept mum over the bombing of  Obiozor’s country home.

    Many  of them did not respond to  calls while some  who answered said they wanted to watch the unfolding event before commenting on the issue.

    However, the President of Ohanaeze Ndigbo in the state, Ambassador Azunna Akpelu condemned the arson saying that Prof. Obiozor has not made any inflammatory statement to warrant the burning of his house.

    “As it is now everything about about the incident is still sketchy. I don’t know why this could happened to him when he has not made any inflammatory statement against anybody that could warrant burning of his house. What I  know that about the Igbos is that they are lovers of their brothers, the Igbos are not violence, they are peace makers. Whatever ha that has caused that is what we have to find out and at an appropriate time I will now speak on that.”

    Elder statesman, Chief Emmanuel Iwuanyanwu said he would speak on the incident later but said Prof. Obiozor did not deserve what has happened to him.

    Also, a former House of Representatives member, Dr. Chris Asoluka said the President General “is a gentleman who does not deserve such treatment at his retirement age.”

    He called for concerted effort in tackling of insecurity in the state before it gets out of hand.

    “The incident is a bit disheartening and we ask ourselves where do we go from here. Obiozor doesn’t deserve it , he is a nice person.”

    Ngige  described  the  burning of  the Ohanaeze President’s house by gunmen as inhuman, disrespectful.

    He says the people who did such a thing have no respect for Igbo elders, adding that it was the same reason that led to the death of former Minister of Finance, Dr Chu Okongwu

    Speaking with The Nation on Saturday, the former Anambra State governor, said he aligned himself with what the new Anambra State governor, Prof Chukwuma Soludo said in his maiden address that there was need for dialogue.

    Ngige, maintained that he was of the belief that those performing such despicable acts in Igboland were not members of Indigenous People of Biafra IPOB.

    He said the group had been infiltrated by armed robbers, kidnappers and other hoodlums, adding that for anyone to burn the building of Prof George Obiozor, that they were no longer human beings.

    “Ndigbo have lost their economy for a long time. I believe that IPOB and Eastern Security Network ESN, had been hijacked by criminal elements.

    “The former Minister of Finance, Dr Chu Okongwu died few weeks after they burnt his house in Nnewi and the same people have the temerity to burn down octogenarian like Prof Obiozor’s house.

    “That action is condemnable, it’s inhuman and senseless. Anybody who listened to the address presented by Prof Soludo knows that it’s the way to go and we are not going to keep quiet , we will continue talking ” the minister said

    He said those who did such dastardly act had no respect for elder statesmen like Obiozor and Ndigbo.

    Also condemning the incidents, the Alaigbo Development Foundation (ADF) yesterday warned that Igboland would no longer tolerate the continued insurgency and destruction of property in the region by hoodlums.

    The ADF which was reacting to the attacks on the country home of the president general of Ohanaeze Ndigbo, Prof. George Obiozor and Umuguma police station all in Imo State, said the insurgency should end immediately.

    Spokesman of the group, Abia Onyike described the attacks as condemnable and regrettable.

    He blamed the Southeast governors for not doing anything about it, regretting that the Ebubeagu security outfit  was used to attack political opponents instead of using it to protect the people.

    Onyike said, “This thing should end by now. But nobody knows when it will end.

    “It’s very unfortunate that these things are still going on. It’s very condemnable and regrettable that the hoodlums and unknown gunmen are taking the centre stage in the Southeast.

    “It’s unfortunate that the Southeast Governors Forum is not doing anything about it.

    “The so-called Ebubeagu security outfit they set up, instead of using it to protect the people, they are using it to pursue, harass and attach their political opponents.

    “But when it comes to providing genuine security, they are nowhere to be found. It’s extremely unfortunate that the entire Southeast is very porous.

    “The governors should tell Igbo people what they are doing with the Ebubeagu security outfit.

    “The police and other security agents must rise up and arrest the situation. They must look for the culprits and bring them to book. This one is something that we can no longer tolerate. It is becoming too much”.

    The youth  wing of Ohanézè Ndígbo in a statement described the incident as an attack on the entire Igbo nation.

    Spokesperson of Ohanézè Youth, Maxi Chika Adiele in a statement said those who carried out the attack as shameless.

    He said:”Those who carried out they attack are shameless. They are trying to change the narrative. Igbo people are industrious, innovative, peacefully and hard working.We are not known for violence.

    “This is desecration of everything that binds us together. That attack is not just an attack on Chief Obiozor, it is an attack on the entire Igbo nation and whosoever that is involved, the God of Justice will bring them to book.

    “We in Ohanézè we are progressive and whatever thing that will bring lasting peace to Igboland is what we are in for.  I think they law enforcement agents will take action but we in Ohanézè youth will continue to support our Elders and every known conventional ways to bring peace. After all we are peace loving people. We will go ahead with our peace moves, it is a duty for every one of us, this is just a temporary setback”, he said.

    Former Minister of State for Health, Fide Nwankwo described the incident as shocking.

    He, however, called on security agencies to keep an open mind while trying to unravel those responsible for the attack.

    Mr Nwakwo, a PDP governorship hopeful, said the attack should serve as a wake up call to all southeast Leaders irrespective of political affiliations to close ranks and find a lasting solution to the security challenges bedeviling the region.

    He said:”The attack should spur southeast Leaders to find lasting solution to security challenges that has creeped into Igbo land. Let us close ranks and save guard our place.

    “This is very worrisome. It is not as if there is any internal war going on between the states in Igboland neither are we fighting over any economic issues, so it or really difficult to understand why this is happening”, he added .

    Senate Minority Leader, Senator Enyinnaya Abaribe, last night, described the attack by unknown gunmen on the Awomanma, Imo State home of President-General of Ohaneze Ndigbo, Prof. George Obiozor, as despicable and horrendous.

    Senator Abaribe in a statement by his Media Adviser, Uchenna Awom in Abuja on Saturday, said the unwarranted attack on the foremost scholar and Nigerian patriot depicts a dangerous slide to a state of anarchy that must be arrested immediately.

    The attack and others before it he said, have left a sour taste in the mouth of a hapless people haunted daily by fear of the unknown.

    The Minority Leader therefore urged the security agencies to carry out an indepth investigation on the incident and apprehend the perpetrators.

    “The attack said to have come on the heels of another attack on a Police Station in Umuguma, Owerri same day, calls for concern and deep introspection by Ndigbo and all men of good will.

    “We cannot continue this way and it stands condemned in the strongest terms,” Senator Abaribe said.

    Senator Abaribe however consoled Professor Obiozor and the Ohaneze Ndigbo family.

    Former national chairman of the All Progressive Grand Alliance (APGA), Senator Victor Umeh on Saturday said former Governor of Anambra State, Chief Willie Obiano did wonderfully well with Anambra money.

    Umeh said this while speaking on the arrest of Obiano by the operatives of the Economic and Financial Crimes Commission (EFCC), during the 80th birthday celebration of foremost Nigerian philosopher and president general of Alaigbo Development Foundation, Prof. Uzodimma Nwala in Enugu.

    Umeh expressed confidence that Obiano would defend himself.

    According to him, the former governor used Anambra money judiciously and committed same to verifiable projects.

    He said: “It is not new in Nigeria. Most governors, when they leave office, EFCC will swarm on them. He must be given the right to be heard. We don’t know why they arrested him. But I’m sure when they listen to him, he will be able to defend himself.

    “One thing I keep telling people is that former governor, Obiano did wonderfully well with Anambra money. He used our money well to the displeasure of those in the opposition. They don’t want to accept it.

    “A governor who built an international airport, got it commissioned and working. Planes are coming in there and going and you are still looking for your money. He also built an international conference centre. All these projects he didn’t build them with sand. Apart from meeting the other obligations of running the government, meeting the needs of the people, paying workers salaries, he did so much for Anambra State. That is why we have to be calm to allow the EFCC to finish their job. But I’m confident that Obiano will defend himself”.
