    BREAKING: PEPC rules Monday on Obi, LP’s request for live streaming of proceedings

    The Justice Haruna Tsammani-led five-member Presidential Election Petition Court (PEPC) has reserved ruling till Monday on the application by Peter Obi and the Labour Party (LP) for live streaming of the proceedings of the court.

    Justice Tsammani announced this a moment ago after lawyers to parties adopted their various processes.

    Lawyer to Obi and the LP, Awa Kalu (SAN) urged the court to grant the application in the interest of the public.

    The court has adjourned till Saturday for further pre-hearing session in the petition.

    BREAKING: Court nullifies Alex Otti’s candidature, other LP candidates in Kano, Abia

    A Federal High Court sitting in Kano has nullified the candidature of Abia Governor-elect, Dr Alex Otti and all the candidates of the Labour Party in Abia and Kano States.

    The court, which was presided over by Justice M N Yunusa, ruled that their emergence was not in compliance with the provisions of the 2022 Electoral Act.

    A copy of the judgement delivered by the court was made available to newsmen on Friday.

    The Court in suit No FHC/KN/CS/107/2023 filed by Mr Ibrahim Haruna Ibrahim against the Labour Party and the Independent National Electoral Commission, INEC, ruled that the failure of the Labour Party to submit its membership register to the INEC within 30 days before their primaries renders the process invalid.

    “The party that has not complied with the provisions of the electoral act cannot be said to have a candidate in an election and cannot be declared winner of an election; this being so, the votes credited to the 1st defendant is a wasted vote,” the Judge ruled.

    JUST IN: Apapa takes back seat in court

    The factional National Chairman of the Labour Party (LP) Lamidi Apapa on Friday sat at the back of the court during the Presidential Election Petition Tribunal.

    The Nation reports that Apapa was booed and mobbed by angry mob at the venue of the PEPC on Wednesday.

    Apapa told reporters that he was in court that Wednesday to assert himself as the Acting National Chairman of the party.

    On how he was mobbed, Apapa, said: “They pounced on me, removed my cap and I am very sure that if not that you people (journalists) were there, I would have been dead by now.”

    He alleged Obi was aware he would be attacked, stating that members of the presidential campaign group of the party in a meeting on Tuesday to broker peace among the warring factions, vowed to deal with him should he attend the court session.

    Apapa in an interview after the incident said he refused to be intimidated by the mob action and vowed to be present in court today.

    Keeping to his words, the factional chairman arrived in court room and decided to sit at the back of the courtroom, not in the area reserved for Labour Party officials.

    BREAKING: PEPC reserves ruling on INEC, Tinubu, APC’s request to dismiss Atiku, PDP’s petition

    The Justice Haruna Tsammani-led five-member Presidential Election Petition Court (PEPC) has reserved rulings in applications by the Independent National Electoral Commission (INEC), President-elect, Bola Tinubu and the All Progressives Congress (APC) seeking the dismissal of the petition by Atiku Abubakar and the Peoples Democratic Party (PDP).

    INEC, Tinubu and the APC are praying the court to either dismiss the petition in whole or some of its paragraphs and other accompanying processes filed by the petitioners for offending the provisions of the law.

    After taking arguments from lawyers to parties, Justice Tsammani announced that the rulings have been reserved to be delivered on the day of judgment in the main petition.

    Lawyers who moved the applications for INEC, Tinubu and APC – Kemi Pinheiro, Yusuf Ali and Lateef Fagbemi (all Senior Advocates of Nigeria) prayed the court to grant the reliefs in their applications, seven in all.

    INEC filed two, Tinubu filed three, while APC filed two.

    Lawyer to the petitioners, Chris Uche (SAN) in counter argument, urged the court to dismiss all the applications and proceed to hear his clients’ on the merit.

    The court has adjourned further pre-hearing session in the petition till Saturday for parties to agree on the schedule to be adopted for the hearing of the petition.

    The court has risen briefly, to resume shortly to commence further pre-hearing in the petition by the Peter Obi and the Labour Party (LP).

    N’Assembly: Governors will back Akpabio, Abbas, says Sule

    All Progressives Congress (APC) governors from the North have resolved to support President-elect Bola Tinubu’s choice of National Assembly presiding officers, Nasarawa State Governor Abdullahi Sule has said.

    He spoke during separate meetings at the Nasarawa State Governor’s Lodge with Senate President aspirant Godswill Akpabio and Deputy Senate President aspirant Barau Jibrin on Wednesday night as well as yesterday with House of Representatives Speaker aspirant Tajudeen Abbas and Deputy Speaker aspirant Benjamin Kalu.

    Akpabio was at the meeting with members of the Solidarity Group which is spearheading his campaign.

    Sule told the aspirants: “We cannot in any way fight the choice of Bola Ahmed Tinubu. We cannot in any way fight the choice of our party.” 

    He thanked the lawmakers for visiting him over the “project”, and described them as loyal party members who will work for the success of the incoming Tinubu administration.

    House Speaker Femi Gbajabiamila met with the Minority Caucus where members agreed on consensus building.

    Also yesterday, an aspirant for Speaker, Ado Doguwa, quit the race to support Abbas.

    But, the Northern Elders Forum (NEF), in its reaction to the controversy over the endorsement of candidates for National Assembly presiding officers, said the group will not campaign for selfish candidates.

    Its Publicity Secretary, Dr. Hakeem Baba-Ahmed, said the lawmakers should be allowed to choose principal officers based on merit and competence.

    Sule assured that Northern APC governors were on the same page with Tinubu and the ruling party over the choice of Abbas and Kalu.

    He said as the Chief Executive of his state, he also has preferred candidates for the leadership of the House of Assembly, adding that nobody would disagree with him on his decision.

    Sule said going against the choice of the President-elect and the party could create problems for the incoming administration.

    He stressed the fact that Northern governors were the ones who stood their ground for presidential zoning to the South where the “best has emerged”.

    He added: “If people hear that we’re disagreeing with the President-elect, they will laugh at us. We won’t disagree with him.”

    The Tajudeen/Kalu Campaign Team visited the governor as part of efforts to get the support and blessings of all stakeholders ahead of the inauguration of the 10th Assembly in June.

    On the Northcentral question, Sule said: “When Tinubu returns to Nigeria, we’ll sit down with him and ask him what is there for us in the Northcentral. 

    “I’m a governor, and when I indicate interest in who becomes the Speaker in my state, nobody argues with me.”

    He advised the aspirants to reach out to the other contestants in a bid to carry them along and get their support.

    Sule said: “You asked me for advice, and I’ll give you one. I saw you with PDP, LP and the rest of them. That shows you’re serious. Also, visit all the other aspirants. Visit all the opposition parties and ask for their support, so that they won’t penalise their members for supporting you.

    “I wish you well. I like the way you’re carrying the campaign. Try and carry everybody along. We know that the next administration is coming into an economic storm, so the president needs total peace and stability. From the governors, I promise you we’re going to give him the total support.”

    The country, he noted, is facing a lot. 

    “The incoming president will need somebody like Akpabio, as the chairman of the National Assembly, to enable him to push through his plans for Nigerians. 

    “Senator Akpabio to the best of my knowledge, has paid his dues, and that is why we are supporting him,” he said.

    Abbas told the governor that the team visited him to seek his support, cooperation and blessing.

    He said since his first election into the House in 2011, he has been making modest contributions to the legislature, which culminated in his sponsoring 74 Bills from 2019 to date, out of which 21 were signed into law.

    He recalled that before becoming a lawmaker, he had been a teacher from primary to tertiary institutions and that he established three different departments in Nuhu Bamalli and the Kaduna State University (KASU).

    Gbajabiamila, Minority caucus agree on consensus building

    Gbajabiamila and the Minority Caucus agreed to build consensus for the smooth take-off of the 10th Assembly and the emergence of presiding officers.

    A statement by spokespersons of the Minority Caucus – the Greater Majority – Victor Afam Ogene and Dachung Musa Bagos, said they agreed to consensus building in the interest of the House.

    The group led by Nicholas Mutu and Fred Agbedi had threatened to field candidates among the minority parties for Speaker and Deputy Speaker and set up a committee to shop for candidates.

    The group, a coalition of the seven opposition political parties, was led by Nicholas Mutu.

    Others, who accompanied him, included Wole Oke, Ali Isa, Dennis Agbo, Mansur Soro and Kabiru Ahmadu.

    At the end of the deadline, none of its members indicated interest in the two positions.

    The spokesmen said the parley with Gbajabiamila was the climax of a series of interfaces which the “Greater Majority” had with those aspiring to lead the House.

    Doguwa withdraws

    House Leader Doguwa announced his withdrawal from the contest, urging his supporters to support Abbas and Kalu.

    Speaking at a meeting of the Joint Task, 10th Assembly, Doguwa also announced that two other candidates, Abdulhareem Olawuyi (APC, Kwara) and Abubakar Makki Yalleman (APC, Jigawa) have withdrawn from the contest.

    Doguwa said Abbas is qualified, adding that he has the legislative experience to lead the House.

    He said he withdrew from the race to support the party’s choice because he is a beneficiary of the zoning arrangement.

    Doguwa said: “Don’t imagine that my appearance here is by accident. For those of you who are thinking you’re daydreaming, you’re not daydreaming. This is reality.

    “It is not like the table is turning against me. No. The truth is that the time has come for me to pay back and I think that paying back in these circumstances is a great responsibility that I must honour and oblige.

    “I rise today in the presence of my boss, Right Honourable Gbajabiamila, and I am flanked by Abdulraheem Olawuyi and Abubakar Makki Yalleman. 

    “Together collectively and individually, we are stepping into the shoes of this great campaign because, at every given time, there can be only one Speaker.

    “On this basis, we have all come individually and collectively to surrender our bid to be Speaker this time around to our great party, the APC and defer to our gentleman that was picked by the party to run for the speakership.”

    NEF: on merit we stand

    Baba-Ahmed said the North will not campaign for selfish persons jostling for principal offices.

    He said the northern voters have done their job and voted based on convictions over qualities of candidates while “some were induced, some voted along faith and others party lines”.

    Speaking at a one-day colloquium organised by the Democratic Watch Initiative (DWI) in Kaduna, he said: “Individuals and groups lobbying for positions from northern legislators should be conscious of a number of things. 

    “First, the best thing is to respect the independence of the legislature and allow members to choose their leaders.

    “The North does not want just any legislator from the North to become Speaker. We should hope that he has the highest personal integrity and a good idea of how his position can help him. All of them contesting should submit to a process by which their fellow contestants nominate them and then support them.

    “The same thing should be done at the Senate level. If those who know each other better than us cannot decide who will serve our interests as Northerners best, then we stop campaigning for all of them. We do not want legislators who want to be in positions of power to fulfil personal ambitions.”

    ‘Akpabio, Jibrin, best choices’ 

    Northwest APC youths endorsed Senators Akpabio for Senate President and Barau Jibrin as Deputy Senate President.

    The APC youth wing said Akpabio from the Southsouth and Jibrin from the Northwest will build the confidence of party members across the country, and foster national unity. 

    They also stated that both Akpabio and Jibrin are experienced lawmakers with a proven track record of achievements.

    In a statement by the Northwest APC Youths Leader, Abdulhamid Umar Moh’d, the group said both lawmakers are generally accepted across the country as a result of their contributions to the president-elect’s victory at the poll.

    Moh’d said: “The choice of Akpabio and Jibrin is so appropriate because both lawmakers made serious contributions to ensuring Tinubu won the election. 

    “While Akpabio relinquished his presidential ambition for Tinubu, Jibrin contributed immensely to APC’s triumph in the Northwest.

    “It is pertinent to note that, in the South, Southsouth contributed the second highest votes after Southwest which houses the President-elect. The Northwest gave the party the highest votes in the North with Kano State consistently giving APC the highest vote per state in every election since the formation of the party.

    “We understand that the business of legislature is highly professional because it deals with law-making and financial appropriation. Its leadership must be able, ready, and willing to support President-elect Tinubu.

    “We need pan-Nigerians who have been tested and trusted, proven worthy of integrity, character and prudent management to lead the Senate, hence the choice of Akpabio and Jibrin.

    “The President-elect is from the Southwest and the Vice President-elect is from the Northeast. As such, the Senate President should be zoned to the Southsouth and the Deputy Senate President to the Northwest. It should also be noted that Akpabio and Barau are experienced and competent lawmakers.

    “One has served as a governor and the other has been a long-term lawmaker.”

    The Presidential Transition Council (PTC) yesterday rolled out a programme for the inauguration of Bola Ahmed Tinubu and Kashim Shettima as President and Vice President on May 29.

    Tinubu will take office as the 5th president of the fourth republic and Nigeria’s 16th leader since independence.

    The president-elect will be conferred with the highest national award of Grand Commander of the Order of the Federal Republic (GCFR) and vice president-elect will get second highest national award the Grand Commander of the Order of the Niger (GCON) by President Muhammadu Buhari on Thursday ahead of their oaths taking four days later.

    Chairman of the Council and Secretary to the Government of the Federation (SGF), Boss Mustapha, said many foreign heads of state have been invited and expected to attend.

    Speaking to reporters at Aso Villa, the PTC chair said the theme of Tinubu’s and Shettima’s inauguration as the 16th President and Vice President will be: ”Nigeria: better together.”

    Pre-inauguration events include a regimental dinner in honour of the Commander in Chief on Tuesday at the Armed Forces Officers Mess at 7pm, and a valedictory Federal Executive Council meeting at the Council Chambers, Presidential Villa, the next day.

    After their investiture with the national honours on Thursday, Tinubu and Shettima will receive the transition documents at the State House Conference Centre at 10am. 

    On Friday, there will be a public lecture and 

    Jumaat prayer at the National Mosque at 10am and 1:30pm.

    The inauguration lecture on the topic: Deepening Democracy for Integration and Development by former Kenyan President, Uhuru M. Kenyatta, will hold at the International Conference Centre on Saturday at 10am.

    Also on Saturday, there will be a children’s day programme involving a parade and a party at the Old Parade Ground 10am and at the State House Conference Centre at 2pm.

    On Sunday, an inter-denominational church service will hold at the National Christian Centre at 10 am, followed by the inauguration dinner/gala night at the State House Conference Centre at 7pm.

    The main event – the inauguration parade/swearing-in, will take place on May 29, at Eagle Square, at 10am. 

    There will be a post-inauguration luncheon at the State House Banquet Hall at 1:30 pm.

    It will be strictly for the President and his brother presidents, heads of government and his guests.

    Mustapha said all events will be broadcast live and streamed on various social media platforms.

    He said invitations have been sent to the presidents and heads of government as well as heads of international organisations. 

    “Many of these invitees have confirmed attendance in person,” the SGF said.

    He described the handover as historic for Nigeria, urging citizens to embrace it as “a moment made for togetherness, unity, peace and progress”. 

    The SGF said adequate security arrangements have been made and restated that nothing would stop the inauguration.

    He retreated that inauguration would hold without a doubt.

    “Our Constitution and Electoral Act have dealt with that. Our laws are sacrosanct.”

    The SGF added that President Buhari has directed all relevant government institutions to cooperate with and support the transition process through engagement with the President-elect’s team. 

    “It is for this reason that President Buhari among other things, approved the inclusion of the team as part of the Federal Government delegation to the World Bank/IMF Spring meetings in Washington DC in April,” Mustapha said.

    National Security Adviser, Babagana Munguno (retd), said the committee has concluded arrangements for the accreditation and issuance of passes and identity documents for all security agents. 

    He advised those that have no business around the vicinity to steer clear.

    Munguno said: “My only advice is that if you have no business in security, you need not be near the vicinity of the programme, especially on the Inauguration Day. 

    “We do not envisage anything that will be adverse. So, I urge everybody to be calm.”

    EFCC: Zamfara Governor under probe for alleged N70b phantom contracts

    The Economic and Financial Crimes Commission (EFCC) has said Zamfara Governor Bello Muhammed Matawalle is under investigation for alleged award of phantom contracts and diversion of over N70billion.

    It said the cash was sourced as a loan from an old generation bank purportedly for the execution of projects which were never done.

    The anti-graft agency claimed that more than 100 companies have received payments from the funds, with no evidence of service rendered to the State.

    It said an Abuja property developer, collected N6billion on a N10billion contract without rendering any service to Zamfara state.

    It also said investigation has revealed that another contractor collected over N3billion for a contract for the supply of medical equipment.

    But the commission traced a payment of N400million from medical supply contractor’s account to a Bureau de Change operator.

    It said one of the beneficiary firms of the suspicious contracts, Fezel Nigeria Limited, has refunded N300million.

    It said Matawalle decided to attack EFCC chairman, Abdulrasheed Bawa because his tenure was coming to an end and he was becoming dreadful of his fate.

    It said Matawalle’s outbursts against EFCC were about a case of corruption fighting back.

    It asked Nigerians to expect more wild allegations made by Matawalle as those at the receiving end of EFCC’s investigations, fight viciously back.

    The EFCC made the clarifications at a briefing in Abuja by its Director of Media and Publicity, Barrister Osita Nwajah.

    The commission said it was yet to arrest Governor Matawalle because he still enjoying immunity provided by 1999 Constitution.

    But EFCC said from May 29, the Governor has a case to answer.

    Nwajah said: “It is intriguing that Matawalle would want to take on the role of a supervisor, who tells the EFCC whom to investigate. Is this a case of a “’thief’’ saying he must not be touched until other ‘’thieves’’ are caught?

    “Unfortunately, it is not within Matawalle’s remit to dictate to the EFCC whom to arrest, when and where. Suspects in the custody of the commission cut across all sectors and social class.

    “The qualification to get a space in the commission’s detention facility is to commit a crime. It does not matter whether you are a priest, Imam, Governor or minister. Currently, a former Minister of Power is in the custody of the EFCC over a N22billion corruption allegation. That conveniently did not attract Matawalle’s attention.

    “Of course, these shenanigans are not strange. They appear to play out in cycles, particularly when the nation is in political transition.

    “Virtually all the predecessors of the incumbent EFCC chairman suffered similar indignity at the hands of politically exposed persons under investigation for corruption. Who among the former chairmen of the Commission was not accused of pilfering recovered assets?

    “The commission would like to put the nation on notice to expect more of the kind of wild allegations made by Matawalle as those at the receiving end of EFCC’s investigations, fight viciously back.

    “But the real issue with Matawalle is that he is being investigated by the EFCC, over allegation of monumental corruption, award of phantom contracts and diversion of over N70billion.

    “The money which was sourced as loan from an old generation bank purportedly for the execution of projects across the local government areas of the state, was allegedly diverted by the governor through proxies and contractors who received payment for contracts  that were not executed.

    “The commission’s investigations so far revealed that more than 100 companies have received payments from the funds, with no evidence of service rendered to the state.”

    The EFCC spokesman, who claimed that the commission has interrogated some contractors, also provided insights into a few preliminary findings.

    Nwajah added: “Some of the contractors who had been invited and quizzed by the commission, made startling revelations on how they were allegedly compelled by the governor to return the funds received from the state coffers back to him through his aides after converting the same to United States Dollars.

    “They confirmed that they did not render any service to Zamafara state but were allegedly directed to convert the monies paid to them into United States Dollar and return to the State governor through some of his commissioners, notably the commissioners in charge of Finance and Local Government Affairs.

    “One of the contractors, a popular Abuja property developer, collected N6billion on a N10billion contract without rendering any service to Zamfara state.

    “Another contractor collected over N3billion for a contract for the supply of medical equipment but the Commission traced a payment of N400million from his account to a Bureau de Change operator. The contractor confessed the payment was to procure the dollar equivalent allegedly for the state governor.

    “As part of the extensive investigation of contracts award by the Matawalle administration, especially for phantom projects in the local government areas, the commission has recovered a sum of N300million from a company, Fezel Nigeria Limited. The funds were traced to the Zamafara Investment Company”

    He insisted that Matawalle has a case to answer.

    “The EFCC investigation is the source of anxiety in Government House, Gusau, with the governor in mortal dread of his fate once he steps down as governor on May 29. In Nigeria, state governors and their deputies enjoy immunity from criminal prosecution while in office, a reason the EFCC has yet to arrest Governor Matawalle,” he said.

    Nwajah, however, asked Nigerians not to be carried away by the sentiments of Matawalle because it was a matter of corruption fighting back.

    He said successive EFCC chairmen had always been victims of the antics of those under investigation.

    He said ideally, Matawalle “claims ought not to be dignified with a response.”

    He said:  “The attention of the Economic and Financial Crimes Commission, EFCC has been drawn to a statement credited to the Governor of Zamfara State, Bello Muhammed Matawalle, in which he attempted to cast aspersion on the integrity of the EFCC’s fight against corruption by making farcical allegations of corruption in assets disposal and plea bargain procedure, among others.

    “These claims ought not to be dignified with a response. What is at play here is a pure case of corruption fighting back. Matawalle’s outburst is product of paranoia- an uncomfortable exertion arising from the heat of EFCC’s lawful activities.

     “However, for the sake of some gullible citizens who might be swayed by the governor’s sudden burst of crusading zest, a measured response has become imperative to  expose Matawalle’ outburst for what it is, a hollow gambit to deflect attention from the real issue.

    “The issue has nothing to do with the transparency of EFCC’s asset recovery and disposal process. Contrary to the claims by Matawalle, the commission supervised an asset disposal exercise that was widely acclaimed as the most transparent in the country’s history.

    “Proceeds of the open and transparent exercise have since been remitted into the coffers of the Federal Government, and are being deployed in the provision of infrastructure for Nigerians.

    “The issue is also not about plea bargain. Indeed, it is hypocritical for Matawalle to rile a process for which he has been a beneficiary. Plea bargain is a practice established by law, and the Commission has never gone outside of the law in the application of this principle. If Matawalle has any evidence of abuse of plea bargain process, he is at liberty to make the disclosure.”

    Justice Tsammani made the announcement a moment ago after the court took arguments from lawyers to parties in the case.

    Petitioners’ lawyer, Chris Uche (SAN) prayed the court to grant his clients’ request, while lawyers to the Independent National Electoral Commission (INEC), President-elect, Bola Tinubu and the All Progressives Congress (APC) urges the court to reject it.

    Abubakar Mahmoud (SAN) for INEC, Woke Olanipekun (SAN) for Tinubu and Lateef Fagbemi (SAN) for the APC described the application as ridiculous, intended to among others, trivialize the court’s business .

    They added that the court has met the constitutional requirement by  making sufficient arrangements for the public to follow the proceedings by allowing a large media presence and providing huge television screens at the court’s foyer.

    Institutional reforms and rapid development will get immediate priority from the incoming administration, President-elect Bola Ahmed Tinubu has said.

    The target of the reforms is to bring help to the downtrodden and vulnerable Nigerians, Tinubu added.

    Besides, he pledged to unify the country and ensure the continuation of the positive relationship between Nigeria and the United States (U.S.).

    Tinubu spoke during a 20-minute discussion with U.S. Secretary of State Antony Blinken on Tuesday night.

    It was the first direct talks between the U.S. top diplomat and the president-elect, who is currently in Paris, France.

    The phone call was initiated by Blinken.

    Separate statements from the Tinubu media office and the U.S. Department of State confirmed the telephone interaction.

    But the Blinken telephone call to Tinubu left the Presidential candidate of the Peoples Democratic Party (PDP) in February 25 election Atiku Abubakar fuming.

    The statement by Tunde Rahman of the Tinubu Media Office quoted the President-elect as expressing his determination to strengthen Nigeria’s democracy and faithfully serve the people.

    Tinubu recalled being granted asylum by the U.S. when he was forced into exile during his struggle for the restoration of democracy in Nigeria.

    He expressed his absolute belief that the result of the election which he clearly won reflected the will of the Nigerian people.

    He further urged the U.S. to factor in Nigeria’s place in Africa and provide needed assistance in areas of security and economic investment in order for the nation to lead the way and be a shining example to the rest of the continent.

    Blinken assured that Nigeria should expect a good and mutually beneficial relationship with the U.S.

    He promised to play his part in ensuring and sustaining a cordial relationship between the two nations, saying a democratic and peaceful Nigeria is important to the U.S. as it is to Africa.

    Blinken’s office statement by Matthew Miller said: “The Joe Biden administration is committed to strengthening ties with Nigeria.

    “He emphasised his continued commitment to further strengthening the U.S.-Nigeria relationship with the incoming administration.

    “The Secretary noted that the U.S.-Nigeria partnership is built on shared interests and strong people-to-people ties and that those links should continue to strengthen under President-elect Tinubu’s tenure.

    “Secretary Blinken and President-elect Tinubu discussed the importance of inclusive leadership that represents all Nigerians, continued comprehensive security cooperation, and reforms to support economic growth.”

    The Independent National Electoral Commission (INEC) yesterday accused Labour Party (LP) and its presidential candidate Peter Obi of refusing to pay for documents.

    It said the petitioners were unwilling to pay the required fees for the certification of election documents required to prove their petition.

    INEC said their unwillingness to pay the prescribed fees accounts for the delay in the release of the remaining documents.

    They relate to the presidential election results in Sokoto and Rivers states.

    INEC’s lead lawyer, Abubakar Mahmoud (SAN), said this at the resumption of the pre-hearing session in the petition by Obi and LP before Presidential Election Petition Court (PEPC) yesterday.

    Mahmoud referred to a letter to him by the petitioners’ lawyer, Livy Uzoukwu (SAN), in which he protested the N1.5 million requested for the certification of the document concerning Sokoto.

    Mahmoud said his client was willing and ready to release the requested documents, once the stipulated fees were paid.

    “Specifically, with respect to Sokoto and Rivers, I was informed by the commission that the documents were provided, but the petitioners did not want to pay for certification.

    “In Rivers, they were given some documents, but they insisted they will not take any until all the documents they requested are made available,” he said.

    Mahmoud added that, unlike the petitioners’ team, the Peoples Democratic Party (PDP) got all the documents it requested because it complied with the requirements.

    He also accused the petitioners’ legal team of frustrating efforts by parties to sort out and agree on the mode of tendering available documents as exhibits.

    Mahmoud claimed that while the petitioners’ team made it impossible for representatives of parties to meet on May 10 as earlier agreed, it (the team) walked out of the meeting subsequently held on Tuesday without any provocation.

    Uzoukwu had complained that the scheduled report on the parties’ agreement on the tendering of documents was made impossible because INEC allegedly refused to grant his clients access to the documents.

    He said he wrote five letters, visited INEC headquarters and even met with INEC Chairman on the issue, all to no avail. 

    He prayed the court to compel INEC to make the documents, including Form EC8A, available to the petitioners.

    Uzoukwu denied the INEC lawyer’s claim that his clients were unwilling to pay and assured the petitioners were ready to pay any amount once it is official.

    He denied that the petitioners’ team walked out of the meeting as claimed by Mahmoud.

    Counsel for the President-elect and Vice President-elect, Bola Tinubu and Kashim Shettma – Woke Olanipekun (SAN) and the counsel to the All Progressives Congress (APC), Lateef Fagbemi (SAN) noted that from Mahmoud’s account, it was obvious that the delay in the release of the remaining documents was because the petitioners failed to pay the required fees.

    Olanipekun and Fagbemi said the account of what transpired at Tuesday’s meeting, meant for parties to agree on documents, was as told by Mahmoud.

    Olanipekun noted that the petitioners were making a mistake by refusing to pay the required fees, noting that certification and payment were allowed under Section 104(1) of the Evidence Act, without which the petitioners will be unable to tender the documents.

    He wondered why the petitioners insisted on getting all the documents before taking any further steps when they already have documents concerning 36 of 38 states.

    Fagbemi said: “The refusal of the petitioners to observe the protocol, to pay the necessary fees as required by law is what has made it impossible to proceed.”

    The court then adjourned till Friday for the possible conclusion of the pre-hearing session.

    The petitioners are to report on their agreement about the tendering of the documents and the hearing of pending applications, including those filed by the respondents seeking the striking out of some aspects of the petitions.
