    Inheritance: Islamic law governs estate of deceased Muslim with Christian Wife – Appeal Court

    The Court of Appeal in Kano has ruled that the daughter of the late Major Mohammed Arogun Adeniyi, Nike, and her Christian mother must share the deceased’s inheritance with the children of his other two widows, who are Muslims.

    Nike reportedly received ₦23,588,000 in gratuity and other entitlements but has refused to share it with her agnate siblings, citing her mother’s civil marriage.

    Justice Muhammed Lawal Shuaibu ruled that the estate of a Muslim who married a Christian under the Marriage Act is governed by Islamic Law.

    The Court of Appeal, in Appeal No: CA/IL/SH/1/2022, has set aside the judgment of the Sharia Court of Appeal of Kwara State sitting at Ilorin, in Appeal No: KWS/SCA/CV/AP/IL/14/2022, delivered on 3rd August 2022, wherein it set aside the earlier ruling of the Upper Area Court I, Ilorin.

    Major Mohammed Arogun Adeniyi, a Muslim, died on October 18, 2020 at the Nigerian Army Barracks, Kainji, Niger State, and was buried according to Islamic rites.

    He was survived by his aged parents, the appellants, and other heirs, and he left inheritable estates.

    While the deceased was married to Maimuna Mohammed and Inna Fatima Mohammed, the 1st and 2nd appellants respectively, the 2nd respondent, Evangelist (Mrs.) Olabisi Mohammed was married to the deceased under the Marriage Act.

    Upon his demise, the Nigerian Army paid the 1st respondent, Nike Mohammed, the deceased’s first daughter and next of kin in the records of the Nigerian Army, a sum of ₦23,588,000 as the deceased’s emoluments, insurance, gratuity and other entitlements.

    It was gathered that Nike, the next of kin of the late Major, was not willing to share the ₦23,588,000 gratuity and other entitlements of the deceased officer paid into her FCMB account, along with the properties of the deceased with the other entitled heirs.

    Consequently, the appellants initiated an action at the trial of the Upper Area Court against her.

    The mother, Evangelist (Mrs.) Olabisi Mohammed was later joined as a co-defendant in the suit at her instance.

    Upon being joined in the proceedings as the 2nd defendant, Evangelist (Mrs.) Olabisi Mohammed challenged the jurisdiction of the Upper Area Court to determine the suit, contending that since the deceased had married her under the Marriage Act, his estate was inheritable only by her and the children she bore him, to the exclusion of the deceased’s aged parents and the appellants, under the Administration of Estates Law of Kwara State. In other words, the trial Upper Area Court lacked jurisdiction to hear and determine the appellants’ case, and Islamic Law was not applicable to the estate.

    In his ruling, the trial Upper Area Court judge dismissed the objection and assumed jurisdiction to hear and determine the matter under Islamic Law.

    Aggrieved by the ruling of the Upper Area Court, Nike Mohammed and her mother appealed to the Sharia Court of Appeal of Kwara State, Ilorin, which reversed and set aside the ruling of the trial Upper Area Court, contending that it is the Administration of Estates Law of Kwara State, and not Islamic Law, that applies to the estate of the late Major, a Muslim, merely because the said military personnel married a Christian under the Marriage Act.

    Not satisfied with the said decision, the Appellants challenged the same before the Court of Appeal and the Court in its judgment considered a very pivotal question: what is the appropriate law to be applied in the distribution of the estate of a person who died as a Muslim who married a Christian under the Marriage Act?

    Agreeing with the submissions of Tajudeen Oladoja, SAN, learned senior counsel to the appellants, the Court of Appeal, in a unanimous judgment delivered by Justices Muhammed Lawal Shuaibu, Abubakar M. lamido and Ahmed R. Mohammed set aside the judgment of the Sharia Court of Appeal of Kwara State, Ilorin, delivered on the 3rd day of August 2020 and restored the earlier decision of the trial Upper Area Court No. 1, Ilorin, assuming jurisdiction to distribute the estates of late Major Mohammed Arogun Adeniyi in accordance with Islamic Law.

    The Court of Appeal held that the administration of the estate of a person who lived and died as a Muslim but married to a Christian under the Marriage Act is governed by Islamic Law.

    The students’ wing of the Coalition of Northern Groups (CNG) has cried out over the high rate of insecurity in and around the higher institutions of learning in the northern region.

    It, however, called on President Bola Tinubu to revisit the approach and reform the security architecture of the Nation as well as deploy troops to all campuses to ease the anxiety among students. 

    The students noted that following the insecurity in the campuses, kidnapping, and banditry attacks on campuses are now perceived as the new normal, with students suffering from psychological disorders and kidnapping anxiety as a result of either being a victim of kidnapping or having ones loved one kidnapped or lost someone dear to kidnapping activities or the fear of been kidnapped.

    Addressing a press conference in Kaduna on Tuesday, August 27, the group’s national coordinator, Hassan Adamu, said, the situation has increased students’ anxiety, leading to the withdrawal of female students from schools and poor academic performance.

    It also lamented that the Academic Staff Union of the University had issued a notice of warning strike, as a result of the inability of the Federal Government to resolve issues relating to the agreement reached between them.

    Adamu equally lamented that the rising foreign exchange rate has multiplied the price of learning materials by 300%, as many students can no longer afford essential textbooks, stressing that it is so bad that most students cannot afford a meal a day.

    He said: “The increasing hike in electricity tariff has compounded the problem on most of the campuses, saying that almost all the campuses are left blackout as a result of the inability of the management to settle electricity bills.

    “The increasing cost of PMS, he observed is quite alarming and leading to a hike in transportation, pointing out that the federal government has failed to fulfill its promises of donating CNG buses to schools.”

    The national coordinator equally lamented that the Region has been hit by a flood disaster leading to the loss of thousands of lives and properties worth billions of Naira including Farmlands, which is likely to affect the bumper harvest proposed by experts.

    He hailed the release of the Benue State medical students from captivity and called on relevant agencies to provide all the students with adequate psychological and medical healthcare. 

    He also called on the president to do everything possible to avert any form of industrial action in the tertiary institutions, saying that they would not go back to those days of having spent 7 years on a 4-year course.

    The students sympathized with all the victims of flood disasters across the region and Nigeria at large, calling on government at all levels to, as a matter of urgency, roll out relief materials for victims of flood disasters in the region.

    The Coalition of Northern Groups, the student’s wing, then called on the Federal Government to review its foreign exchange policies as advised by experts, noting that leaving the market forces to determine whether foreign will continue to increase inflation.

    “The Federal Government should, as a matter of urgency, reintroduce electricity subsidies at least for tertiary institutions or provide adequate solar electrification as expected.”

    Northeast Boko Haram victims to enjoy health insurance scheme – NEDC boss

    The North East Development Commission (NEDC) has concluded arrangements to provide health insurance scheme for vulnerable households and individuals in the Northeast region. 

    The Managing Director and CEO of the Commission, Alhaji Mohammed Alkali, said the plan would go a long way to support families in the region who were victims of the Boko Haram insurgents activities. 

    Alkali, who disclosed this during a meeting with the Chairman of the National Population Commission (NPC), also said his Commission would partner with NPC to address humanitarian problems affecting the region especially regarding the menace of out of School Children, Internally Displaced Persons, (IDPs) and victims of flood disasters. 

    Alkali praised the Management of the NPC led by its Chairman Nasir Isah Kwarra for providing geo-spatial data of the country’s roads, streets, Communications masts, bodies of water and demographic mapping that could assist the NEDC in the implementation of its Master Plan. 

    Alkali said the Commission had over time engaged the services of consultants and researchers to implement its development programmes in the region, promising that NEDC would henceforth work with NPC to address critical humanitarian challenges in the Northeast.

    He said the NEDC would be ready to sign a Memorandum of Understanding with the NPC to address challenges of out of school children, girl child education, Almajiris phenomenon and how youths in the region could benefits from training and skills acquisition programme organised and sponsored by the NEDC. 

    The NEDC boss said in line with its mandate, his commission developed a 10 year Master Plan to address poverty, displacement of people by insurgents and flood disasters, youth restiveness, inadequate infrastructures and climate vulnerability amongst others. 

    He commended the NPC for offering to collaborate with NEDC to address the challenges and make life more meaningful to people in the region, saying all the wards, and local governments councils in the six states of the region have been captured for specific programmes to address their needs. 

    Kwarra said the team decided to visit the NEDC to open doors of collaboration and support in critical areas of data and demographic information that would assist the Commission to deliver on its mandate. 

    He said: “Our decision to visit NEDC is germane as a body charged with the responsibility to generate data for socio-economic and demographic activities in the country, we are obligated to share experiences with your commission. 

    “These experiences are important to planning and execution of development programmes. Right now the NPC is on a nationwide campaign for birth registration. And as for the conduct of population census, we are on top of the game. 

    “We have geo-spatial data of the country on roads, streets, Communications masts, bodies of waters and demographic mappings on houses, and communities. This information will go a long way to assist your commission to deliver on its mandate. 

    “There is urgent need to address issues of poverty, out of school children, girl child education, internally displaced persons, inadequate infrastructures, climate change and environmental vulnerability. The NPC has data and other necessary information that your commission could leverage on to deliver services and programmes to the people in the Northeast region. 

    “We are also preparing to organise a regional summit on out of school children and the Almajiris question. We hope to bring in the Northeast governors, the Ulamas and other religious leaders to address the challenges. I believe that these are practical ways we can address the problems”.

    Kaduna state governor, Senator Uba Sani, has inaugurated a Skills Development Council for the state, emphasising his administration’s commitment to equipping citizens with the necessary skills for positions in industries and businesses attracted to the state by the government.

    At the inauguration, held at the Sir Kashim Ibrahim House on Monday, August 26, Governor Sani, who will personally chair the council, described the establishment of the council as a clear indication of his government’s resolve to address the state’s skills gaps effectively.

    The governor stated: “We want our citizens to have the requisite skills to fill positions in the industries and other businesses we have attracted to the state.”

    “This inauguration is indeed a milestone in our efforts towards addressing our skills deficit and empowering our citizens, especially youths to be relevant in a fast-changing world.

    “On assumption of office in May 2023, we committed to investing in human capital to put Kaduna State youths in good stead to respond to the fast-changing needs of the 21st Century and to effectively contribute to the economic development of our dear state.

    “As you are aware, the construction of the Vocational and Technology Skills Acquisition Cities in Rigachikun, Samaru Kataf and Soba has reached advanced stages. The long-term impact of the centres in terms of employment generation and economic growth will undoubtedly be far-reaching as the target beneficiaries would be equipped with the essential skills and entrepreneurial opportunities for financial independence.

    “The trainees will be equipped with a variety of vocational and technical skills including Welding and Fabrication, Articulated Vehicle Driving, Automobile Gas Conversion, Automotive Mechatronics, Solar Power Installation, Electrical Installation, Tiling, POP Making, Carpentry and Joinery, Fashion and Design, Information and Communication Technology (ICT), Artificial Intelligence (AI), Aluminum Fabrication, and Refrigeration and Air Conditioning.

    “The construction of the Remodeled Panteka Market in Tudun Wada, Kaduna is also progressing steadily. The remodelled Panteka Market will be a major centre for skills acquisition and job creation. Youths will be trained in carpentry, welding, painting, roofing, plumbing, electrical work, and other trades. We shall work out collaborative arrangements between the Remodelled Panteka Market and the Vocational and Technology Skills Acquisition Cities.

    “The Kaduna state government is collaborating with NBTE to provide the National Skills Qualification Framework (NSQF) certification which is an instrument approved by the Federal Executive Council for the development, classification, and recognition of skills, knowledge, and competencies acquired through technical and vocational training.

    “This is a globally recognized certification that will provide our youths with employment opportunities across various industries within and outside the country. Other globally recognized certifications that will be acquired from the centres include Microsoft, Google, CISCO, Huawei, and others.

    “The Kaduna State Skills Development Council, which I am about to inaugurate, will serve as the highest decision-making organ for skills development in the state. It will provide overall leadership and strategic direction for the development of strategies and an implementation plan for skills acquisition and development.

    “The Council has the following terms of reference: Develop a Skills Development Framework for the State; develop a strategic implementation plan for skill acquisition for the state; annually, produce an action/operational plan for repositioning the skills development system in Kaduna State, aiming to address youth unemployment and Coordinate and supervise the execution of the operational/action plan.

    “Others are to; Identify and attract technical and donor partners to support the strengthening of the skills development system of the state; Ensure objectivity, transparency, and inclusion in the selection of beneficiaries for skills acquisition programs with special consideration for females and persons with disabilities; develop strategies and establish collaboration with employers of labour to secure employment opportunities for trained youths; collaborate with the National Board for Technical Education to reposition the Skills Development System in Kaduna State and Carry out any other task relevant to the achievement of the Council’s objectives. 

    “Members of the Kaduna State Skills Development Council have been carefully selected based on their skills, competencies, and commitment to the Governance Agenda of our administration. I am confident that you will discharge this responsibility with total commitment and dedication,” he said.

    Earlier in his remarks, the Executive Secretary National Board for Technical Education, Prof. Idris Bugaje who was represented by Hussaini Mohammed, commended the establishment of the Skills Development Council and other initiatives aimed at up-skilling the state’s residents.

    He expressed confidence that the efforts would significantly reduce the challenges of insecurity fueled by poverty and unemployment, positioning Kaduna as a model for skills development in Nigeria.

    According to Professor Bugaje, “At the moment there are huge skill gaps in the oil and gas industry, building construction, engineering services, etc. across the world. If we train our youths they could take up these opportunities and Nigeria shall start earning foreign exchange from dollar remittances.

    “The second largest foreign exchange earner in Bangladesh after textiles, is the export of skills, with 11.5 million Bangladeshis: in the diaspora remitting about $40b annually,” he said.

    Deputy Governor, Dr. Hadiza Balarabe will serve as the Vice Chairman of the Skills Development Council, while the Secretary to the State Government, Dr. AbdulKadir Muazu Meyere, Commissioner of Business, Innovation and Technology Member, Commissioner of Local Government Affairs and ALGON Chairman will serve as members.

    Vice President Kashim Shettima, 10 governors, accompanied by at least 13 private jets were in Jalingo-the Taraba State capital for the wedding between the Taraba governor’s daughter, Keziah Agbu Kefas and Bitrus Josiah Agbu.

    The roll call of those governors present were: Adamawa State governor, Ahmadu Fintiri; Plateau State governor, Caleb Muftwang; Bauchi State governor, Bala Mohammed; Edo State governor, Godwin Obaseki; Rivers State Governor, Sim Fubara; Zamfara State governor, Dauda Lawal;  Borno State governor, Umaru Zulum; Delta State governor Sheriff Oborevwori; Enugu State governor, Peter Mbah; and Kogi State governor, Usman Ododo.

    The dignitaries held a dinner yesterday night after the PDP Governors’ Forum meeting. In attendance was Governor Usman Ododo of Kogi State, who won the Supreme Court judgement against SDP’s Mohammed Ajaka, a situation that attracted media attention.

    Meanwhile, the entire Jalingo city was shut down by the presence of dignitaries as all decent hotels were fully booked for guests.

    The entire Jolly Nyame Stadium, the venue of the occasion, was occupied by guests and onlookers of what has been widely perceived as the grandest occasion in the history of the State.

    Defence Minister donates N20 million to Jigawa flood victims

    The immediate past governor of  Jigawa State, who is also the current Minister of Defense, Alhaji Mohammed Badaru Abubakar, yesterday, presented a donation of N20 million to the victims of the recent flood disaster in Jigawa State.

    The minister announced the personal donation when he paid a visit to the state, also condoled the families and relatives of the people who lost their lives in the disaster.

    Abubakar during the visit paid a courtesy visit to the state governor, Malam Umar Namadi at Dutse Government House, noted that “With great sorrow, I came to commiserate with Jigawa State governor, Malam Umar Namadi, the victims and the entire people of the state on the calamity inflicted our state which so far killed 33 people, displaced over 7,500 families and washed away hundreds of hectares of farmland.”

    He also commended the state governor  for his rapid and quick response to the victims of the disaster, “This  shows your deep concern and caring for your people, thanks for that, and may Almighty Allah give you more courage and wisdom to guide the state to prosperity”

    The immediate past governor of the state said the donation was a personal assistance to the victims to alleviate their sufferings, therefore, urged the governor and the flood victims to take the natural disaster as an act of test from Almighty Allah , and submit everything to him, while at the same taking all necessary measures to minimize the damages.

    As the Federation Capital Territory Administration (FCTA) celebrates 33 retired management staff, the FCT Minister of State, Dr. Mariya Mahmoud, has emphasized the administration’s commitment in ensuring that the welfare of all staff is topmost.

     The minister who made this commitment at the grand reception in honour of the retired management staff of the administration, also stated that the establishment of the FCT Civil Service Commission was one of the promises fulfilled.

     Mahmoud, who was represented by her Senior Special Assistant on Administration and Strategy, Dr. Abdullahi Isah Kauramata, noted that the establishment of the commission has restored the lost hope among career civil servants in the FCT Administration.

     She said: “I think that hope has been given to the civil servants; that hope of realizing your ultimate desire; that hope of reaching the peak of civil service career, has been granted today by the present administration.

     “I must at least commend the effort of His Excellency, Barrister Nyesom Wike, with my support as Minister of State, we are able to realize this goal and this is made possible by the commitment of the present administration under the able leadership of His Excellency, President Bola Ahmed Tinubu.

I mean healthy living, so that you can see many more years ahead; so that your families that have now welcomed you back home will spend more quality time with you. And this can be achieved through a healthy lifestyle, healthy diet, among others”.

      In his address the FCT Head of Service, Mr. Samuel Attang, who was represented by the Permanent Secretary Education Secretariat, Mr. Prospect Ibe, observed that the careers of the retirees have been marked by diligence, professionalism, and an unwavering commitment to the principles of public service.

     He, however, commended the support and vision of the Minister of FCT, Barrister Nyesom Wike and Minister of State, Dr. Mariya Mahmoud, for fostering a culture of excellence and dedication within the ranks.

     Attang described the retirees as the backbone of the administration, just as he assured them that their hard work would not go unnoticed.

    Arewa group tackles Clark over letter against 27 Rivers lawmakers

    Arewa Youths for Peaceful Coexistence has tackled the elder statesman and bigwig of the Peoples Democratic Party (PDP), Chief Edwin Clark, for condemning the defensive actions of the party’s national secretariat in favour of the 27 PDP lawmakers of Rivers State.

    The group in a statement by its national chairman and the Abuja chapter chairman, Hon. Haruna Bature and Hon. Ogah Okpanachi, said Chef Clark as an elder, ought to play an advisory and mediatory role in the political crisis in Rivers, rather than taking sides with the sitting Governor.

    It, however, called on Chief Clark to retract his letter, apologise to the parties mentioned in the letter and assume the proper fatherly and mediatory role expected of him as an Elder Statesman.

    The statement said: “Attention of the Arewa Youths for Peaceful Coexistence has been drawn to the letter written by Chief Edwin K. Clark condemning the defensive actions of the Acting National Chairman and National Secretary of the Peoples Democratic Party (PDP), Alh. Illya Damagun and Sen. Samuel Anyanwu in favour of the 27 PDP Lawmakers of Rivers State.

    “We are greatly shocked and disappointed by the toxic hatred and bitterness expressed in the letter against the defensive actions of Alh. Illya Damagun and Sen. Samuel Anyanwu and the FCT Minister, Chief Barr. E.N. Wike in favour of the 27 PDP lawmakers of Rivers state.

    “We wonder why the elder statesman, Chief Edwin K. Clark who is supposed to be a mediator between the two factions suddenly lost touch with his status, and role and threw caution to the wind by taking sides with Governor Sim. Fubara to sacrifice the 27 PDP lawmakers forgetting that all the parties in this crisis are bonafide and prominent indigenes of Rivers State whose interests must never be sacrificed for another. 

    “The legal technicalities of the alleged defection of the 27 PDP Lawmakers of Rivers State have been severally challenged and judgments passed in favour of the 27 PDP Rivers state lawmakers at the Federal High Court and Court of Appeal, and therefore expected the elder statesman to have chosen the path of peaceful mediation and reconciliation to give proper closure to the issues in contention.

    “We categorically wish to state that the actions of Alh. Illya Damagun and Sen. Samuel Anyanwu properly informed the Court that the position of the party is to give all the parties in Rivers State Crisis fairgrounds to litigate their matters in court without fear or favour and should never be condemned for such actions.

    “Finally, we wish to remind Chief Edwin K. Clark that all the parties in the Rivers State crisis especially the FCT Minister, Chief Barr. E.N. Wike has fundamental rights enshrined in the Constitution of the Federal Republic of Nigeria which cannot and must never be compromised or sacrificed for any petty personal or regional sentiments.

    “We are therefore calling on Chief Edwin K. Clark to immediately retract the letter, apologise to the parties mentioned in the letter, and assume the proper fatherly and mediatory role expected of him as an Elder Statesman,” the statement read.

    Olofa, ODU hail Kwara Gov, seek support for expansion works on Ibrahim Taiwo Road

    The Olofa of Offa Oba Mufutau Esuwoye 11 has hailed Governor Abdulrahman Abdulrazaq’s passion for infrastructural and rural urban development. 

    He called on the people of the community to support the expansion and rehabilitation works recently approved for the popular Ibrahim Taiwo road.

    The Olofa spoke at his palace during a sensitisation visit by the Kwara Commissioner for Works Engr. Abdulquawiy Olododo, where he sought public support for the extensive construction works.

    On the Commissioner’s entourage were the Executive Chairman, Kwara State Geographical Information Service Alhaji Abdulkareem Suleiman; Chief Press Secretary to Governor Rafiu Ajakaye; Senior Special Assistant to the Governor on Infrastructure Engr. Ladi Yusuf; and some senior bureaucrats. 

    The team was received at the Palace by Olofa of Offa with many High Chiefs and the leadership of the Offa Descendants’ Union (ODU). 

    The Olofa commended Governor AbdulRazaq for the project and how his government continues to prioritise the welfare of the people of the state, including Offa community.

    The monarch said his subjects are lovers of development and are ready to cooperate with the government and the contractors.

    “We are happy for what brought you here today. We thank His Excellency for always being with us. His Excellency has always shown us that Offa is his second home,” Olofa of Offa said.

    “We are always in support of his good works and laudable projects, and we pray Almighty Allah to be with him in all ramifications.

    “I am sending out my chiefs and representatives to inform the people of the need to support this huge development. Nobody should disturb the contractor under any guise. If you have anything obstructing government’s setbacks, please remove it. This is in our interest.”

    Abdulquawiy said the team visited the First Class monarch to seek his support, especially with a view to educating persons whose temporary structures have taken over road setbacks to give way.

    “We are here in Offa to meet the Olofa of Offa, Oba Mufutau Gbadamosi Esuwoye II and the Offa Descendants Union (ODU) and to intimate them and the entire Offa community about the reconstruction of Ibrahim Taiwo road,” he said.

    “For us to reconstruct and expand this road, we will need to claim the government setback where we have some temporary structures. So we need their cooperation. 

    “As you all know, this government of Mallam AbdulRahman AbdulRazaq is about the people. There is the need for us to communicate and engage with the community for them to be aware of exactly what our intentions are and what we are doing. We are glad about the reception by the Olofa and the ODU.”

    The Commissioner said the contractors are now on site to proceed with the work, which will last about four months.

    The road will be supported with concrete drainage, solar street lights, and walkways, he added.

    National Vice President for ODU, Alhaji Tajudeen Bello, commended the administration for the road project, which he said reflects its commitment to infrastructural growth across the state.

    He urged residents to always respect road setbacks when erecting any structures, saying road setbacks are meant for public advantage.

    “We want everybody to key into what the government is doing. The government is not doing anything that is bad. It is the right thing to maintain the setbacks while building anything. So, the road setbacks belong to the government, and that is what the government is claiming for the good of our community,” he said.

    The Commissioner also inspected the Flyover at Unity, which he said is now 65% done. 

    “We are very satisfied with the quality of work done on this project.

    Just a few days ago, a delegation from Nigerian Institute of Civil Engineers was on this site, and they equally issued a statement that the quality that is being done is very satisfactory,” he said.

    “The project is moving at a good pace that we are very happy with. As you can see, we are already standing on the bridge.”
