Oba Akinleye warns against religious legal systems in Yorubaland

His Royal Majesty, Oba OmoTooyosi Adebayo M. Akinleye, has called for the continued preservation of secular legal system in Yorubaland, emphasising the region’s historical transition from the Osugbo/Ogboni judicial system to a more inclusive and constitutionally grounded legal framework.

In a letter addressed to His Eminence, Alhaji Muhammad Sa’ad Abubakar, CFR, the monarch highlighted the significant role the Osugbo/Ogboni system once played as a high court of justice in pre-colonial Yoruba society.

However, he noted that the region has evolved towards a system that embraces universal legal principles, allowing for freedom of thought, conscience, and religion as enshrined in Nigeria’s constitution.

“The shift from traditional judicial structures to a secular legal framework is not just a legal necessity but a social imperative,” Oba Akinleye stated. “It ensures that justice is administered fairly and without bias, irrespective of religious or cultural affiliations.”

Regarding the introduction of Sharia law in the Southwest, the monarch cautioned against any move that could threaten the constitutional secularity of Nigeria.

He stressed that imposing religious-based legal systems in a diverse region like the Southwest could lead to social discord and legal confusion.

“Our legal system must remain neutral and inclusive,” he warned.

“The introduction of Sharia in the Southwest could alienate non-Muslim populations and create unnecessary friction. We must ensure that no single religious doctrine dictates the rights of our people.”

Oba Akinleye reaffirmed that maintaining a secular legal structure is vital for peace, unity, and development in Yorubaland. He urged leaders to uphold the constitutional principles that guarantee equal rights for all citizens, regardless of their faith or beliefs.
