    Update: Supreme Court upholds Wike, Amosun, Umahi’s elections

    The Supreme Court on Wednesday upheld the elections of Nyesom Wike, Ibikunle Amosun and Dave Umahi as governors of Rivers, Ogun and Ebonyi States respectively.

    The court in three unanimous judgments in the appeals filed by Wike, his party, the Peoples Democratic Party (PDP) and the Independent National Electoral Commission (INEC), set aside the concurrent judgments of the Rivers State governorship election tribunal and the Court of Appeal, Abuja.

    The appeals were all heard by a seven-man panel headed by the Chief Justice of Nigeria, Justice Mahmud Mohammed.

    Justice Kudirat Kekere-Ekun, who read the lead judgments in the three appeals, upheld the return of Wike as winner of the election.

    “I find and hold that this appeal is meritorious and it is allowed. The judgment of the lower court delivered on the 16th of November 2015 and the judgment of the tribunal delivered on 24th October 2015 are hereby set aside.

    “The petition of the petitioners is dismissed. The return of Nyesom Wike as governor of Rivers State by the Independent National Electoral Commission (INEC) is restored,” she stated.

    Justice Kekere-Ekun said she will provide reason for her decision on February 12.

    Justices Mohammed, Ibrahim Mohammed, Sylvester Ngwuta, Kumai Akaahs and Amiru Sanusi, who were members of the panel agreed with Kekere-Ekun’s lead judgment.

    The candidate of the All Progressives Congress (APC), Dakuku Peterside and his party had gone before the Rivers State governorship election tribunal to challenge Wike’s return by INEC as the winner of the April 11, 2015 governorship election in the state.

    The tribunal, which sat in Abuja, ruled in favour of the petitioners and voided the election on grounds of widespread violence and non-compliance with the Electoral Act.

    It ordered a rerun election within 90 days.

    The apex court also dismissed the appeal by the PDP governorship candidate in Ogun State, Adegboyega Isiaka.

    Isiaka had challenged the judgments of the Court of Appeal and Ogun State governorship election tribunal, which both upheld the election of Ibikunle Amosun as governor of Ogun State.

    Justice Akaahs, who read the lead judgment, held that the appeal lacked merit and dismissed it.

    The court equally dismissed the appeal filed by governorship candidate of Labour Party in Ebonyi State, Edward Nkwegu.

    Justice Chima Centus Nweze, who read the lead judgment, held that the preliminary objection raised by Umahi succeeds in part.

    He resolved the two issues on the main appeal against the appellant.

    “No merit in this appeal. Umahi is the duly elected governor of Ebonyi State. Reasons will be given on Friday, January 29,” Justice Nweze held.

    Amosun marks birthday with the aged

    Ogun State Governor Ibikunle Amosun yesterday marked his 58th birthday with the aged.

    The governor gave them gifts.

    He also laid the foundation stone for the N8 million Oba Prisons Mosque at Oba, Abeokuta, the state capital.

    While his wife, Olufunso, organised the birthday celebration with the aged at the June 12 Cultural Centre at Kuto, Abeokuta, the Islamic Humanitarian Service (IHS) co-ordinated the mosque building project at the Oba Prisons in conjunction with the Nigerian Prisons Service (NPS).

    Special prayers, led by the Chief Imam of Egbaland, Alhaji Liadi Orunsilu, was offered to Allah while another was observed for him by Christians.

    Presenting gifts to hundreds of the aged, Amosun hailed them for their prayers and support for his administration.

    The governor reminded Ogun State residents of President Muhammadu Buhari’s visit to the state next week.

    He urged the residents to pray for the success of the visit, which will mark the 40 years of the state’s creation.

    On the mosque building project, Amosun, who was represented by Mr. Abdul-Jeleel Amosun, pledged to support it.

    The Deputy Controller of Prisons (DCP) at Oba, Raphael Odeyemi, said Allah would reward the initiators.

    Ambode, Amosun, Aregbesola, others mourn

    Lagos State Governor Akinwunmi Ambode yesterday commiserated with Ibadan people and the Oyo State government on the death of the Olubadan of Ibadan, Oba Samuel Odulana Odugade.

    The governor, in a statement by his Chief Press Secretary, Habib Aruna, described the late monarch as a well accomplished Nigerian.

    “Oba Odulana was an accomplished Nigerian. He gave his all to serve the country in various capacities.

    He was a seasoned civil servant and a thoroughbred politician, which saw him become a minister in the First Republic.

    “His contributions towards the establishment of both primary and secondary schools in the old Western Region cannot be forgotten in a hurry.

    “On behalf of the people of Lagos State, I wish to express our heartfelt condolence to the people of Oyo State. May his gentle soul rest in perfect peace,” Ambode said.

    Ogun State Governor Ibikunle Amosun described the late monarch as one of those who laid the foundation for the present day Nigeria.

    “A World War II veteran, the late Oba Odugade was a seasoned civil servant and a thoroughbred politician, who later became a minister in the First Republic.

    “He was involved in the establishment of both primary and secondary schools in the old Western Region and voluntarily retired, before being elected to represent his people in the 1959 pre-independence House of Representatives,” Amosun said.

    His Osun State counterpart, Rauf Aregbesola,  commiserated with the family.

    The governor described the late monarch as fatherly, quiet, peaceful and a bridge-builder.

    In a statement by his Director, Bureau of Communication and Strategy, Semiu Okanlawon, the governor said the monarch’s death has left a huge vacuum in the traditional rulers’ council in Oyo State.

    He lauded the late monarch for always championing peaceful co-existence as well as fostering cordial relationship among diverse groups.

    According to him, the monarch’s reign was peaceful, remarkable and progressive even though it was brief.

    Kogi State governor-elect Yahaya Bello described the late Olubadan as a unifying factor who used his position to transform the economy and cultural awareness of the Ibadan people.

    In his condolence message, Bello described the late Olubadan as “a great Nigerian who will be missed for his unifying aura and undying commitment to the transformation of Ibadan and Oyo State as a whole”.

    He added: “The late Oba was a father to all Nigerians and through his actions he greatly showed the receptive spirit of  Ibadan people by accommodating Nigerians from various parts of the country.

    “By conferring chieftaincy titles on non-Yoruba, he succeeded in making Ibadan a home for all.

    “During his reign, he attracted development to the ancient city of Ibadan and promoted the city as a blend of traditional power and modernisation.

    “I wish to commiserate with Governor Abiola Ajimobi and the people of Ibadan over this painful loss.”

    The Minister of Communication, Adebayo Shittu, called on the Olubadan-in-Council to ensure a smooth transition.

    He noted that one of the beautiful things in Ibadan chieftaincy is the rancuor-free manner in which successors are chosen.

    He said: “The late monarch was epitome of honesty, decency and a good symbol of Yoruba culture and tradition, who lived an unblemished life.

    “The late Olubadan played his roles as a father to all within his domain very well. I urged Ibadan people to sustain his values.”

    The Ogun State government has expressed satisfaction with the level of on-going projects, which are at 75 per cent completion.

    Governor Ibikunle Amosun, represented by Deputy Governor Yetunde Onanuga, gave the rating when he inspected the 8km dual-carriage way in Ofada-Mowe-Ibafo Road in Ogun Central Senatorial district.

    The governor said on February 3, the state’s 40th anniversary, most of the on-going projects would be ready for inauguration.

    He praised the contractors for working day and night to meet the completion deadline.

    Amosun warned traders in Ijebu, Ofada and Ibafo against illegal dumping of refuse, saying the government would not hesitate to wield the big stick on erring traders.

    He said the government would continue to enlighten residents and enforce environmental sanitation laws, until there is complete compliance across the state.

     

  • Bailout: Amosun as study in prudence

    It was originally derived from the 14th century Old French word, “prudence.” That French word, in itself also derives from the Latin word, “prudential” meaning “foresight, sagacity.”

    Indeed, the word prudence is usually associated with wisdom, insight, and knowledge. Little wonder, therefore, that it was considered by the ancient Greeks and later on by Christian philosophers, most notably Thomas Aquinas, as “the cause, measure and form of all virtues.”

    In other words, prudence is the mother of all virtues. It also refers to the exercise of good judgment, informed by intelligence and good character. Prudence requires the consideration of long term choices and implications of decisions, and the avoidance of biases that make us focus on instant gratification.

    This, perhaps explain why, economists would describe a consumer as prudent if he or she saves more when faced with riskier future income. This additional saving is called precautionary saving.

    Judging from this premise therefore, one can then logically come to the conclusion that no other word can better describe the decision of the Ogun State Governor, Senator Ibikunle Amosun, to opt for a 10-year repayment schedule for the bailout fund provided to states of the federation by the federal government.

    Whereas the federal government had offered to the states a 20-year repayment schedule, Amosun, a chartered accountant and prudent manager of resources, chose to repay the bailout fund in 10 years.

    Of course, that decision placed Ogun State in a class of its own. Ogun State is the only state in the federation to choose that path. If Ogun State had played along with the 20-year repayment plan, the current monthly deductions from its allocations would have been reduced by an amount in excess of N400m.

    But that would have been a short-sighted decision. Governor Amosun, being prudent, knew that what was required of him is a consideration of long term choices in a manner that avoid biases that often make the average person to focus on short-term rewards while ignoring the long-term implications.

    So by choosing a 10-year repayment plan, the governor is in the long run saving the good people of Ogun State over N80bn in debt service costs that would have been incurred over the period of the loan.

    He is in fact not stopping there. The governor is also working very hard to ensure that he saves more for Ogun State by exercising the option of making lump sum repayments of the principal whenever the state has the capacity to do so. By so doing, Governor Amosun intends to fully repay the bailout loan before the end of his tenure of office.

    “We don’t intend to leave any debt to the administration that will succeed us. Despite the apparent squeeze that this incremental repayment places on our finances in the short-term, we think it is the best decision for the people of Ogun State to have a much lower cost of debt overall, allowing financial resources to instead be directed towards the further development of our state,” the Governor said.

    So, where is this confidence coming from in an era where resources are dwindling and some have started calling for a reduction of the national minimum wage?

    Well, the answer again, lies in the meaning of the word prudence. “We took this decision because we are confident that the efforts we have made to date to diversify our revenue sources and strengthen our Internally Generated Revenue (IGR) base will continue to bear fruit as we proceed through our second term.

    “Indeed it is the fruit of these efforts that has enabled Ogun State to continue to pay salaries and pensions as and when due, despite the notable reduction of funds from the federation account,” Governor Amosun said. This also explains why the Ogun State governor was able to pay the December 2015 salaries of all civil servants in Ogun State before Christmas Day and also paid 10 per cent bonus.

    The Senator Amosun-led administration has repeatedly made it clear that it is not considering a reduction of the minimum wage or staff retrenchment as a result of the dwindling federal allocation.

    And he sure has good reasons for this confidence. Even before the current economic downturn, Governor Amosun had been forward looking by embarking on efforts that led to a quantum leap in the IGR profile of the state.

    Moving forward, the governor is not relenting in his administration’s drive towards further raising IGR through the provision of services to the people. Ogun State has a multi-pronged strategy to drive its revenues and cover recurrent expenditure. For instance, the Governor Amosun administration has been hugely successful in attracting major industries to Ogun State and this has had the effect of creating jobs for the people and increasing government revenues from taxes.

    The governor has also repeatedly stated his administration’s resolve to make agricultural production and industrialisation, which is one of the five cardinal programmes of his administration, a major source of job creation and invariably a source of revenue for the government.

    With the advantage of proximity to Lagos, the biggest market in Nigeria; being the gateway to the rest of Nigeria as well as proximity to the markets of the West African sub-region, Ogun State in fact holds the potential of seeing its revenue base grow steadily over the years.

    This growth is even further guaranteed by prudent and effective management of resources which is one of the major hallmarks of the Governor Amosun-led administration.

    Our challenges are stepping stones for greatness – Amosun

    Governor Ibikunle Amosun has urged Nigerians, particularly the people of Ogun state, to take the challenges of the current economic slow – down buffetting the country as stepping stones to greatness.

    Amosun charged Nigerians to gird their loins and prepare  for the challenges ahead, adding that with collective prayer, sense of purpose and dogged determination, Ogun state and Nigeria would be lifted to the league of developed economies.

    The Governor who made this known in his New Year  broadcast on Friday, said preparedness for the challenges ahead is imperative to ensure that  nobody is caught unaware of the present economic slow-down.

    According to him,  the only way to continue to be good partners in progress is for every citizen to play his or her own part through cooperation with government and payment of necessary taxes and levies.

    Amosun also noted that the current economic climate neither exempt Ogun from the imperative of financial sustainability as a state nor his administration’s responsibility to create wealth and employment for the citizenry, particularly the youths.

    He said that the administration is working diligently  to increase the state’s Internally Generated Revenue (IGR) so that it can be self sustaining and reduce over-reliance on the federal allocation.

    Amosun added: “No doubt, in the just ended year, the nation and States witnessed significant economic slow-down which expectedly took its toll on the States of the federation such that many States could not meet up with the primary purpose of governance and payment of salaries for their various workforce.

    “We have cause to thank God that the same year brought us an exceptional change, especially at the Federal level where we now have a new Government in place.

    “It is worthwhile to say that while the State is directly affected by the challenge of reduced fund allocation from the centre, our Government has been striving not to disappoint the good people of Ogun State, as we have ensured regular payment of salaries as well as continued with our developmental projects.

    “For our Civil Servants to have a fun-filled yuletide celebration we have not only paid December Salary before the Christmas celebrations, we equally paid ten (10) percent of their salary as bonus.

    ” We cannot but thank the good people of Ogun State for the support given to us that contributed to the immense achievements recorded during the first term of our Administration. You all are indeed good partners in progress and this is continually evident in this first year of our second term.

    “Truly, the first year of our second term is very important to us as a Government as it will dictate and set the tone for our second term which to us is indeed a period of “optimisation”.

    “Towards this end, the task of rebuilding our dear State and repositioning our workforce as the best in the country remains sacrosanct.

    ” It is as a result of these genuine people-oriented projects and developmental strides that our State has soared to a higher pedestal making it the envy of many and the pride of her citizens, both at home and in the Diaspora. Even, the most ardent of our critics have come to the conclusion that Ogun State is now carving a niche for itself among the comity of States.

    “I enjoin us all to continue to gird our loins and prepare ourselves for the challenges ahead. As a State, we must ensure that we are not caught unaware of the present economic slow-down, knowing fully well that challenges like these are veritable tools to be used as stepping stones for greatness.

    “With our collective prayer, sense of purpose and dogged determination, we will no doubt lift our State to the league of developed economies. Needless to say that the only way to continue to be good partners in progress is for every citizen to play his or her own part through cooperation with government and payment of necessary taxes and levies.

    “This begins from doing the right things and at the right time. Dear people of Ogun State let me assure you all that this New Year will bring us greater development.

    “This means we must be further prepared, more than ever before. As trustees of your mandate, you can be rest assured of our unreserved commitment and unalloyed dedication to the successful accomplishment of the “Mission to Rebuild” Ogun Statte.

    “We will no doubt leave no stone unturned in improving the lives of our people. As you all know, the New Year brings us into another milestone as our dear State turns 40, come 3rd February, 2016. It is imperative to thank God because truly, we are not the same as we were at inception 40years ago.

    ” In the same vein, we cannot but be grateful to our founding fathers, and particularly those that served before us whose efforts contributed to the development of the State and improvement in the lives of our people.

    The Court of Appeal, sitting in Ibadan, the Oyo State capital, yesterday upheld the judgment of the Governorship Election Petition Tribunal of October 23 in Abeokuta, which upheld the victory of Ogun State Governor Ibikunle Amosun.

    The five-man panel of the Appeal Court, led by Justice H.M Ogunjimiju unanimously upheld Amosun’s victory and dismissed the appeal filed by Adegboyega Isiaka of the Peoples Democratic Party (PDP).

    Ogunjimiju held that Benjamin Ibikunle, the Principal Witness, PW9, for the appellant was not a credible witness, adding that his testimony could not be relied upon by the court.

    She said the evidence of PW9 was biased and could not be given any probative value because he informed the court that he was a PDP member and could go to any length to ensure victory for his party.

    The judge said the report of the witness was inconsistent and that there was no doubt he did not take part in the inspection of electoral materials.

    Justice Ogunjimiju said the court could not give any probative value to the testimony of the witness because he was not an expert.

    It said that only an expert opinion could be given probative value by the court, adding that the tribunal was right in dismissing the petition.

    The panel said there was no place that the number of voters exceeded the number of those accredited and that the election complied with the Electoral Act.

    It said the appeal lacked merit and dismissed it while declaring Amosun winner of the April 11 governorship election.

    The five-man panel of the Appeal Court headed by Justice H.M Ogunjimiju unanimously upheld Amosun’s victory and dismissed the appeal filed by Mr. Adegboyega Isiaka of PDP.

    Ogunjimiju held that Mr Benjamin Ibikunle, the Principal Witness, PW9, for the appellant was not a credible witness, adding that his testimony could not be relied on by the court.

    Amosun advocates return to agro-forestry

    Ogun State Governor Ibikunle Amosun has advocated a return to agro-forestry as an effective means of lifting Nigeria out of its economic doldrums.

    Amosun spoke yesterday at a session of environmental experts at the 2015 United Nations Climate Change Conference of Parties, COP 21 in Paris, France.

    He said: “The way to go if we really want to come out of the economic crisis is through agro-forestry. It will save our environment and provide jobs for our people. If we are going to get it right as a nation, we need to diversify our economy. We are blessed with natural and human resources and the best way to diversify is via agriculture that will lead us to industrialisation.”

    Amosun hailed the global focus on sustainable and eco-friendly development, which the COP 21 represents.

    “I am happy and excited about the COP 21 conference because everyone is putting attention on the environment.

    “It is so important to us in Ogun State because we have the largest base of industries in Nigeria and, therefore, we need to look into energy sources that are environmental-friendly for the industries,” Amosun said.

    He seized the occasion to stress that in Ogun State, the era of uncurbed carbon emissions by companies was over.

    Amosun said this was necessary due to the long term effects of such carbon emissions on the livelihoods and health of the people.

    The Ogun State governor also called on global investors, who are not yet in Ogun State, to make the Gateway state their destination.

    He said Ogun State was a perfect destination for local and foreign investors because it is blessed with human capital, access to major markets in Lagos and the West African sub-region as well as investor-friendly policies.

    Governor Ibikunle Amosun yesterday presented a budget proposal of N200, 274, 453, 352 billion to the Ogun State House of Assembly.

    The budget is expected to be financed largely from Internally Generated Revenue (N108 billion), federal allocation (N42 billion) and external loan (N40 billion).

    The 2016 budget experienced 4.9 per cent reduction compared to this year’s N210.3 billion.

    Amosun, who spent nearly two hours defending the budget, christened: “Budget of Optimisation”, said the budget would be judiciously used to execute his administration’s five-point agenda.

    The governor said his administration would not reduce the N18,000 minimum wage.

    He said: “Despite dwindling funds from the Federation Account, decisive and pragmatic steps must be taken as we seek to actualise our goals in Ogun State.

    “We shall continue to demonstrate prudence while also exhibiting financial resourcefulness to ensure that projects across the state are completed.”

    According to him, the proposed budget would be allocated among the administration’s five cardinal programmes – affordable qualitative education N40,170,805,280; efficient health care delivery N14,346,259,000; agricultural production/industrialisation N10,167,958,000.

    Others are affordable housing and urban renewal N26,567,290,663 as well as infrastructural development/employment generation N31,048,600,000 and miscellaneous N77,973,540,409.

    He assured the people that all projects, particularly roads, would be completed before 2019.

    The governor explained that N99.29 billion (49.6 per cent) was allocated to capital expenditure while N100.98 billion (50.4 per cent) went to recurrent expenditure.
