    Jos High court suspends Nigeria Professional League over Giwa FC

    Nigerian Professional Football League (NPFL) has been suspended indefinitely until the League Management Committee (LMC) fully complies with the earlier order of the court reinstating Giwa FC back to the league.

    Proprietor of Giwa Football Club, Ambassador Chris Giwa has dragged NPFL and LMC before the State High Court to address the suspension of his club from participating in the ongoing premiership.

    Justice I Kunda in his ruling delivered at the Plateau State High Court which sat in Bukuru, near Jos yesterday decried the delay tactics being employed by the counsel to the LMC, Olumide Olujimi, to delay the case knowing fully well that the Nigerian league is time bound, and the league would have effectively ended before the case is determined.

    The judge declared the case adjourned sine die but also told the defendants that they can proceed with their appeal at the Appeal Court if they so wish.

    The League Management Company (LMC) has filed an appeal against the Plateau State High Court order asking it to reinstate Giwa FC to the Nigeria Professional Football League (NPFL). The LMC, in its appeal filed by Chief Akin Olujimi (SAN), is praying the Court of Appeal to set aside the interim order of the Plateau State High Court, Jos on several grounds of law and challenging the jurisdiction of the lower court to have granted the orders in the first place.

    In a related development, the League organizers also made an appearance through its counsel, Chief Akin Olujimi (SAN), before the High Court in Bukuru, near Jos-Plateau State presided over by MR Justice I.I Kunda and filed a motion urging the court to stay further action on the orders it issued last week.

    It will be recalled that the order was made by the lower court in the suit filed by one Mustapha Abubakar, who claims to be suing for himself and Giwa FC, asking the Court to direct LMC to restore Giwa FC to the NPFL and reschedule all matches of the club, among other prayers.

    But a new twist to the suit emerged when Giwa FC wrote to LMC to categorically dissociate itself from the suit filed by the said Mustapha Abubakar. In its letter to LMC, dated 22nd August, 2016, Giwa FC stated that it is not a party to the suit and has not instructed anybody to file a case on its behalf and, therefore, distance itself from the case entirely.

    Giwa FC’s disavowal of the suit is in compliance with the written undertaking that all Clubs in the NPFL individually signed and gave to LMC agreeing not to take any matter concerning NPFL to the ordinary courts, but rather to be subject to and be bound by the internal dispute resolution processes of NPFL and football governance, generally. This undertaken is one of the critical conditions demanded of any club or persons applying to participate in football activities globally.

    The LMC gave five grounds for the appeal which included lack of jurisdiction by the Jos High Court to hear the matter since the two principal defendants, the LMC and the Nigeria Football Federation (NFF) reside in Abuja and that the acts complained about which is the hearings and expulsion of Giwa FC also took place in Abuja.

    A second ground of appeal filed by the counsel to the LMC was that the Jos High Court Judge who granted the order as a Vacation Judge is only entitled to hear cases of urgency and there must be an affidavit of urgency filed with the papers to show the facts of such urgency before the court can hear the matter. The LMC contend that there was no such affidavit of urgency and therefore it was wrong for the court to have heard the matter and grant orders as it did.

    The LMC further averred in the appeal that it was also wrong of the Judge to have heard the case as a fundamental human rights case since Giwa FC Limited, the owner and operator of the football club and the football club itself cannot have fundamental human rights. “The law is settled in Nigeria that only natural persons and not corporate persons can have fundamental human rights. This point, additionally, goes to the lack of jurisdiction of the court to hear the case,” the LMC stated in the appeal papers.

    The body further argued in the appeal that “In law, only a company can sue for itself for wrongs allegedly done to the company. Any person suing on behalf of a company must have the resolution of the company authorising that person to do so. That condition has not been fulfilled in this case”.

    Giwa FC’s letter buttresses and is a confirmation of LMC’s position from the beginning that the said Mustapha Abubakar is an interloper, who has no dealings or connection whatsoever with LMC or the subject matter of Giwa FC’s expulsion from NPFL, a decision which was reached with strict compliance with due process and the relevant provisions of the Framework and Rules of NPFL, 2015/2016 Season.

    Hearing of the motion was adjourned till today.

    Giwa FC reinstated to Nigeria league after court order

    The League Management Company (LMC) has reinstated Giwa FC to the Nigeria league in compliance to a court order to that effect.

    According to a statement by the LMC and signed by chairman Shehu Dikko, Giwa FC, who were expelled from the league after they failed to honour a total of three matches, have been restored to the league and their players could no longer feature for the clubs they were sent out on loan to after their expulsion.

    The statement read in part: “… as a law abiding corporate entity, LMC has taken immediate steps to effect compliance with the directives of the Court, as contained in the Order, pending the hearing and determination of the Motion on Notice. To this end, kindly be advised that:

    “Giwa FC has been restored to the NPFL table, while further processes are being activated to reschedule the matches concerning the club, in accordance with the NPFL Framework and Rules, 2015/2016 season;

    “No club shall henceforth feature any player whose registration it acquired on the basis of the expulsion of Giwa FC, as all such registrations are withdrawn.”

    The Disciplinary Committee of the Nigeria Football Federation (NFF) on Monday ratified the expulsion of Giwa FC by the League Management Company (LMC).

    The Jos-based side was sent packing from the Nigerian top-flight after failing to honour three cumulative games which breached league guidelines, supersport.com reports.

    Giwa FC was banished to Ilorin to play three home games after unruly fans marred a league game involving the home team and Enugu Rangers in May.

    However, the team did not travel to Ilorin to play the games but elected to travel for away games.

    The LMC brought down the hammer on the Jos-based side and was thrown out of the league in accordance with the league statutes.

    The NFF Disciplinary Committee has now upheld the decision of the LMC to expel Giwa FC from the Nigeria Professional Football League (NPFL).

    “The committee finds Giwa FC in breach of Rule B13.28 of the NPFL Frame Work and Rules which states that ‘if a club fails to honour three matches cumulatively within the League season without an acceptable reason to the LMC such a club shall be expelled from the League and its matches played and unplayed shall be cancelled,’” the committee said.

    Giwa FC defender Shittu Lawal believes that his side will be looking to have three points in the bag as they were able to do against the likes of Sunshine Stars and Kano Pillars when NPFL leaders Enugu Rangers come visiting on Sunday.

    The Jos Elephants welcome Imama Amakpakabo’s Flying Antelopes to the Rwang Pam Stadium, and Shittu hopes that his team employs the same determination that brought success to them against big teams in the past.

    “This season when we got six points at home against Sunshine and Pillars the tempo was really up there,” Shittu told Goal.

    “We were in their faces and picked up some really good points against the really big teams and we’ll look to do that again. Even though we are all professionals, everyone loves playing against the big teams in the big games.

    “As a player, I can tell you first hand that when you get games like Enyimba, Kano Pillars, Rangers, Shooting Stars and Heartland, you enjoy it a lot more.

    “We at Giwa FC relish the challenge and will be targeting the maximum points against the Flying Antelopes this weekend.”

    The match-day 12 tie between Giwa FC and Enugu Rangers will get underway by 4pm at the Rwang Pam Stadium on Sunday.

    ‘Giwa FC belongs to Plateau State’

    The owner of Nigeria Professional Football League Outfit, Giwa FC of Jos, Ambassador Christopher Musa Giwa has urged citizens of Nigeria, particularly those residing in Plateau State to see the team as a Plateau State team and not his personal business enterprise.

    Giwa made the statement while speaking with journalists at the Rwang Pam Stadium after his team recorded a heart-warming 1-0 victory over Shooting Stars Sports Club of Ibadan on Sunday.

    The statement was in reaction to a question thrown at him in respect to whether they would play their home games in Jos if they grab a continental ticket at the end of the season.

    “I wonder why you guys are asking this kind of question, if God gives us this team for Plateau State and we decide to play our matches outside Jos,  it means our mission is not accomplished.

    “Giwa FC belongs to the People and government of Plateau State it’s not just about me as a person,” he said.

    Giwa also thanked God Almighty for the victory over 3SC and said his boys are psychologically ready for the final showdown with Nasarawa United FC of Lafia in the last game of the season.

    The Plateau Elephants are currently placed third on the log of the NPFL on 63 points after 37 games.

    10-man Giwa FC of Jos held Ifeanyi ubah FC to a 1-1 draw at the Gabros Stadium, Nnewi in one of the Glo Premier League matches played on Sunday.

    Giwa FC striker David Sunday was the hero as he came on from the bench to get an equaliser in the 88th minute to secure a vital away point for the Jos Elephants. Sunday replaced Charles Okoro.

    Jolly Osas had already put the home side into the lead in the 35th minute through a well converted free kick against the run of play as the visitors were dominant in all departments during the match yesterday.

    Giwa FC, who got a boost with the presence of its owner Ambassador Chris Giwa at the stadium, was unperturbed despite being one man down as Prince Madaki was shown a red card for foul play.

    The result has moved Giwa FC into fifth position in the table on 50 points, while Ifeanyiubah have dropped to 11th.

    The point is a boost to an ambitious Jos-based side whose interim coach, Danladi Bugi has insisted that his side will fight to a successful end to get a continental ticket.

    Former Flying Eagles coach, Manu Garba, has taken over at Nigeria premier league side, Giwa FC.

    The Jos club announced Garba’s appointment via its Twitter handle, disclosing the coach was introduced to the team on Wednesday evening.

    He takes over from Aminu Musa, who quit the club on Wednesday because of family reasons, africanFootball.com reports.

    Garba was also in the reckoning for the top post at champions Kano Pillars and he has previously worked with his hometown club Gombe United.

    Giwa lies fifth on the Nigeria Professional Football League table with 46 points from 29 matches.

    Armed robbers attack Giwa FC

    Armed Robbers on Tuesday attacked players of Giwa FC in Enugu while traveling to honour a Nigeria league Week 21 game against Abia Warriors in Umuahia.

    The team official, Sammy Adesoji, told africanFootball.com that the players, who were in their bus, were attacked and lost mobile phones and cash to the hoodlums.

    “Our players were attacked by armed robbers at 9th mile in Enugu. We thank God no life was lost,” Adesoji told africanFootball.com.
