  • EFCC calls more witnesses in Kalu’s trial

EFCC calls more witnesses in Kalu’s trial

The Economic and Financial Crimes Commission (EFCC) on Monday, called its sixth witness in ongoing trial of former Abia Governor, Orji Uzor Kalu, at a Federal High Court in Lagos.

EFCC had on Oct. 31, 2016, preferred 34 count charges bordering on N3.2 billion alleged fraud against Kalu and his former Commissioner for Finance, Ude Udeogo.

Also charged is a company, Slok Nig. Ltd.

The accused had pleaded not guilty to the charges and were granted bail.

When trial resumed on Monday, the prosecutor, Mr Rotimi Jacobs (SAN), called the witness, Mr Braimoh Yakubu, an Internal Control Officer with Guaranty Trust Bank.

Led in evidence, Yakubu told the court that he had been a Regional Coordinator of the bank since 2005.

He said that his schedule of duty included investigation of fraud and irregularities, listening to customers’ complaints as well as acting as a liaison officer.

Giving his narration on events in 2007, the witness told the court that the EFCC wrote a letter to his bank, requesting for account opening documents of the third accused, Slok.

He said that the account opening documents of Slok were retrieved and forwarded to the commission.

Presented with the documents, the witness identified them as the same sent to the commission by the bank as ordered.

But counsel to Slok, Mr C.C. Nwofor (SAN), raised objection to the admissibility of the document on grounds that it contained some other document not emanating from GT Bank.

According to him, some of the documents sought to be tendered emanated from other banks and so, the witness cannot testify on them since he is not its maker.

Other defence counsels also aligned themselves with Nwofor’s objection.

However, in a bench ruling, Justice Mohammed Idris overruled the objection of the defence counsel and held that such objection only went to the weight to be attached to such document.

Accordingly, the court admitted and marked the documents as exhibits.

Under cross-examination, counsel to Kalu, Mr Awa Kalu (SAN), sought confirmation from the witness that he had been working at GT Bank since 2005 and the witness replied in the affirmative.

To further question by the defence counsel, Yakubu said that he obtained his masters degree between 2008 and 2010.

Justice Idris adjourned until Jan. 23 for continuation of trial.

In the charge, the accused were alleged to have committed the offence between August, 2001 and October, 2005.

Kalu was alleged to have utilised his company to retain in the account of a First Inland Bank, now First City Monument Bank, the sum of N200 million.

The sum is alleged to have formed part of funds illegally derived from the coffers of Abia Government.

In one of the counts, the third accused (Slok Nig. Ltd) and one Emeka Abone, who is said to be at large, were also alleged to have retained in the company’s account the sum of N200 million on behalf of the first accused.

In counts one to 10, the accused were alleged to have retained about N2.5 billion in different accounts, the funds which were said to belong to the state government.

Cumulatively, in all the counts, the accused were alleged to have diverted over N3.2 billion from the Abia Government’s treasury during Kalu’s tenure as governor between 1999 and 2007.

The offence is said to have contravened the provisions of sections 15(6), 16, and 21 of the Money Laundering (Prohibition) Act, 2005.

It is also said to have contravened the provisions of the Money Laundering Act of 1995 as amended by the amendment Act No.9 of 2002 and section 477 of the Criminal Code Act, Laws of the Federation, 1990.

  • Reconcile Ajimobi and Shittu, Kalu, Nnamani, others tell Buhari

Chieftains of the All Progressive Congress (APC) yesterday appealed to President Muhammadu Buhari to reconcile Oyo State Governor Abiola Ajimobi and Minister of Communication, Barrister Adebayo Shittu.

They said the rift between the duo could affect the fortunes of APC in the state.

Led by former Senate President Ken Nnamani; former Abia State Governor Orji Kalu and others, the chieftains said the party must ensure reconciliation to promote peace and progress.

They spoke yesterday at the inauguration of the Muhammadu Buhari/Osinbajo (MBO) Dynamic Support Group Southwest Zonal Office in Ibadan.

Others at the event were Minister of Health, Prof Isaac Adewole; Deputy Chairman Southwest, Chief Pius Akinyelure; Postmaster General of the Federation, Bisi Adegbuyi; National Coordinator, Muhammadu Buhari/Osinbajo Dynamic Support Group, Usman Ibrahim and South West Zonal Coordinator of the organisation, Lateef Olawumi among others.

Leading the call for the unity of the political big wigs in the state, Nnamani noted the party must eschew the politics of bitterness and rivalry but accommodate others for progress.

According to him: “As members of one family, we must try and eschew every form of bitterness and excessive anger because nobody does anything right in anger or bitterness.

“The same thing if you are speaking and you speak with anger, you are likely to say things you will regret later.”

Kalu did not hide his disappointment with the level of disagreement between the governor and minister whom he both described as “two elephants”.

He warned that the fight which resulted in the absence of the governor, his aides and even the state party leadership will only make the “grass suffers”

He promised to take the matter to the highest level along with Nnamani to ensure amicable resolution.

The former governor said: “”I cannot understand why the minister is very close to me and the governor is very close to me. They are also very close to Ken Nnamani. We came here to honour both of them. I am slightly not very happy what I have seen here that the governor is not here, the party officials are not here, the commissioners are not here, and they are the main things that will make APC what it is and they are supposed to be here please, but they are not here.”

Pension payment row: Abia pensioners fault Kalu

Abia State pensioners  have faulted the claim by former Abia State Governor Orji Uzor Kalu that he ver owed pensioners during his tenure as governor between 1999 and 2007.

Kalu spoke last month during his formal reception into the All Progressives Congress (APC) in Umuahia.

But speaking under the aegis of Abia State Civil/Public Service pensioners association, leader of the group, Chief Emmanuel Okparanta advised the former governor not to politicize the issue of pension payment.

He spoke during a meeting with Abia State Commissioner for Information John Okiyi Kalu in Umuahia.

Okparanta said; “We were shocked to hear Dr Kalu tell Nigerians a blatant lie that he never owed salaries and pensions during his tenure, whereas we are aware that most of the issues with Pensions and salaries in Abia State started during his tenure.

“We still have Pension outstanding from 2002 to 2007 and the succeeding administration inherited the payments, paid some and passed on the remaining to the Ikpeazu administration.

“It was also under Kalu’s administration that the local government system in Abia State was bastardised. For instance, Aba North Local Government owed workers more than one year salary even after the local government was sunk into huge bank loans.”

the commissioner appealed for patience from the pensioners to enable the government stabilise internally generated revenue through the introduction of technology that will minimize Revenue leakages and ensure regular payment of salaries and pensions.

He said: “The government of Dr Okezie Ikpeazu is concerned about pension outstanding and we are determined to ensure that the problem is quickly solved to enable our senior citizens enjoy their retirement benefits. Today we have ensured that MDAs that make up more than 70% of our workforce are up to date on salary payments and the next stop is to ensure that pensioners and teachers are also up to date. This government is determined to defeat that challenge of salary and Pension outstanding  the same thoughtful and systematic way it defeated the challenge of Ukwu Mango Ariaria and Aba Road Umuahia”.

Chief Okparanta, praised the governor for keeping his promise of paying at least three months outstanding and urged him to harmonise “old and new pensioners payment in the state”.

Kalu: Star witness on the run, says EFCC

The Economic and Financial Crimes Commission (EFCC) has told a Federal High Court in Lagos that its star witness in the trial of former Abia State Governor Orji Uzor Kalu is evading appearance.

Kalu, Udeh Jones Udeogu and Slok Nigeria Limited were arraigned October 31, 2016 by the EFCC before Justice Mohammed Idris on a 34-count charge of N3.2billion fraud.

    They pleaded not guilty.

At the commencement of proceedings yesterday, EFCC counsel Rotimi Jacob said he could not proceed with trial because his star witness, Mr Mike Udoh, had repeatedly made himself unavailable to give his testimony.

He accused some unknown persons of being behind Udoh’s absence.

He said: “Our main witness that we intended to call, we have approached him for more than six months. We have noticed that each time the matter is coming up, he will just travel to Umuahia or Calabar or Cameroun.

“He was supposed to come today but switched off his phone. EFCC went to his house in Umuahia yesterday and this morning but met his wife who said he travelled to Calabar. Despite all our efforts, we have not been able to bring him.”

He prayed for a short adjournment of about a week to enable the agency round up its case.

Kalu’s counsel, Mr Awa Kalu (SAN), accused the EFCC of a ploy to foist an adjournment on the court.

Justice Idris upheld Jacob’s application for adjournment. He noted that this was the final adjournment it would allow. The case continues on January 22 and 23.

2019: Buhari not interested in automatic ticket, says Kalu

•Declares PDP can never bounce back

Former Abia State Governor Dr Orji Kalu yesterday said President Muhammadu Buhari is not interested in automatic ticket for the 2019 presidential election because he would want other candidates to explore democratic process to test their popularity.

Speaking in an interview at a private wing of the Murtala Muhammed International Airport Lagos, Kalu backed others calling on Buhari to go for primaries ahead of the elections.

He said: “Buhari himself is not even looking for automatic ticket. Buhari is a man that is very fair and free to what he does. And his feeling is that if any candidate is willing to contest against him, he should come at the Eagle Square.”

Supporting calls for primaries, the former governor stressed: “The contest should be thrown open. There would be no rancour. We are in democracy and I would vote for the President.

“I’ve said it times without number that President needs to consolidate on his achievements because the President is very popular.

“He is still the only person carrying 12 million votes in his back. His tenure has been besieged by illness. So the President genuinely deserves second tenure.

“We are not afraid of anybody who wants to contest against the president.”

Reacting to the possibility of PDP returning to power, Kalu stated: “How can they bounce back when treasury was looted? How can they bounce back when the international community doesn’t see anything good in them?

“How can they bounce back when we gave them our treasury, they opened and looted it.

“We would call names if they want us to call names in future. All the world powers knew what happened and this is why they tactically insisted that PDP must leave power.

“PDP committed what was very shameful to be seen in a democratic process. There is no system that is without corruption but going to loot is an affront to Nigerian people.”

He was however reluctant to comment on the resignation of the former Vice President Atiku Abubakar from the ruling All Progressive Congress (APC), saying, if he had the opportunity of advising him, he would have asked him to remain to rebuild the APC.

According to him: “To be honest with you, Atiku was my boss and he is still my boss. I hardly don’t want to discuss Atiku Abubakar. You know he is very close to me.

“The question you are asking me is a lot of task but I wish him well. If I was to advise him before he leaves, I would say, ‘don’t leave. Let us build a large team together.’

“If he wants to contest against the President, it would be open at the Eagle Square. If he wins, we would support him.”

  • Kalu under fire over Kanu’s whereabouts

Kalu under fire over Kanu’s whereabouts

Former Abia State Governor Orji Uzor Kalu was under attack yesterday for his revelation of Indigenous People of Biafra (IPOB) leader Nnamdi Kanu’s whereabouts.

Kanu has not been seen or heard from since last month’s  fracas between his supporters and troops near his Afaraukwu home in Umuahia, the Abia State capital. His lawyers have urged the High Court in Abuja to compel the military to produce him, “having taken him away when they invaded his house”. But the military has since denied taking Kanu away.

The ex-governor, in an interview published yesterday by a national daily, said Kanu had bolted away to London.

Kalu said: “Kanu was not taken away by the military. Kanu went to Malaysia from where he travelled to the United Kingdom. Nnamdi Kanu is in London right now as we speak. He was not arrested by anybody. He left the country on his own.”

The ex-governor said one of Kanu’s relations told him the whereabouts of the separatist leader whose counsel Ifeanyi Ejiofor wondered how Kalu could be authoritative about his client’s whereabouts when he did not claim to be present on “the day soldiers invaded Kanu’s abode”.

The lawyer, who referred to the processes he filed in relation to a suit, seeking to compel Chief of Army Staff Lt.-Gen. Tukur Buratai to produce his client in court, said he stood by the claim in the suit that the army should account for Kanu’s whereabouts.

Ejiofor and others in the suit claimed that Kanu, who was in his house during the September 14 attack on his premises by some soldiers, “has not been heard from or seen after this bloody attack in his home by the agents of the respondent (COAS) since the 14th day of September 2017”.

In a statement sent through an electronic mail yesterday, Ejiofor said: “ Kalu saw Kanu’s travails as an opportunity for relevance.

“What do you expect from a man who is enjoying a temporary freedom? Struggling to get his head out of grievous corruption charge hanging on his neck?

“He is seeking for possible relevance where none exists, opportunity to divert attention.  May be he has forgotten he is no longer the governor of Abia State.

“I advise the discerning mind to kindly disregard his tantrums as that coming from a drowning man.

“The military should produce my client wherever they kept him. The matter is now in court, let’s meet in court.

“Orji Uzo Kalu can as well apply to be joined as a party in the suit. Let his position be on oath.”

The banned separatist group, in a statement by its spokesman Emma Powerful, said: “IPOB through her lawyers will compel Orji Uzor Kalu to appear in court alongside (Gen. Tukur) Buratai on the October 17, 2017 to tell the world, under oath, what he claims to know about the whereabouts of Mazi Nnamdi Kanu.

“His laughable assertion that the IPOB leader is in London is a confirmation that all along he has been working in tandem with Governor Okezie Ikpeazu, Willie Obiano, Rochas Okprocha and others to slaughter as many IPOB family members as possible in order to please the core North.

”Our leader Mazi Nnamdi Kanu before his abduction by the Nigerian Army has brought an end to the era of cash-and-carry politics of subservience to Hausa/Fulani to the detriment of Biafra.

”We have formally instructed our attorneys to add the name of Orji Uzor Kalu as one of those who might help in locating our leader. He should be prepared to present his evidence in a court of law and be cross examined under oath. The surviving members of Kanu family have all denied ever talking to Orji Uzor Kalu about the whereabouts of our leader.”
