MTN sacked me for reporting ‘fraud’ to EFCC, ex-manager tells court

A former General Manager for Internal Audit at MTN Nigeria Communications Limited, Thuli Mashanda, has told the National Industrial Court of Nigeria that the company sacked her because she reported an alleged act of fraud to the Economic and Financial Crimes Commission (EFCC).

Testifying for a former Network Group Operations Manager, Mr Paul Odunewu, who sued MTN, Mashanda said her employers were not happy when she made a report to the anti-graft agency.

Odunewu accused the company of withholding his entitlements, including a long-term incentive scheme (share option) worth over $13.14 million (about N2.1 billion). He is also demanding N100 million damages, among others.

The embattled manager said despite being responsible for MTN’s initial growth in Nigeria – having been persuaded to return home from the United Kingdom (UK) to develop telecommunication in Nigeria – he became a victim of racism in the company and his contract subsequently terminated.

“I built the engine of the defendant’s business in Nigeria, including people and process technology,” Odunewu said.

Corroborating Odunewu’s testimony that some MTN’s workers were allegedly victimised, Mashanda, a South African, said she was improperly queried for doing what she thought was right, and was eventually fired.

She said: “The query was improper because I reported fraud to the EFCC when they stole money. MTN did not want that to happen because the whites were transferring money illegally out of MTN Nigeria abroad. Hence, they terminated my employment.”

Mashanda said she became a victim of her professionalism, adding: “I don’t recall that I parted in good terms with the company because I was doing the work that I was paid to do.”.

Defendants in the suit are: MTN Group Limited, South Africa; MTN Nigeria and MTN International, Mauritius.

Odunewu said prior to the “malicious” termination of his appointment, his impeccable record and achievements at MTN came under serious attacks in 2006 from “a group of white South African racists posted to Nigeria to oversee Network Group Management”.

He said a particular white South African expatriate was “perturbed and astonished by the wealth of experience displayed by the claimant and set out on a collision course with him”.

Matters got to a head when Odunewu said he received a letter, dated February 28, 2006, purportedly terminating his appointment. His access to MTN network was revoked.

  • ‘Why MTN launched mobile health insurance’

MTN veered into providing mobile health insurance because it believes in a healthy society, its Chief Executive Officer, Michael Ikpoki has said.

He spoke when the telco signed a deal with the National Health Insurance Scheme (NHIS) and the nation and the aggregator, Salt and Einstein.

He said health is wealth and a healthy citizenry will remain invaluable asset to the productive sector of the economy.

He said:  “At MTN, we believe that health insurance contributes to removing the financial barriers to healthcare, thereby giving people unrestricted access to good health care without having to pay out-of-pocket. More than bringing flexibility and ease to paying for health care service, health insurance is also a means of providing greater access to healthcare for larger segments of a population. Indeed we believe health insurance is imperative for closing the gap between the availability of health care service and the ability of the citizenry to access it.”

Described as The MTN Y’ello health cover, he said it is an all-inclusive mobile health insurance scheme, which will give all Nigerians the opportunity to  access good, affordable and quality healthcare service wherever, whenever the need arises. The scheme will allow subscribers to gain access to pre-defined treatments and also freedom to choose their own Health Maintenance organisation (HMO), and healthcare provider from over 6000 registered partners across Nigeria.

Under the scheme, subscribers will have access to unlimited number of visits to the hospital with at a weekly deduction of   N250 only.

NHIS Executive Secretary, Dr. Femi Thomas said: “This new service will provide Nigerians affordable health insurance cover on a pre-paid basis.

“Through the Y’ello Health, mobile subscribers are able to opt into a micro healthcare insurance scheme through Health Management Organisations (HMO’s), using their mobile phones for a range of pre-defined medical treatments for which affordable premium can also be remitted through the subscribers’ mobile phone.

The MTN Y’ello is one of the many ways Africa’s leading telecommunications network is adding value to the lives of it subscribers. The next leg of the launch will take place in Abuja at a yet-to-be-announced date.

  • How MTN withheld my entitlements, by ex-manager

How MTN withheld my entitlements, by ex-manager

A former Network Group Operations Manager at MTN Nigeria Communications Limited, Mr Paul Odunewu, has accused the company of withholding his entitlements, including a share option worth over $13.14 million (about N2.1 billion)

He sued MTN at the National Industrial Court of Nigeria (NICN) sitting in Lagos and demanded N100 million in general damages for alleged wrongful termination of his contract.

Odunewu said he worked at MTN for over four years, and was responsible for the network’s outstanding achievements, which continues till date.

The former manager said he was responsible for the company’s pre-paid and post-paid revenue, subscription, voucher management and real-time charging.

He said: “I built the engine of the defendant’s business in Nigeria including people, process and technology.”

Odunewu added that MTN made over N5.15 trillion in revenue as at December 2013.

Testifying before Justice Oyejoju Oyewumi, the claimant said MTN pleaded with him to return home from the United Kingdom and help the company to develop its telecommunications in Nigeria.

According to him, he was promised, among others, a Share Option, a long-term incentive scheme being developed by MTN.

Odunewu said when he complained that the Share Option was not contained in his offer letter, MTN persuaded him to accept the job, adding that he would be entitled to the shares after three years.

“In November 2001, the defendant sent the contract to me. I saw it and discovered the Share Option was not included, hence I wrote the CTO about my observation.

“This is my complaint before this court, that the defendant in 2001, before I joined them, made a representation to me that my role included a Share Option. I believe same.

“I acted on contract. I joined the company. I worked with all my energy for the defendant for over three years. So, I’m asking the court to stop the defendant from denying my entitlements to the Share Option,” he said.

MTN Group Limited, South Africa; MTN Nigeria and MTN International, Mauritius are other defendants in the suit.

Odunewu said his position came under attack when a group of white South Africans was posted to oversee Network Group management in 2005.

He said there was an “onslaught” against him when his superiors suddenly became “disturbed that a Nigerian could possess such incredible experience and exposure…”

The former manager said matters got to a head when he received a letter, dated February 28, 2006, purportedly terminating his appointment and his access to the MTN network as a worker was revoked.

Odunewu claimed that the contract termination contradicted the clauses in his agreement with MTN.

The plaintiff averred that he never committed any serious or persistent breach of the provisions of the agreement or the company’s code, adding that he was never summoned to a disciplinary committee or found guilty of any misconduct or non-performance.

But the defendants denied Odunewu’s claims. MTN said the former manager’s contract was of limited to the duration and was due to terminate on December 12, 2003.

MTN said: “The letter of offer of employment with the second defendant expressly warned against any expectation of continued employment, nor was it ever at any time suggested to the claimant that he was to be made or had been made a permanent employee of the second defendant or any of the defendants.

“In the circumstances, claimant knew and expected, or ought to have known and expected that his employment was not a long-term or permanent appointment, and that the same was also liable to be determined within 60 days of the receipt of written notice.

“The defendants say that the claimant’s claim is speculative and gold-digging, that he is not entitled to the reliefs claimed or at all and that the claim herein should be dismissed with substantial costs

    in favour of the defendants.”

MTN, others partner NHIS on health insurance

MTN Nigeria has partnered Salt & Einstein MTS and the National Health Insurance Scheme (NIHS) to drive the penetration of insurance in the country through the mobile platform.

Speaking yesterday at the flag-off of the pilot programme of the initiative, Chief executive Officer, MTN, Michael Ikpoki said the tripartite partnership is the first in the country, Africa and indeed, the world as it has not been done anywhere.

He said the broader vision of the telco is lead a bold digital world and touch the lives of its numerous subscribers, adding that pursuing this lofty goal requires the innovation and coming up with unique products.

He said the partnership was necessitated by the need to bridge the identified gap existing in affordable, accessible and cost-efficient insurance scheme in the country which would be attractive to many people.

According to Ikpoki, with the payment of the premium of between N250 and N1000 per week, the subscriber is covered with insurance of about 80 per cent, stressing that in the event of an illness, all the insured needed to do was visit any of the health management organizations (HMOs) across the country.

Executive Secretary/CEO, NHIS, Dr Femi Thomas said the step marks the beginning of the digitalization of health in the country, adding that the development will help drive Federal Government’s desire to deepen insurance penetration in the country.

He lamented that formal sector insurance stands at 3.5million people up from 2.3million it used to be in January this year while informal sector insurance figure stood at 1.5million, adding that the partnership will leapfrog health delivery and accelerate penetration.
