  • Oyetola cautions children against drug abuse

Governor Adegboyega Oyetola of Osun State has urged the youths, particularly children, to shun drug abuse and imbibe the spirit of godliness and good moral standards.

Oyetola made the plea during the celebration of the 2019 Children’s Day on Monday at Osogbo City Stadium.

The governor also appealed to parents to reflect in the upbringing of their children the ‘Omoluabi ethos’ cardinal to the Yoruba.

Oyetola, who was represented by Mr Wole Oyebamiji, the Secretary to the State Government, implored the children to prioritise their education and treasure their future above all other things.

The governor said the theme of the celebration, “Drug Abuse among Children: Addressing the Challenges,” was timely and apt.

According to him, all hands must be on deck to build a sane society in view of the damning statistics and reports on drug abuse among children.

“May I seize this opportunity to warn our children against hard drugs intake.

“Drugs are destroyers of health and killers of dreams to become what one desires to become in life.

“We are doing our best as an administration to give our children all-round education and the good life.

“I appeal to parents to reciprocate this gesture by bringing up their children and wards in the fear of God and engraining in them good upbringing and high moral standard.

“It is imperative to use this medium to educate and charge our children and all relevant stakeholders in the state on the menace of drug abuse which is bedeviling our society, and which is taking its toll on the welfare of a large population of children and youths within our society.

“The hydra-headed challenge of drug abuse by the youth is becoming highly worrisome.

“The devastating effect and threat of drug abuse to humanity cannot be over emphasised as it takes its toll on the physical, mental, emotional, physiological and social status of the user.

“Many reasons have been advanced for the abuse of drugs by our youths, they include escapism, peer influence, lack of parental care, unemployment, effect of the social media and internet exposure.

“The consequences of drug abuse are grave, we cannot pretend that all is well, so all hands must be on deck to tame the monster because we are gradually losing our youths and our future to drug abuse.

“Everyone must be vigilant and there is a need for massive sensitization and education against drug abuse at all levels for optimum effect, “Oyetola said.

  • Crime prevention: Osun to register miners, says Oyetola

Osun state government will register all miners operating in the state, Governor Adegboyega Oyetola said on Tuesday.

Besides, serious steps are to be taken to prevent security lapses linked to some of the criminals who are operating as illegal miners in the state.

These are the highlights of an Ife-Ijesa zonal security sensitization meeting held on Tuesday in Ilesa. The zone is where the vast gold deposit in the state is located.

Apart from the governor, Deputy Governor Benedict Alabi, Wife of the Governor Mrs Kafayat Oyetola, others top government functionaries, traditional rulers led by Ooni of Ife, Oba Adeyeye Ogunwusi, and Owa Obokun of Ijesaland, Oba Adekunle Aromolaran, heads of security agencies in the state, leadership of artisanal miners and community leaders attended the meeting, which sought people’s cooperation in the fight against illegal mining, kidnapping, banditry and other vices now rearing their ugly heads in the state.

They appealed to residents to report any strange development in their domains for appropriate legal actions.

Governor Oyetola said: “The activities of illegal mining vendors, if not checked, will shatter the safety, security and peace of our people as they are capable of engaging in untoward behaviours.

“Already, there is an upsurge in criminal activities in this area.

“We have of recent been battling with kidnaping, harassment of people, and indiscriminate shootings on the highway, all traceable to the nefarious activities of some of these illegal miners.

“Should these high level crimes continue, government will be forced to take a drastic action, which will include but not limited to a total ban on mining activities in this state.

“To prevent the hammer from falling, all hands must be on deck to avoid criminality.

“So, all miners operating in this state must be registered to enable the government keep a record.

“Community leaders (the Serikis) must play a key role in ensuring that this directive on registration is faithfully carried out.

“Thereafter, Serikis will be held accountable for acts of crime committed by miners in their area of operation.

“Ensuring that these crimes do not happen requires your collective support and cooperation and those of our people with the government”.

Heads of security agencies – the police, the army, the DSS, Immigration, the prisons, Road Safety, Civil Defence and the NDLEA – reaffirmed their commitment to securing the state and preventing the influx of criminals posing as miners.

Leaders of the gold mining union also sought for government support to enable them prevent crimes.

A Community leader, Prof. Olu Odeyemi, warned of dire consequences unless drastic measures were taken to stop the rising level of insecurity.

Oba Ogunwusi and Oba Aromolaran urged the government to empower traditional rulers who know their domain and are in a better position to assist in securing their areas

They called for synergy between the government, people and the security agents as part of efforts to strengthen security and stamp out all forms of criminality in the State.

Governor Oyetola described the security stakeholders’ meeting as sacrosanct, in view of the huge mineral deposits in the zone.

The Governor said the elaborate plans the state has for artisanal miners will create wealth and improve the prosperity of the people.

He called on community leaders to support the government in its efforts at ensuring proper registration and data capturing of all miners operating in the state.

Oyetola urged community heads to sanitize their domains by ensuring that criminals do not live in their communities.

He warned landlords and landowners to always be vigilant to ensure that houses are not rented to criminals saying they will be liable in a situation where such tenants commit crime and are traced to where they live.

Deputy Chief of Staff to the Governor, Mr. Abdullah Adeyanju Binuyo, who set the tone for the meeting, said Osun state would partner with development partners and the Federal Government, which has picked the state and Kebbi state as pilot of its gold extraction programme, to boost mining and get the benefits for the state and the people.

Oyetola described the meeting, a second one on insecurity in one month as “a testament to the importance this administration places on the safety and security of our people, adding:  “It is our policy to adopt a creative and proactive approach to security and to respond with dispatch when security breaches occur.”

  • Aregbesola, Yayi hail Lagos APC chieftain Enilolobo

Immediate past governor of Osun State, Rauf Aregbesola, and the the lawmaker representing Lagos West Senatorial District in the Green Chamber Senator,  Solomon Olamilekan Adeola,  have eulogised the virtues  of  Abdulahi Ayinde Enilolobo, a chieftain of the All Progressives Congress (APC) in Lagos.

Speaking at  a symposium to celebrate the party chieftain’s Golden jubilee, the duo, described Enilolobo as a humble,  dedicated and honest family and  party man.

Senator Yayi said: ” Hon Enilolobo means everything to me. He is a political juganut in the setting of Lagos, he is a seasoned administrator who is blessed with a loving mother.

“He has contributed immensely to the success of the party especially in Alimosho. If he wanted any political office, he would get it but he prefers to remain a party man. He has touched many lives and would satisfy others before himself. He has always  been there for everyone of us.”

Expressing concern about the relationship between the country’s growing population and the lean  revenue accruing to the nation,  Aregbesola said: “We dont remember that we are poor here in Nigeria. If we have a deep thought, we ought to have a day of weeping every month.

“If we don’t work harder to improve our fortunes, we would continue to be poor. In 2017, Brazil had a population of  approximately 200 million people almost about what Nigeria had. That year, Brazil had a revenue of about $600  billion and a budget of $700 billion.  Nigeria in that same year made $13 billion  and a budget of $23 billion. Are the two countries equal?

“Today, OPEC allowed Nigeria to extract and sell 2million barrel of crude oil per day but we don’t get that quantity. Even if we get 2million barrel per day and if the price rises to $100 per barrel, it means our income will be $200 million.

” If you divide this by 200 million people, it amounts to  $1 per every Nigerian.   We have to check our population by practicing birth control. If we don’t address this, we would have huge problems to deal with. We would also need every able bodied person to work.”

  • Osun gov dispute: Appeal Court delivers judgment Thursday

The Court of Appeal in Abuja will on Thursday deliver judgments in three appeals and a cross-appeal filed against the majority judgment given in March 22, 2019 by the Osun State Governorship Election Tribunal.

The court made this known in the hearing notices it sent to parties, a copy of which The Nation sighted in Abuja on Wednesday.

The tribunal had, in the majority judgment, given by two of its three members, upheld the petition  by the People’s Democratic Party (PDP) and its candidate in the governorship election held in the state on September 22 and 27, 2018 Senator Ademola Adeleke.

The tribunal’s majority judgment reversed the victory of the All Progressives Congress (APC) and its candidate, Adegboyega Oyetola and declared the PDP and Adeleke winners.

Oyetola, APC and the Independent National Electoral Commission (INEC) filed substantive appeals, seeking the setting aside of the majority decision, Adeleke filed across-appeal, challenging a portion of the decision.

At the hearing of the appeals on April 24, Oyetola, the APC and INEC prayed the five-man panel of the Court of Appeal, led by Justice Jummai Sankey, to set aside the majority decision of the tribunal, uphold their appeals and dismiss the October 16, 2018 petition by Adeleke and the PDP.

They equally urged the court to dismiss the cross-appeal filed by Adeleke, on the grounds that it is unmeritorious.

Wole Olanipekun (SAN), who argued the appeal by Oyetola, faulted the reasons given by the tribunal in reaching the judgment appealed against, arguing that the decision was not supported by the evidence led by the petitioners.

He urged the court to void the judgment because the judge, Justice Peter Obiorah who wrote and delivered it, did not participate in all the proceedings of the tribunal.

Olanipekun noted that “the judge, who did not sit, came to write the leading judgment and reviewed the evidence of the February 6, 2019 proceedings where he was absent.

“Adjudication is like video watching. It cannot be done by proxy. The judge cannot analyse the evidence of a witness, whose demeanour he did not observe. The judgement should be declared a nullity on this ground alone”

Olanipekun, who said he and some named senior lawyers were at the tribunal on February 6, 2019, faulted the argument by lawyer to Adeleke and the PDP that it was not clear from the record of proceedings, whether or not Justice Obiorah was absent on the particular day.

Read Also: Court remands two persons over armed robbery in Osun

He argued that the judge’s failure to sigh at the end of the proceedings on February 6, 2019 was enough evidence to justify the appellant’s claim that Justice Obiorah was absent on the day in question.

Olanipekun also faulted the tribunal’s cancellation of results in 17 polling units in the state, and noted that the petitioners did not tender any result of the election before the tribunal.

“If there was no result before the tribunal, the tribunal could not have cancelled what was not before it. Since no single result was submitted and could not have been cancelled,” he said.

He argued that the tribunal went beyond its powers by annulling  results in the 17 polling units in order to justify its the judgement it gave in favour of the petitioners.

Lawyer to the APC, Akin Olujinmi (SAN), while arguing the party’s appeal, contended that the tribunal was wrong to have allowed the petition, which was incurably incompetent.

“The 1st and 2nd respondents sought to be declared winner of the election, held on September 22, 2018, which was declared inconclusive. They also asked the tribunal to void the rerun election held on September 27, 2018, because they believed it was unlawful.

“You cannot say you should be declared a winner on the election that you said was unlawful and void,” he said.

Olujinmi accused the tribunal of exceeding its jurisdiction when it engaged in amending the petitioners’ reliefs to make them grantable.

“No tribunal has the jurisdiction to reframe, amend  or formulate reliefs for the petitioners.

“On realising that the reliefs could not be granted, they (members of the tribunal) amended the reliefs and granted it by themselves.

“We are saying the tribunal has no power to amend a petitioner’s reliefs. The much they ought to do, on realising that the reliefs could not be granted, was to have dismissed the petition.”

He further faulted the tribunal for holding that the petitioners proved its case of non-compliance in respect of the polling units where it voided results.

Olujinmi added: “The tribunal was wrong. They cannot use the allegation of non-compliance directed at the election of September 27 against the election of September 22.

“The tribunal relied on certified true copy of Form EC8A, which they said were dumped on the tribunal. This was what they still relied on to nullify results in the polling units in which they said malpractices were proved. The so called non-complaince did not affect the result of the election,” Olujinmi said.

He argued that the tribunal went outside its powers and contravened Section 140(2) of the Electoral Act when it  engaged in the deduction of votes from the outcome of the election to arrive at the decision it gave.

Lawyer to INEC, Yusuf Ali (SAN) who argued in similar manner, contended that the tribunal erred in its majority judgment, particularly as regards the issue of non-compliance.

He noted that the tribunal, having found that accreditation was properly done and that all witnesses agreed that the votes scored were not affected by the omissions noted in some result sheets, ought not to have voided any results.

Citing Section 134 (b) of the Electoral Act, Ali argued that  non-compliance means not compliance with the provision of the Act, not an act of omission on the part of INEC officials,  which are not contrary to the provision of the Act.

Ali also argued that since the tribunal held that the petitioners did not prove over-voting and non-compliance, it ought not to have turned around to void votes in some polling units.

On the question of why INEC did not call it witnesses at the tribunal, Ali said it was unnecessary because the petitioners did not not discharge the burden of prove placed on them by the law to warrant INEC to call fresh witnesses.

Ali added: “There is no law that said INEC most call witnesses, since the petitioners could not discharge the responsibility of proving their declarative reliefs, there was no need for INEC to have called its own witnesses.”

Lawyer to Adeleke and the PDP, Onyechi Ikpeazu (SAN) faulted the three appeals and the arguments proffered by Olanipekun, Olujinmi and Ali.

Ikpeazu argued that the tribunal was right in its decision to have declared Adeleke and his party as the winner of the election.

He faulted the argument that Justice Obiorah did not participate in all the proceedings of the tribunal, arguing that there was no sufficient evidence to that effect.

Ikpeazu urged the court to dismiss the three appeals and uphold the judgment of the tribunal.

Kehinde Ogunwumiju (SAN), who argued Adeleke’s cross-appeal, urged the court to allow his client’s appeal and reverse the portion of the judgment, where the tribunal rejected the evidence the petitioners lead in relation to six polling units.

Ogunwumiju argued that the tribunal wrongly excluded some of its evidence, because while it called 23 witnesses to prove it’s allegation of non-compliance in 23 polling units, the tribunal only upheld 17 where it voided elections.

Olanipekun, Olujinmi and Ali argued that the cross appeal was incompetent on several grounds and urged the tribunal to reject it.

At the conclusion of proceedings that lasted over eight hours, the presiding judge, Justice Sankey said judgments would be reserved till a later date.

She told parties that the date of the judgment would be communicated to them by the court’s Registry.

Other members of the court’s five-man panel are: Justices Abubakar Datti Yahaya, Ita George Mbaba, Isaiah Olufemi Akeju and Bitrus Sanga.

  • South West support for Buhari, wise, progressive – Group

An Osun State-based social group, Ifesowapo Kajose Society, has saluted the South West geo-political zone for supporting President Muhammadu Buhari, and his vice, Prof. Yemi Osinbajo, to return to power.

The group described the resolve of the South West to work with other zones to actualize second term in office for Buhari and Osinbajo, as wise and progressive.

In a statement by its President, Mr. Samuel Jegede, the group said when it is time for South West to provide national leadership for the country the zone will count on other zones for support and to return the goodwill it has established over the years.

According to him, the six states, Lagos, Ogun, Oyo, Osun Ondo and Ekiti that make up the South West have the resources to lead Nigeria.

However, he cautioned Ogun State out of the six states in the South West to step aside when it is time for the zone to produce the nation’s leader because “it has benefited more than the rest in the past and therefore, as a matter of equity and equality only Lagos, Oyo, Osun, Ondo and Ekiti States must have a shot at the presidency.”

Congratulating Buhari for returning to power in the second term, Jegede advised that he must not allow himself to be distracted from focusing on the myriads of challenges facing Nigeria, including insecurity, economy, energy among others and must proffer solutions to them without further delay.

He commended the All Progressives Congress for providing exemplary government and good governance in Osun, Ekiti and Lagos States.
