Oyo CJ rejects monarch’s application to transfer case

Oyo Chief Judge, Justice Iyabo Yerima, has rejected application of the Oloko of Oko in Ogbomoso area, Oba Solomon Akinola, who is standing trial with 14 others in a case of attempted murder and land grabbing.

The monarch and 14 other defendants had filed an application seeking transfer of the case from the State High Court, Ibadan to the State High Court in Ogbomosho, where most of the trial took place.

According to Justice K.A Adedokun of the State High Court Ibadan, the CJ turned down the monarch’s application to transfer to High Court in Ogbomoso to start afresh after the prosecution has closed their case.

The judge further said that he would not be able to deliver the earlier scheduled ruling on the no case submission filed by the defendants because the new defense counsel had written the Oyo Chief Judge to stop him from further adjudicating on the case.

He said that the previous counsel handling the case, Mr M.O. Folorunsho had withdrawn because he had been appointed as a Judge in Kwara State.

Justice Adedokun said that the new defense counsel that took over the matter wanted the case to start afresh.

According to the judge, the new defense counsel also wanted the case to be transferred back to Ogbomoso State High Court where most of the trials took place.

“However, the Chief Judge refused to grant their prayers and insisted that I should continue handling the matter.

“The Chief Judge also said that it would be unfair and unjust to start the case afresh because all the rigorous time and resources expended by the prosecution on the trials would be a waste and that some of the witnesses have even died.

“I received the letter directing me to continue handling the case just yesterday,”the judge said.

Adedokun fixed March 19 as new date for ruling on the no case submission filed by defendants.

The other 14 defendants standing trial with Akinola include: Chief Sunday Aderinto, Chief Jimoh Asimiyu, Timothy Aderinto, Matthew Akintaro, Rafiu Ganiu and Adejare Adeleru.

Other defendants are. Samson Ogunmola Zacheaus Adeleru, Kamorudeen Ajibade, Raji Rasaq, Mutiu Arowosaye, Oyeyemi Oyelekan Olusegun Oyelekan and Sheriff Adio.

The defendants had pleaded not guilty to a 29-count charge bordering on alleged attempted murder, assault, robbery, stealing and land grabbing.

Protesting Oyo royal family welcomes new Alaafin, seeks implementation of 1976 declaration.

The Abidekun Iteade family, one of the nine protesting royal families in Oyo, has changed stance by welcoming the new Alaafin Oba Akeem Abimbola Owoade

The family is one of the nine royal families protesting exclusion from ascending the throne of their forefather, Alaafin Abiodun Atiba.

The nine families, a.k.a The Atiba 9, had approached the court to seek inclusion in the selection process for a new Alaafin of Oyo.

They asked the court to direct the Oyo State Government to implement the 1976 Oyo State government’s gazette, which recognizes other ruling houses being children of Alaafin Abiodun Atiba, thereby qualifying them to mount the throne.

They also requested that the Governor considers their plea to present a sole candidate from the nine ruling houses as a compensation for their historical exclusion from the Alaafin stool, which has been enjoyed by their fellow brothers – Agunloye and Alowolodu ruling houses that have been producing the Alaafin after the demise of Abiodun Atiba

The nine royal families which have been recognised by the Oyo State Government are Adeitan, Adediran Ese Apata, Adesiyan, Iteade Abidekun, Olanite, Adelabu Baba Ibadan,  Adesokan Baba Idode, Tella Okiti Papa and Tella Agbojulogun.

In a statement on Monday, the matriarch of the Abidekun Iteade royal family, Alhaja Feyisikeade Titilayo Tijani, welcomed Oba Owoade and praised Governor Seyi Makinde for approving a candidate outside the Ladigbolu and Gbadegesin families of the Agunloye ruling house.

Oba Owoade hails from the Lawani Agogo-Ija branch of the Adelu Agunloye Ruling House that has previously ruled three times.

The Lawani Agogo-Ija branch is one of the 29 eligible branches within the Adelu Agunloye Royal House.

But she described Owoade’s selection as another step in serving justice to other ruling houses of Abiodun Atiba descent who have been excluded from mounting the throne of their forefather,  Alaafin Abiodun Atiba.

The matriarch called on the Governor not to relent in pursuing justice and equity to all parties in the Alaafinate controversy just as she urged Oba Owoade to review the Alaafin chieftaincy declaration to accommodate the Atiba 9 in line with the Oyo State decision of year 2000. She prayed for Oba Owoade’s successful reign on the throne and urged him to make the development of Oyo his topmost priority.

Tijani emphasized that the gazette was based on the 1976 declaration authorising same. She urged Governor Makinde to use the same courage to implement the declaration without further delay.
