  • Court urged to halt demotion of policemen

The High Court of the Federal Capital Territory (FCT) has been urged to halt an exercise by the Police Service Commission (PSC) to demote some police officers recently promoted for “gallantry and superlative performances.”

The request if contained in a fundamental rights enforcement suit the incorporated Trustees of the Initiative Against Human Rights Abuse and Torture.

It is the plaintiff’s contention that the nation’s extant laws prohibit punishment being applied for an offence which was not in existence as at the time of its commission, just as no policy or law can be applied in retrospect.

The suit filed on Tuesday has the Inspector General of Police (IGP) and the PSC as defendants.

The group’s Field Coordinator, Chukwuma Unamka stated, in a supporting affidavit, that the affected policemen, promoted between 2015 to date, contacted the plaintiff organisation and expressed their fears of impending demotion exercise.

He added:”They were among the officers of the Nigerian police force promoted from 2015 to date under the special promotion practice of the Nigerian police force

“Before their promotion, many other officers of the Nigerian Police Force from 1999 to 2015 had benefited from the practice and till date none of them had been demoted for that reason.

“The police force has a promotion procedure, but the said procedure for many years allowed for an exception wherefore instead of waiting for 3 years and attendances of course for promotions, officers who had distinguished work either as aides or rescue teams who had performed very well, were promoted.

“There was also a practical exception, where officers who had waited for so long before their last promotion but who are seen to deserve more were promoted to be at par with their contemporaries.

“This practice had been on, until recently when the 2nd respondent reviewed same and condemned the practice in their press release dated 14th September, 2018 stated that such practice should never occur again and called on the 1st respondent to ensure so.

“They have received on good information that there is a move to demote them to their previous ranks on the orders of the 2nd respondent and that it should affect only officers promoted from 2015 to date.

“If nothing is done swiftly to stop this, it would lead to a breach of their rights to freedom from discrimination and it will be most unjust.

“The new policy to trash the practice of special promotion should be a new one as it is and not meant to demote any officer promoted at the time it was not in operation or in force.

“It will be discriminatory to demote the 2015 to date category and leave others who have benefited from the same practice.”

The plaintiff wants the court to make an order directing the respondents to cease action on the demotion of any of the officers, as any action so taken will amount to a breach of Section 42 and 36 (8) of the Constitution.

It also seeks an order enforcing the fundamental right of the applicant to freedom from discrimination and fair hearing and right not to be punished for an act which at the time it was committed was a matter of practice’’.

The plaintiff also seeks a declaration that the practice of special promotions within the Nigerian Police Force, which led to the promotion of police officers from 2015 date, is proper and legitimate and any attempt to demote any of the officers so promoted in line with the recent press release of the 1st and 2nd  respondents dated 14th September, 2018, would amount to breach of  the affected officers’ rights to freedom from discrimination and right not to be punished for an act which  was not an offence in practice at the time it was done as provided in sections 42 and 36 (8) of the Constitution.

  • Group to Gwandu: Obey PSC posting out of Edo

Group to Gwandu: Obey PSC posting out of Edo

…Storms Police HQ, National Assembly in protest

Indigenes of Edo State under an umbrella group called Concerned Citizens of Edo State, have demanded that the State’s Commissioner of Police, Mr Haliru Gwandu, should immediately comply with his redeployment by the Police Service Commission (PSC), noting that his continued stay and ‘gross incompetence’ has given criminals freedom to cause mayhem.

The group, which led protests from Edo House to the Louis Edet House and the National Assembly complex in Abuja, on Monday, decried the insistence of the commissioner of Police in Edo State, Mr Gwandu, to hold on to his office after being posted out of the command about three months ago. They called on the presidency, the Inspector General of Police, Ibrahim Idris, and the National Assembly, to prevail on the matter, and see to it that the PSC posting is obeyed to the latter.

In a letter addressed to leaders of the National Assembly and the Presidency signed by its coordinator, Hon. Henry Okpamen, the group said, “We, the concerned citizens of Edo State, are gathered here today to share our pains with Mr President, the President of Senate and the Speaker of the Federal House of Representatives and all their members on the worsening security situation in our State.  While Mr Governor and his Cabinet, with cooperation from the revered Benin Monarch, Oba Ewuare II, are working round the clock to encourage investments into Edo State, the Inspector General of Police has refused to support the government of Edo State in this effort.”

They said that the centrality of Edo State has made it vulnerable to people from different parts of the country, who come in with sundry interests, noting that Okada, Okpella, Ekenwan, Auchi-Ekpoma-Benin axis of the state are flashpoints of crime, which call for responsive and intelligent policing.

The group noted that it was surprising that Mr Gwandu was redeployed from the state about three months ago by the PSC, but he has since colluded with the IGP and other elements at the presidency to frustrate the enforcement of the directive. They stated that the posting, which was contained in a release by the PSC on July 5, 2017, has left many in Edo confused because, though one Mr Johnson Babatunde Kokumo was announced Edo State Commissioner of Police, Mr Haliru Gwandu and his minions still hold sway in the state.

They said that while previous Police Commissioners posted to the state worked assiduously to check criminal activities in well-known security flashpoints, the present Commissioner, Mr Gwandu applied a “lethargic and a rather nonchalant attitude” to his job.

According to the group, “the incompetence of Mr Gwandu came to the fore in March 2017, when a former Council Chairman of Etsako East, Hon. Suleiman Malik Afegbua and some other persons were kidnapped by suspected herdsmen along the Benin-Ehor road.  Hon. Afegbua was later killed by the kidnappers.

“Strangely, while the family was still negotiating the release of the other persons that were kidnapped along with him, Mr Haliru Gwandu announced gleefully to the whole world that the kidnappers had been arrested by his men, which was not true. This breach of trust demonstrates that Mr Gwandu was out of touch with reality and incapable of relying on security reports to manage delicate situations in the State.

“Even after this well-publicized incident involving Hon. Suleiman Afegbua, herdsmen continued to operate freely in that area and this led to the kidnapping and killing of innocent, vulnerable farmers especially women in Ewu, Uromi, Ubiaja and Ebigbere communities of the state. “

The group said the State Police Commissioner has refused to cooperate with other security operatives in the state, which has often jeopardized the lives of innocent citizens. To buttress this point, they said, “For instance, when Dr. Andy Ehanire, the renowned environmentalist and conservationist was kidnapped on Sunday 24th of September 2017, which led to three police officers being killed in the process, available information indicates that there was ample and advanced intelligence report showing that criminal elements were planning to invade the area at that period.

“However, Mr. Haliru Gwandu, in his characteristic manner slept away and decided to leave the criminals to operate freely and put the lives of his officers at the mercy of the killers.  Without a doubt, this situation has precipitated fear all over the state and low morale among the officers.”

They continued, “While the family of the slain policemen were still mourning, the family of the kidnapped victim and government were still negotiating with the kidnappers, another incident took place on Tuesday, October 3rd, 2017 with the kidnapping of the renowned musician, Ambassador Osayomore Joseph.  Mr. Gwandu, knowing fully well the security situation in the state was sighted on Televison attending a security summit which some of us refer to as a jamboree in Port Harcourt. Mr. Gwandu refused to establish a situation room to update the people of the state on what steps and progress had been made in the effort to apprehend the kidnappers of the two renowned Edo Personalities.”

Promotion Scandal: Osinbajo urged to extend anti-corruption searchlight to Police

A lawyer, Pelumi Olajengbesi has called on the Acting President Prof. Yemi Osinbajo to intercede in alleged one-sided promotion exercise about to commence in the Nigerian Police Force (NPF).

Olajengbesi, who spoke during a media briefing on Friday in Abuja disclosed that about 72 aggrieved security officers had lodged complaints over denial of their promotions.

He raised accusations that officers of the force were often elevated based on ethnicity and relationships rather than merit.

The lawyer, who is a member of United Global Resolve for Peace, a civil society organization criticized the development describing it as such capable of discouraging the officers from diligently performing their responsibilities.

He appealed to Osinbajo to direct the Chairman of Police Service Commission (PSC), Sir Mike Okiro to probe several concerns and ensure equity and fairness in the forthcoming promotional exercise.

“There is currently a development in the Police. For over six years, the police have been exposed to reckless promotion scandal. You are also aware that there is currently promotion process going on and we are surprised that this process is also enmeshed in a lot of dirtiness, reckless abuse of opportunities, favoritism and some of those acts that doesn’t glorify any nation that practices democracy.

“So we decided to call you to give caution to the Nigerian state and call on the acting president to ensure that the anti-corruption searchlight should be extended quickly to the police,” Olajengbesi said.

He warned the Inspector General of Police (IGP), Ibrahim Idris and PSC chairman to desist from wrong acts capable of demeaning the force.

“Now that the police are becoming determined in their duties, then people in authority must also treat all police force members with all forms of respect and dignity. Our demand is that everyone who is due for promotion should be promoted.

“When people diligently work in a particular organization and they are entitled to certain promotions, when they are denied of these promotions, it amount to great discouragement. It will affect their psyche and this is becoming today’s value system,” he added.

In his remark, Executive Director of the organization, Olaseni Shalom said the organization has decided to open an electronic mail to enable every aggrieved police officer suffering from the same segregation express their concerns.

He disclosed plans to engage in advocacy visits to the PSC and subsequently write a Freedom of Information (FOI) request to demand for list of those who had been promoted, in order to ascertain if the Service was biased or otherwise.

Olaseni restated commitment of the group to take up the fight on behalf of the marginalized police officers across the nation.
