    Ex-convict remanded over attempted murder

    An ex-convict, Hassan Wahab, 32, who allegedly attempted to kill a pedestrian, was arraigned in Lagos on Wednesday.

    Wahab, who was previously convicted for robbery, is facing a charge of attempted murder before an Ikeja Chief Magistrates’ Court.

    The Magistrate, Mrs Oluwadamilola Olanipekun, ordered that Wahab should be remanded in prison custody, pending further investigation and advice from the Director of Public Prosecutions (DPP).

    Earlier, the Prosecutor, Insp. William Ologun, told the court that the accused on Dec. 5, 2015, fired several shots at one Wale Odeniyi at Magboro area on the Lagos- Ibadan Expressway but missed target.

    The prosecutor said the accused claimed that he was unjustly imprisoned, following false accusations by his victim and decided to shoot Odeniyi in revenge.

    Wahab was arrested after the police were tipped off by members of the public.

    Ologun said the offence contravened Section 228 of the Criminal Law of Lagos State, 2011.

    The case was adjourned till Feb. 24 for trial.

    Six herdsmen remanded

    An Oyo State High Court, Ibadan, Oyo State, yesterday remanded six Fulani herdsmen in prison custody for alleged kidnapping and illegal possession of firearms.

    Abdullahi Mohammed (35); Abubakar Abubakar (28);  Damanya Gambo (30); Usman Saidu(30); Usman Idris (35) and Hassan Maikudi (30) were remanded by Justice M. L. Abimbola.

    It was gathered that the accused terrorised Okeho, a border town between Oyo and Benin Republic.

    They were said to have been arrested by the Inspector General of Police (IGP) Intelligence Response Team (IRT), which raided the community and apprehended them.

    The police alleged that Maikudi led his gang to abduct his father, Alhaji Idris Maikudi, after which a ransom of N1.5million was paid to secure his release.

    When the charges were read to them, the accused pleaded not guilty.

    Justice Abimbola remanded them in prison custody and adjourned the case till February 2.

    Dokpesi remanded in Kuje Prison

    FORMER DAAR Communication Plc Chairman Raymond Dokpesi yesterday arrived in Kuje Prison ahead of the perfection of his bail terms.

    He was shielded from anxious inmates at the facility by warders.

    According to a source, Dokpesi was brought to the prison at about 4.55pm and immediately taken to the Prison Chief’s office.

    The source said: “We have received Dokpesi in Kuje Prison and perfected his records before allocating him a cell.

    “Upon sighting Dokpesi, most of the inmates who were abreast of the ongoing anti-corruption trials, were anxious to see him.

    “But we decided to keep him in the office of the Officer-In-Charge to avoid being hurt by some inmates. Warders succeeded in shielding him from inmates.”

    The source described Dokpesi as “certainly moody”.

    Justice Gabriel Kolawole of the Federal High Court, Abuja yesterday ordered that Dokpesi should submit his international passport or any other international document that could enable him travel out of the country.

    He also said the accused person should be remanded in Kuje Prison pending the fulfilment of his bail conditions.

    The judge  granted Dokpesi bail in the sum of  N200m with two sureties in like sum.

    He said: “One of the sureties must be a public servant, either serving or retired, and not below the rank of director, while the second surety must be an entrepreneur who must submit evidence of tax payment in the last three years.

    ”The sureties must tender title deeds of landed properties in any part of Nigeria, the value of which must not be below N200milion.”

    The judge said one of the sureties must be a serving or retired civil servant of the rank of a director in either the federal or state civil service.

    If retired, the surety must show a retirement letter indicating the organisation where he or she had served.

    Justice Kolawole also said the second surety must be a private entrepreneur with evidence of three years tax clearance certificate and a verifiable landed property worth N200 million.

    He said the sureties must sign an undertaking of forfeiture of the property to the Federal Government, in the event that the defendant did not make himself available for trial.

    Justice Kolawole also directed that Dokpesi should not be arrested by any government agency for any investigation.

    He said if any government agency wanted further investigation on the case, it should approach the defendant’s lawyers to make him available.

    Dokpesi, who was arraigned alongside his company, DAAR Investment and Holdings Limited on Wednesday, 9 December 2015, pleaded not guilty to the six-count charge bordering on alleged procurement fraud and breach of public trust preferred against him by the Economic and Financial Crimes Commission(EFCC).

    Moving his application for bail at the last sitting, his defence counsel, Mike Ozekhome(SAN),  urged the court to grant the accused person bail on self-recognition.

    Ozekhome said:  “The applicant has not contributed to the insurgency by his act and the only reason he is held in custody is because of mere speculation of future investigation, which this honourable court cannot act on.

    “The alleged offence is bailable. My Lord, the accused will not jump bail, as he has families and dependants. “

    Opposing the bail application, the prosecution counsel, Rotimi Jacobs(SAN), said : “The nature of the offence is corruption and a serious one.

    ”The accused initially denied having any transaction with the office of the National Security Adviser  until he was confronted with the evidence. Therefore, such a person cannot be granted bail, as this is coming when the country is trying to change its corruption rating in the international community.”

    The case was adjourned till February 17, next year for trial.

     

  • Two men remanded for murder

    Two men – Matthew Imeh and Aliu Salisu – who allegedly caused the death of a man by pushing him into an oncoming traffic, were remanded at Ikoyi Prisons.

    An Ebute Metta Chief Magistrate’s Court which gave the ruling, said the accused should remain in custody pending advice from the State Director of Public Prosecutions (DPP).

    The accused – Imeh, 25, and Salisu, 29 – were arraigned before Magistrate O.A. Komolafe on a two-count charge of conspiracy and murder.

    Komolafe, however, rejected the bail application of the accused.

    The prosecutor, Elizabeth Ekuma, an Assistant Superintendent (ASP) had earlier told the court that the accused committed the offences on May 7 at Aiye Junction on Mushin-Isolo Road.

    She alleged that the accused pushed a man, Rafiu Baale, into an oncoming traffic which led to his being crushed by a Mercedes Benz truck.

    She said the offences contravened Sections 221 and 231 of the Criminal Law of Lagos State, 2011.

    The case has been adjourned to Aug. 19, 2015.

    Man remanded for theft

    Chief Magistrate Abimbola Komolafe of an Ikeja Chief Magistrate’s Court has ordered a 58-year-old man alleged to have stolen a N120,000 phone to be remanded in prison custody pending the advice of the Director of Public Prosecution (DPP).

    The prosecutor, Inspector Eramus Nnamonu, alleged that the defendant used a toy gun to rob one Chief Omololu Adegbuyi.

    Peter, whose residence is unknown, was said to have committed the offence on February 24, this year at Gbagada Junction, Lagos.

    The accused was arraigned on a one-court charge of stealing before Magistrate Komolafe.

    According to the Police Prosecutor, Inspector Nnamonu, the offence was contrary to  Act, Cap. 398 vol. XX11 of the Federation of Nigeria 1990 as amended.

    However, when the charge was read to the defendant,  he pleaded not guilty to the one count charge preferred against him by the police.

    But Chief Magistrate Komolafe rejected his plea, saying that the court would wait for the advice of the Director of Public Prosecution (DPP).

    Subsequently, the prosecutor urged the court to remand the accused, pending the advice of the DPP.

    The court granted his request and ordered the defendant to be remanded in prison custody.

    Chief Magistrate Komolafe adjourned the matter till June 4, this year.

    Three men – Agbomeji Seun 25, Rasaq Babatunde 30 and Anthony Gbagolo 19 have been remanded in prison custody for allegedly killing an hotel manager, Olalekan Oduwobi, 40.

    The defendants allegedly stabbed Oduwobi to death with a dagger.

    It was learnt that the defendants were seen jumping into the hotel while returning from an operation.

    The witness person told the hotel manager, who approached the defendants and they allegedly stabbed him dead.

    The incident occurred on February 25 about 10:45pm at Twelve Thirty Hotel in Imokun, Noforija, Epe, Lagos.

    The defendants were said to have unlawfully possessed one pistol.

    They were arraigned on a three-count charge of conspiracy, murder and unlawful possession of fire arms.

    They pleaded not guilty.

    Prosecuting police Inspector Victor Eruada applied that the defendants be remanded in prison custody pending legal advice from the office of the Director of Public Prosecution (DPP).

    Magistrate M.O Tanimola ordered that they be remanded in prison custody pending legal advice from the DPP’s office. The case was adjourned till April 27.

  • Conductor remanded over alleged murder

    An Ebute Meta Cheif Magistrate’s  Court has remanded a 25-year-old conductor, Idris Rilwan,   alleged to have killed  one Egunjobi Rotimi, 34.

    The defendant, a native of Lagos, was said to have conspired with others now at large to unlawfully murder the deceased by shooting him with a gun.

    The incident was reported to have happened on 16th of February in the late hours during a fight between Idris’ version and the deceased at Abuleoba Constain.

    During the course of investigation, he was arrested and arraigned in court on a two-count charge of conspiracy and murder.

    The charge sheet reads.” That you ‘Idris Rilwan ‘m’ and others now at large, on the 16th day of February, 2015, at about 2300hrs, at Costain area of Lagos, in the Lagos magisterial district, did conspire amongst yourselves to commit felony to wit murder and thereby committed an offence punishable under section 231 of the criminal law of Lagos State of Nigeria, 2011.

    “That you, Idris Rilwan ‘m’ and others now at large , on the same time and place in the aforementioned magisterial district did unlawfully kill one Egunjobi Rotimi ‘m’ aged 34 years by shooting him with a gun and thereby committed an offence punishable under section 221 of the criminal law of Lagos State of Nigeria, 2011.”

    The prosecuting police, Inspector Cousin Adam, filed an application that the defendant be remanded in prisom custody pending legal advice from the office of the Directorate of Police Prosecution.

    The defence cousel, Mr Saka Bello, applied for the withdrawal of the charges against his client. He explained that the court should use its discretion, that proper investigation was not done.

    The presiding magistrate, Mr Nurudeen Layeni, ordered that the  defendant be remanded in Ikoyi prisons pending legal advice from DPP office and adjourned the case till 7th of April

    Ondo: ‘Killer cop’ remanded in prison

    A Magistrate’s Court sitting in Akure, the Ondo State capital, yesterday remanded a Police Constable, Abdul Alonge (32), in prison custody.

    Alonge was arraigned for allegedly killing an expectant mother, Mrs. Segi Olajiga.

    Police prosecutor Ayodele Atandeyi said at about 6:30pm last Tuesday, Alonge shot Mrs. Olajiga with his service rifle at the Plaza Hotel, Akure.

    Atandeyi said the charge would be amended to include attempted murder.

    He said the suspect allegedly attempted to kill the driver of the vehicle in which the deceased was.

    Atandeyi said the court lacked the jurisdiction to try murder cases.

    He sought an adjournment to enable him send a duplicate of the case file to the Department of Public Prosecution (DPP) in the Ministry of Justice for legal advice.

    Defence counsel Mr. Fele Aso did not object to an adjournment.

    The Magistrate, Mrs. Charity Adeyanju, adjourned the case till June 18.

    Women lawyers in the state have urged the Commissioner of Police, Patrick Dey-Dokumor, to ensure that Justice is done in the matter.

    In a petition by the State Secretary of the Federation of International Women Lawyers (FIDA), Mrs. Bunmi Niyi-Arajua; the Public Relations Officer (PRO), Mrs. Abimbola Ajileye and eight others, the group described the killing as “very painful”.

    The statement reads: “It is sad, given the fact that the accused was neither responding to a distress call, armed robbery or a civil disturbance in the community.

    “Eye witnesses said the police constable aimed to shoot a taxi driver, who refused to bribe him, but the bullet hit the expectant mother. We are making this representation to your good office to ensure that justice is done in this matter.

    “The death of two lives cannot be treated with levity. The constitution of Nigeria guarantees every citizen the right to life as stipulated in Section 33(1) of the 1999 Constitution.

    “A police officer who points a loaded gun at an innocent civilian on the street is assumed to intend the killing of such civilian. We seek proper prosecution of the suspect.

    “Mere dismissal from the Nigeria Police Force (NPF) will be grossly inadequate. This petition is the first way we can register our disdain for this unwarranted killing.”

  • Major remanded for ‘fraud’

    A retired Army Major, John Ehigie-Jacob, has been remanded in prison by a Benin Magistrate’s Court for alleged fraud.

    The 65-year-old Major was arraigned on a two-count charge of unlawfully defrauding by false pretence, and obtaining N2 million from Dr Emmanuel Igiebor.

    The offence contravened Section 1(3) of the Advanced Fee Fraud and other related offences Act, Laws of the Federation of Nigeria (2006).

    Prosecuting police Inspector Fatai Amuda told the court that Ehigie-Jacob and others at large defrauded Igiebor by false pretences through First Bank Account No: 1113010060266 for the purchase of a Skida caterpillar, knowing same to be false.

    The offence, he said, was committed between October and December 2009.

    Chief Magistrate Endurance Osemweghe declined jurisdiction to entertain the matter, directing that the suspect be remanded in prison.

    He also directed that the case file be forwarded to the Director for Public Prosecution for legal advice.The case was adjourned till April 3 for mention.
