    Tribunal declares Western winner of Amuwo-Odofin Constituency 1 election

    The Lagos State House of Assembly Election Petition Tribunal has declared Folorunso Olaitan Segun of the All Progressives Congress (APC), the winner of the state assembly election held in Amuwo-Odofin Constituency 1, in March 2023. 

    The tribunal sitting in GRA, Ikeja, ordered the Independent National Electoral Commission (INEC) to withdraw the Certificate of Return issued to the Labour Party candidate, Foluke Osafile, and re-issue a fresh one to Hon Folorunso.

     In affirming the victory of Hon Folorunso, the tribunal declared that

    Foluke Osafile of the Labour Party was not a valid candidate of the Labour Party in the election, consequently, all votes cast for the Labour Party, are null and void.

    The Governorship Election Petitions Tribunal in Birnin Kebbi, the Kebbi State capital, yesterday upheld the election of Governor Mohammed Nasir Idris.

    The News Agency of Nigeria (NAN) reports that the panel of judges comprised Justices Ofem Ofem, Dauraba Suleiman-Sikkom and Celestina Dafe.

    The Peoples Democratic Party (PDP) and its governorship candidate, General Aminu Bande, had filed a joint suit challenging the election of Idris, as governor in the March 15 election and April 18 rerun on the platform of the All Progressives Congress (APC).

    The petitioners alleged that the deputy governor had submitted a fake secondary school testimonial to the Independent National Electoral Commission (INEC), that there was over-voting and that the governor was ineligible to contest the election.

    Delivering the judgment, the chairman of the tribunal, Justice Ofem Ofem said: “We state categorically that the third respondent did not forge certificate.”

    On over-voting, the chairman said of the 59 polling units being questioned, irregularities were discovered in nine, resulting in deduction of 1,735 votes from APC while over 900 votes were deducted from the PDP.

    He said the deduction of the votes would not affect the merging between the winner of the election and the runner-up.

    Also, Nasarawa State Governor Abdullahi Sule has said he would not use the state’s funds to challenge the tribunal verdict that annulled his victory in the March 18 election.

    The governor spoke through his Senior Special Assistant on Public Affairs, Peter Ahemba, in a statement yesterday in Lafia, the state capital.

    The statement reads: “The attention of His Excellency, Abdullahi Sule, Executive Governor of Nasarawa State, has been drawn to a media publication credited to a group operating under the umbrella of Human Rights Writers Association of Nigeria (HURIWA), calling for his probe.

    “In the ill-motivated publication, the group urged the Independent Corrupt Practices and Other Related Offences Commission (ICPC) to conduct a thorough investigation into allegations that the governor might be utilising state funds to support his legal battle following the recent erroneous judgment by two members of the Governorship Election Petitions Tribunal against him.

    “…Governor Sule calls on the public to consider this allegation as another distractive strategy coming from an obviously partisan group working for the opposition Peoples Democratic Party (PDP).”

    Also, the Rivers State chapter of the APC has rejected the judgment of the Governorship, National, and State Assembly Election Petitions Tribunal for dismissing the petitions of its governorship candidate, Tonye Cole, and all its National and State Assembly candidates.

    In a statement yesterday in Port Harcourt by its spokesman Darlington Nwauju, APC said it considered the reason for dismissing the petition of Cole as hypothetical and inconsistent with the positions of the Supreme Court.

    The party added: “The October 2 ruling confirmed the fears of Rivers APC about getting justice in the face of iron-cast evidences presented by our team of lawyers at the tribunal…”

    There is tight security across Abia State, especially Umuahia, the state capital, ahead of today’s judgment by the Governorship Election Petitions Tribunal.

    Our correspondent reports that members and sympathisers of the Labour Party (LP) and the Peoples Democratic Party (PDP) have been at loggerheads on and off social media, causing panic in the state.

    But spokesman of the state police command, Maureen Chinaka, an Assistant Superintendent of Police (ASP), warned that the command would deal decisively with anyone or group of persons that may want to foment trouble in the state.

    Ogun State House of Assembly Election Petition Tribunal sitting at Abeokuta, Ogun State capital, has affirmed election of Wasiu Sunday (IWA) of  All Progressives Congress (APC).

     The three-man panel, headed by Justice Imelda Etape, said Ayodele was duly elected on  March 18.

     A petition was filed by Peoples Democratic Party (PDP) candidate, Olowofuja Idowu, seeking nullification of IWA’s victory, claiming he should ne declared winner.

    The panel rejected all documents brought by the petitioners as  “they failed to bring INEC officials to demonstrate the contents of those documents”.

     “They failed to lead evidence to show non compliance with the Electoral Act, and failed to show the polling units where there were over voting.

      “The panel concluded the petitioner lacks merit and declared Ayodele winner of the election.’’

    Ogun State Governor Dapo Abiodun has said Saturday’s judgment by the Governorship Election Petitions Tribunal which upheld his election victory in the March 18 governorship election, is meticulous and transparent.

    He said only mischievous persons were not satisfied with the judicial pronouncement.

    Abiodun said his opponents were not satisfied with their defeat at the poll but still challenged his victory in court “out of mischief”.

    The governor hailed the judiciary for standing for the truth and justice.

    Abiodun spoke yesterday in Abeokuta, the statwe capital, at a special programme organised by the state’s civil servants to welcome him after his victory at the election petitions tribunal.

    The governor assured the people that his administration would build upon the successes it recorded in the last four years.

    Also, the Ogun State chapter of the Peoples Democratic Party (PDP) yesterday said Saturday’s judgment by the tribunal would not deter it from pursuing justice.

    Its Chairman, Mr. Sikirulai Ogundele, told reporters that the party would not relent in protecting the rights and enhancing aspirations of the state’s citizens.

    “This is why the party has decided to take the matter to the appellate courts.

    “We believe a more thorough and impartial assessment of the evidence and allegations will take place at the appellate court’s level,” he said.

    But the Ogun State chapter of Inter-Party Advisory Council (IPAC) has frowned at the plan of the PDP and its governorship candidate in the March 18 poll, Oladipupo Adebutu, to appeal the Saturday tribunal verdict which affirmed the victory of Governor Abiodun.

    Addressing reporters in Abeokuta, IPAC State Chairman Samson Okusanya urged Adebutu to help in building the state and accept the verdict as the will of God.

    Also, Rivers State Governor Siminalayi Fubara has described the judgment of the Governorship Election Petitions Tribunal which upheld his electoral victory as an affirmation of the people’s trust in him.

    Fubara spoke at a thanksgiving service at in the Chapel of Everlasting Grace in Government House in Port Harcourt on Monday night.

    The event was attended by members of the State Executive Council (Exco) and political leaders.

    In a statement by his Special Assistant Media, Boniface Onyedi, the governor insisted that he would not disappoint the expectations of Rivers people on his administration.

    Fubara explained that the place of God in his administration would not be compromised.

    He said God made his governorship election victory possible.

    Fubara thanked his predecessor and current Minister of the Federal Capital Territory (FCT), Nyesom Wike, and all Rivers residents for their support.

    The Plateau State Election Petition trial tribunal sitting in Jos has dismissed the petition filed by Maiyaki Theodore Bala of the All Progressives Congress (APC) for lacking in merit and affirmed Cornelius Doeyok of Peoples Democratic Party (PDP) as duly elected member for Qua’an Pan South constituency of the House of Assembly.

    Justice Emmanuel Nwazunku Phd, who read the judgment, held that the PDP held a repeat Congress in Plateau State on September 25, 2021 in compliance with Hon. Justice SP Gang judgment delivered on November 26, 2020 and had valid structure to nominate and sponsor the 2nd respondent.

    Tribunal judgment victory for democracy, says Sokoto

    Sokoto State Governor Ahmed Aliyu Sokoto has said the judgment of the Election Petitions Tribunal which affirmed his election is victory for democracy.

    The governor, who was the All Progressives Congress (APC) candidate in the March 18 election, described the tribunal’s ruling, which struck out all the six grounds the Peoples Democratic Party (PDP), as evidence that the main opposition lacked genuine case.

    “The tribunal judgment is a clear testimony of the fact that the nation’s judiciary remains unbiased,” Sokoto said.

    But the PDP governorship candidate, Sa’idu Umar, has rejected the outcome of the tribunal.

    Umar said he would pursue the case to a logical conclusion.

    In a statement at the weekend in Sokoto, the PDP candidate said: “Today’s ruling by the Election Petitions Tribunal is only a stage in our struggle to reclaim the mandate of the electorate who are confident of our sincerity of purpose and competence to deliver service and good leadership.

    “We wish to reassure our supporters and the electorate in the state that they are part of this struggle, which we shall pursue with zeal and commitment.”

    The Peoples Democratic Party (PDP) governorship candidate in Ogun State, Mr. Oladipupo Adebutu, yesterday failed in his bid to upturn the March 18 re-election of Governor Dapo Abiodun at the State Governorship Election Petition Tribunal.

    The court dismissed Adebutu’s petition as lacking merit and affirmed the Independent National Electoral Commission’s (INEC’s) declaration of Abiodun as winner of the election.

    The judgments of similar tribunals in Sokoto and Taraba states yesterday also went in favour of Governors Ahmed Aliyu (Sokoto) and Agbu Kefas (Taraba).

    The Ogun State Election Petition Tribunal in its unanimous judgment that took over 11 hours to deliver said the petitioner and his party failed to prove their case beyond reasonable doubt.

    The tribunal chairman, Justice Hamidu Kunaza, held that the allegations of corrupt practices, non-compliance with the Electoral Act, multiple thumb printing of ballot papers, ballot stuffing and forgery contained in Adebutu’s petition were not convincing.

    He described the testimonies of the witnesses brought by the petitioners as “industrially manufactured, mechanically produced and adopted” and “proven too similar, too coincidental and unbelievable.”

    The tribunal held that the petitioner also failed to prove beyond doubt the allegation that Abiodun was convicted in the US as no witness from that country was produced to testify to that effect.

    Supporters of the APC and the governor, who had thronged the court premises, launched into singing and dancing at the end of proceedings, which were witnessed by Ogun State Deputy Governor, Engr Noimot Salako-Oyedele; the Senator representing Ogun West, Solomon Adeola; his counterpart for Ogun Central, Senator Salisu Shuaib; Senator Gbenga Kaka; Minister of State for Environment and Ecological Management, Dr. Iziaq Kunle Salako; former Speaker of Ogun State House of Assembly, Hon. Titi Oseni-Gomez; House of Reps member, Hon. Tunji Akinosi; Hon. Motunrayo Adeleye-Oladapo and ex-Woman Affairs Commissioner, Mrs Funmilayo Efuwape.

    From the PDP were Adebutu, his running mate Adekunle Akinlade and the state chairman of the party, Alhaji Sikirulai Ogundele, among others.

    The state chapter of the APC, in a congratulatory message after the judgment was delivered, said it had always known that the PDP had no substance.

    Publicity Secretary Tunde Oladunnoye quoted the state Chairman of  the party, Chief Yemi Sanusi, as saying:” We went round the 20 local government areas of the state, we went to some local governments twice, we campaigned vigorously in the wards,  we showcased what our party and government have done in four years and was doing.

    “In most of our campaigns, we commissioned projects and inaugurated new ones, which was unprecedented in the electioneering annals of Nigeria. Our people believed in us, trusted us and voted for continuity. We had no doubt about our electoral victory and it was indeed a divine mandate.

    “We have always known that the PDP is as disorganised as its ramshackle petitions, which the party and its highly incompetent and run away defeated candidate knew or ought to have known cannot succeed. They merely wanted to reap where they did not sow, forgetting that you can’t build something on nothing.

    “The tribunal has rightly done justice and due diligence to their spurious petitions.”

    Your petition against Aliyu defective, court tells PDP’s Umar

    The Sokoto Governorship Election Petition Tribunal said the plaintiff, Sa’idu Umar of PDP, not only failed to prove the six grounds formulated in his petition, the 28 polling unit agents who testified for him could not fully identify themselves along with their roles.

    Besides, the tribunal chairman, Justice Haruna Mshelia, said 70 per cent of the exhibits tendered by the petitioner were out of context as they related to State Assembly elections conducted on the same day.

    Umar had challenged Aliyu’s victory over alleged ineligibility of the governor and Deputy Governor Muhammad Idris Gobir, citing what he called falsification of certificates, variation of names, election frauds and non-compliance with electoral guidelines.

    However, the tribunal said the allegations were nor proved.

    According to him, to prove forgery, two different documents or persons must be presented, but the petitioners failed in this regard while the variation of names issue had been settled by the Supreme Court .

    The petition was consequently dismissed.

    How tribunal affirmed Kefas’ election in Taraba

    The Justice G.A. Sunmonu-led   tribunal, which heard the petition against Taraba State Governor Kefas, said the two grounds upon which Professor Sani Yahaya of the NNPP based his case were untenable.

    He said the petitioners failed to justify the relief they sorted.

    ”The petitioner failed to prove his ground that the governor was not duly elected, and therefore, the petition lacked merit,” Justice Sunmonu said.

    The NNPP and its candidate had claimed the election was characterised by irregularities.

    Another relief sort by the NNPP was for the tribunal to order for a fresh election in the state.

    Apart from the alleged irregularities, the party also alleged non-compliance with the Electoral Act 2022.

    Moments after the judgment was delivered, Kefas hailed it  as an affirmation of the will of the people.

    The governor in a statement by Mr Emma Belo, his Special Adviser on Media and Digital Communications, dedicated his victory to the people of the state.

    He asked his opponents to close ranks and support his administration toward moving the state forward.

    The governor enjoined all citizens in the state to accept the judgment as the will of God and that of the majority of the people.

    ”This victory belongs to all Taraba people and every lover of democracy,” he said.

    The governor commended the judges in the tribunal for standing to their professional calling and upholding truth, justice and fairness.

    The Plateau State chapter of the PDP said yesterday that it had petitioned the Chief Justice of Nigeria and Chairman of the National Judicial Council, Justice Kayode Ariwola, over the judgments delivered by the Justice Mohammed Tukur-led National Assembly Election Petitions tribunal sitting in Jos.

    The party accused the three panelists of deliberate perversion of justice and conspiracy to remove its elected candidates into the legislative houses.

    It said the tribunal had upturned one out of the two senatorial seats won by PDP, all the four seats won into the House of Representatives and six out of the 15 seats won in the State House of Assembly.

    The Osun State Election National and State Assemblies Election Petition Tribunal sitting in Osogbo yesterday sacked the Peoples Democratic Party (PDP) lawmaker representing Ife Central State constituent, Jeremiah Awoyeye.

    The tribunal headed by Justice V. O. Eboreime found merit in the petition filed by Johnson Adejobi of All Progressives Congress (APC) that the election was marred by irregularities.

    It said the petitioner was able to prove that INEC did not substantially comply with the provisions of the Electoral Act 2022, Regulations and Guidelines for the Conduct of Elections 2022 and the Manual for Election Officials in declaring the 2nd Respondent, Jeremiah Awoyeye, as the winner of the election.

    It therefore ordered rerun of election in 26 poling units in the constituency to determine the rightful winner.

    Tribunal affirms election of Nasarawa Assembly’s Majority Leader

    The National and House of Assembly Election Petition Tribunal sitting in Lafia on Saturday affirmed the election Mr Mohammed Omadefu (APC-Keana) as member of Nasarawa House of Assembly.

    The three-member panel led by Justice Francisca Isong-Nnang dismissed the petition filed by Mr Basil Osheka and his Peoples Democratic Party (PDP) in affirming Omadefu’s election.

    Justice Isong-Nnang said the petitioners failed to convince the tribunal to order a re-run of the election in five polling units of Agaza ward in the constituency.

    Reacting to the judgment, Omadefu, already the Majority Leader of the House extended his hands of friendship to Osheka and his supporters to develop Keana constituency.

    “I call on my opponent at the election and his supporters to join hands with me to develop Keana constituency,’’ he said.

    The majority leader also gave God the glory for his victory at the tribunal, just as he thanked the constituents for giving him their mandate that was re-affirmed by the court.
