    UPDATED: Supreme Court upholds President’s power to declare emergency rule, suspend elected officials

    The Supreme Court has upheld the power of the President to declare a state of emergency in any state to prevent a breakdown of law and order or degeneration into a state of chaos or anarchy.

    The apex court, in a split decision of six-to-one on Monday, held that the President, during a state of emergency, can suspend elected officials, but that such suspension of elected officials must be within a limited period, not perpetual.

    Justice Mohammed Idris held, in the lead majority judgment, that Section 305 of the Constitution empowers the President to deploy extraordinary measures to restore normalcy where emergency rule is declared.

    He said, “Section 305 of the Constitution vests in the power to declare a state of emergency where there exists imminent danger of invasion or actual breakdown of public order or safety of such gravity as to endanger the stability or continued existence of the federation or any part thereof.”

    Justice Idris recalled instances in the past, since the restoration of democratic governance in the country in 1999, where states of emergency were declared and elected officials were either suspended or retained in office while the emergency rule lasted.

    He noted that, unlike as specifically provided in the constitutions of India and Pakistan, Section 305 of the Nigerian Constitution is not specific on the nature of the extraordinary measures to be deployed, thereby granting the President the discretion to decide on how to go about it.

    The judge held that since the constitution affords the President the discretion to decide on what extraordinary measures to be adopted, his suspension of elected officials for six months and appointment of a sole administrator were not unconditional.

    Justice Idris also held that there was nothing wrong with the National Assembly adopting the voice vote method in deciding how to approve the emergency rule declaration made by President Tinubu in Rivers State.

    He further held that the National Assembly has the prerogative to decide on the voting style to be adopted at any time, as provided in the Legislative Houses (Powers and Privileges) Act.

    The judgment was on the suit, marked: SC/CV/329/2025 filed by the suit filed by Adamawa and 10 other Peoples Democratic Party-led states, challenging the propriety of the state of emergency declared by President Bola Tinubu in Rivers State, during which elected state officials were suspended for six months.

    Justice Idris, in the earlier part of the judgment, upheld the preliminary objections raised by the two defendants against the competence of the suit.

    In upholding the objections raised by the Attorney General of the Federation (AGF) and the National Assembly (the defendants), Justice Idris held that the plaintiffs (the 11 PDP states) failed to establish any cause of action capable of activating the original jurisdiction of the apex court as provided in Section 232(1) of the Constitution.

    He noted that three conditions must be met before the Supreme Court can exercise its original jurisdiction on any case, which includes that there must be a dispute between the federation and a state or states, or between states; the dispute must involve issues of facts or law, or both, and the dispute must relate to an exercisable right or rights.

    He held that the plaintiffs did not show that the state of emergency declared in Rivers affected them in any way or that an emergency rule was declared in any of the plaintiff states.

    The judge also noted that the plaintiffs failed to show that they were authorised by the affected state – Rivers State – to institute the suit on its behalf.

    He noted from their filings, it was evidence that their grievances were about the declaration of a state of emergency in Rivers, suspension of elected officials in the state, and the appointment of a sole administrator, which they claimed were unconstitutional.

    Justice Idris held that the plaintiffs failed to establish the existence of any actionable dispute between them and the federation to require the Supreme Court to exercise its original jurisdiction to determine the case.

    He struck out the suit for want of jurisdiction, but proceeded to determine the case on the merits and dismissed it.

    Justice John Okoro, Chioma Nwosu-Iheme, Haruna Tsammani, Stephen Adah, and Habeeb Abiru agreed with Idris.

    However, Justice Obande Ogbuinya dissented and held that the case succeeded in part.

    Justice Ogbuinya held, among others, that although the President could declare a state of emergency, the President cannot use such power as a tool to suspend elected state officials, including governors, deputy governors, and members of parliament.

    The European Union has said it will install solar microgrids with a cumulative capacity exceeding 300 kilowatts to power at least 10 primary health centres.

    The organisation also said the project would support nearby small and medium enterprises.

    The Head of Section, Green and Digital Economy at the EU Delegation to Nigeria and ECOWAS, Inga Stefanowicz said this during the launch of the Nigeria Solar for Health Project (NISHP) in Gombe State alongside the inauguration of a Project Implementation Steering Committee which will guide the deployment and oversight of solar electrification of healthcare facilities across the state.

    “In Gombe, we plan to install solar microgrids with a cumulative capacity exceeding 300 kilowatts to power at least 10 primary health centres and support nearby small and medium enterprises,” Stefanowicz said.

    “We are confident that this partnership will bring tangible improvements in healthcare delivery, economic activity, and climate resilience,” Stefanowicz said, underscoring the wider impact of renewable energy on Nigeria’s future.

    Stefanowicz highlighted the urgent need for reliable electricity in healthcare settings.

    “Electricity is vital for accessing healthcare services, and the shortage of energy in healthcare facilities poses significant challenges to delivering effective care,” she said.

    Osun 2026: Former Speaker Salaam emerges ADC guber candidate

    482 members of the African Democratic Congress (ADC) and 53 special delegates on Monday elected former Speaker of the Osun State House of Assembly, Dr. Najeem Salaam, as the party’s governorship candidate for the 2026 Osun State election.

    The Chairman of the ADC Primary Election Committee, Hon. Chukwuemeka Nwajiuba, stated that a total of 535 delegates were expected for the exercise, comprising 482 delegates from local government areas and wards, alongside 53 special delegates.

    Dr. Salaam secured the party’s ticket after an overwhelming victory, receiving 520 votes at the ADC governorship primary. According to Nwajiuba, 528 delegates were accredited and all cast their votes. Of these, eight votes were invalid, while 520 valid votes were credited to Salaam.

    “By the powers conferred on this panel by the constitution of the ADC, I hereby declare Hon. Najeem Folasayo Salaam as the candidate-elect and flagbearer of the African Democratic Congress for the 2026 Osun State governorship election,” Nwajiuba announced.

    Tinubu grants NRCRI patent for Turmeric tea production 

    President Bola Ahmed Tinubu has formally granted the National Root Crops Research Institute (NRCRI), Umudike, Abia State, a Certificate of Patents for the production of three varieties of tea from turmeric rhizomes and leaves.

    The NRCRI recently achieved a technological breakthrough in the formulation and production of these turmeric-based teas. 

    Professor Chiedozie Egesi, Executive Director and CEO of NRCRI, confirmed the development to journalists in Umuahia on Monday, noting that the patent certificate was presented to the institute by the Honourable Minister of Innovation, Science and Technology, Mr. Kingsley Tochukwu Udeh, SAN.

    Professor Egesi explained that the patent grant complies with the provisions of the Patent and Design Acts; CAP 344 Laws of the Federation of Nigeria 1990, highlighting the legal recognition of the institute’s innovation.

    Describing the approval as a “landmark achievement,” Professor Egesi said the patent underscores NRCRI’s commitment to advancing scientific innovation, value addition in agriculture, commercialization of indigenous crops, and the expansion of Nigeria’s herbal wellness and nutraceutical industry.

    “Turmeric, globally recognized for its medicinal, antioxidant, and immune-boosting properties, is now being transformed through NRCRI’s research team, led by Dr. Rachel Majekodunmi Omodamiro, into novel tea product variants,” he stated.

    He added that the innovation promises enhanced health benefits, new enterprise opportunities, and significant contributions to Nigeria’s national economy, describing it as another step toward positioning the country as a leader in bio-innovation, natural products research, and high-value root and tuber crop utilization.

    Congratulating the research team, Professor Egesi said the federal government’s recognition of the breakthrough highlights the strength of Nigeria’s innovation ecosystem and the potential of indigenous crops to drive sustainable development.

    NRCRI, which has the statutory mandate to research the genetic improvement, production, processing, storage, and utilization of root and tuber crops, including yam, cassava, sweet potato, cocoyam, ginger, taro, sugar beet, and rizga, also undertakes national and international research collaborations and short-term training programs.

    The institute additionally executes agricultural extension services in collaboration with relevant federal and state agencies, such as the National Agricultural Extension Research and Liaison Services (NAERLS) and State Agricultural Development Projects (ADPs), within its mandate zone covering the Southeast agro-ecological region of Nigeria.

    NIS raises alarm over use of encrypted apps, falsified documents by human traffickers

    The Comptroller-General of the Nigeria Immigration Service (NIS), Mrs. Kemi Nanna Nandap, on Monday raised concerns over human traffickers and migrant smugglers increasingly using encrypted messaging apps, falsified documents, and other sophisticated methods to evade arrest by security operatives.

    Describing the trend as disturbing and the rise of organised smuggling networks as unacceptable, Nandap said the Service is determined to stay ahead of criminals.

    “Recognising that Nigeria is a key country of origin, transit, and destination, the NIS cannot ignore these developments. They threaten not only human life, but also national security, border integrity, and public safety,” she stated.

    She assured that the Service is committed to dismantling all known smuggling networks and bringing perpetrators to justice.

    According to Nandap, the NIS has deployed cutting-edge technologies at the country’s 144 border points and has established strategic partnerships with key stakeholders to combat migrant smuggling and other cross-border crimes.

    The Comptroller-General made the remarks at the NIS headquarters in Abuja during the flag-off of the 2025 edition of the Anti-Smuggling of Migrants Day, held in commemoration of International Migrants Day. This year’s theme is “Smuggling of Migrants: Emerging Trends, Realities and National Response.”

    The Comptroller-General who was represented by the Deputy Comptroller-General in Charge of Works and Logistics, Mrs Ada James Umannah, said the Anti-Smuggling Migrants Week would be dedicated to creating awareness, solidarity and renewed commitment to the global fight against the criminal act of smuggling of migrants. 

    The Immigration boss said the theme of the awareness campaigns speaks directly to the pressing issues confronting Nigeria, West Africa, and the world at large, saying all hands should be on the deck to tackle the menace of human trafficking. 

    Nandap said, “The Nigeria Immigration Service is intentional about the choice of this theme because it challenges us not only to acknowledge the dynamics of irregular migration but to deepen our resolve in combating the criminal networks that exploit vulnerable individuals in search of hope.

    “The rise in organized migrant smuggling networks, the use of digital platforms for recruitment and deception, and the proliferation of complex transnational routes have created new layers of danger for migrants.

    “From desert crossings to perilous sea journeys, migrants face unimaginable risks—trafficking, extortion, sexual exploitation, violence, and tragic death.

    “We have also observed a disturbing trend where smugglers now operate with increasing sophistication—using encrypted messaging apps, falsifying travel documents, coaching migrants on evasion techniques, and collaborating with criminal groups across borders.”

    While she praised the guidance and support of the Minister of Interior, Dr Olubunmi Tunji-Ojo, Nandap said the Minister’s approach through a combination of policy reforms, operational measures, technology deployment, and international cooperation has deepen operations of the Service. 

    “We have enhanced surveillance along our land, sea, and air borders, deploying technology-driven solutions such as: the establishment of a cutting-edge Command and Control Centre that mirrors all operational activities of the Service, the Migration Information and Data Analysis System (MIDAS), Advanced Passenger Information Systems(APIS), Passenger Name Records (PNR), e-gates at our International Airports as well as the Huawei-powered e-border solutions deployed at over 144 border locations across the country.  

    “Our partnerships with ECOWAS, AU, IOM, UNODC, ICMPD, FIIAPP, FRONTEX and other global actors continue to enhance capacity-building, data exchange, joint investigations, and safe return programmes,” Nandap asserted. 

    She said the Service would intensify aggressive community and institutional sensitization on dangers of irregular migration since migrants are lured into the act through false promises. 

    “Our awareness campaigns target the youthful population- Youth Corps Members, students of all levels of educational institution, youth associations, transport unions etc.

    “This year alone, over 200,000 Corps Members were sensitized in addition to the widespread outreach of our citizens across the country during the 2025 sensitization campaign program. 

    “Our messages focus on: techniques adopted by smuggling networks, digital recruitment, false job offers abroad, and the need for our citizens to use secure, orderly, and regular migration channels when travelling abroad,” the Immigration boss said.

    NAAT urges Fed Govt to fast-track talks on 2009 agreement, salary arrears

    The National Association of Academic Technologists (NAAT) has called on the Federal Government to conclude the ongoing renegotiation of the 2009 FGN/NAAT agreement.

    The union also urged the government to conclude talks on salry arrears and address a range of challenges affecting academic technologists and tertiary education sector.

    The call was made in a communiqué issued at the end of the 61st regular meeting of NAAT’s National Executive Council (NEC), at the New ETF Auditorium, Chukwuemeka Odumegwu Ojukwu University (COOU), Igbariam Campus, Anambra State.

    The meeting was presided over by NAAT President, Comrade (Hon.) Ibeji Nwokoma, who also signed the communique.

    According to the communiqué, the NEC of the association expressed concern over delays in the ongoing renegotiation of the 2009 agreement and urged the government to intensify efforts toward a timely and mutually acceptable outcome that would improve the welfare and working conditions of academic technologists and strengthen technological development in the education sector.

    The council also lamented the persistent erratic power supply across the country, noting that it has severely affected laboratory operations, students’ practical learning and research activities. 

    The union called on the federal government to urgently provide alternative power solutions, including solar and wind energy, to support teaching and research in tertiary institutions.

    On taxation, NAAT advocated an increase in the annual income tax exemption threshold from ₦800,000 to ₦2 million, describing the current benchmark as inadequate. 

    The union also noted that only basic salaries of academic technologists be taxed, while allowances and other components should be exempted, to ease financial pressure on its members.

    Addressing national security, the NAAT NEC acknowledged government efforts to tackle rising insecurity but called for expanded strategies and increased deployment of resources to ensure citizens’ safety and create an environment conducive to economic growth and national development.

    The council further expressed dismay over the deplorable state of roads, which it said had become increasingly hazardous. 

    The union, while commending federal and state governments for ongoing road construction projects, called for the prioritisation of urgent repairs on existing roads and the completion of abandoned projects to improve safety and connectivity.

    On capacity building, NAAT commended the federal government for supporting training and retraining of academic technologists through capital grants, but called for increased investment in continuous professional development to enable world-class technological breakthroughs.

    The NEC also appreciated the inclusion of academic technologists and laboratory scientists as beneficiaries of TETFund scholarship programmes, while requesting expanded opportunities for international training on the use and maintenance of modern automated equipment.

    In addition, NAAT appealed to the federal government to immediately release three and a half months of withheld salaries owed to its members, and to pay outstanding arrears relating to promotions, 25 and 35 per cent salary increments, the ₦35,000 wage award, and the consequential adjustment to the ₦70,000 minimum wage.

    The union said settling these obligations was critical to cushioning the effects of the prevailing economic hardship on its members.

    Tinubu condoles Bayelsa over death of Deputy Governor Ewhrudjakpo

    President Bola Ahmed Tinubu has expressed deep condolences to the government and people of Bayelsa State over the passing of the state’s Deputy Governor, Senator Lawrence Ewhrudjakpo.

    In a statement issued on Monday by his Special Adviser on Information and Strategy, Mr Bayo Onanuga, the President described the late Ewhrudjakpo as a diligent and selfless public servant who served Bayelsa State and Nigeria with patriotism and commitment.

    President Tinubu extended his heartfelt sympathies to Bayelsa State Governor, Senator Douye Diri, as well as to the wife of the deceased, Barrister Beatrice Ewhrudjakpo, his children, family members, friends and associates who worked closely with him during his years in public service.

    The President recalled the late Deputy Governor’s distinguished career, noting that Ewhrudjakpo had served Bayelsa State as Commissioner for Works and Infrastructure before his election as Senator representing Bayelsa West Senatorial District.

    According to the President, Ewhrudjakpo’s contributions to the development of Bayelsa State were evident in the infrastructure projects he supervised and the role he played in lawmaking and policy shaping during his tenure in the National Assembly.

    President Tinubu encouraged the government and people of Bayelsa State to preserve and uphold the legacy of the late Deputy Governor, whose service left a lasting imprint on the state’s development trajectory.

    He also offered prayers for the repose of Ewhrudjakpo’s soul and asked God to grant comfort and strength to his grieving family, the government and the entire people of Bayelsa State at this difficult time.

    Police nab 58-year-old man for alleged murder of wife

    A 58-year-old man, Vitalis Nwoko, has been arrested by operatives of the Ahiazu Mbaise Divisional Headquarters in Imo State for allegedly killing his wife, Uloma.

     The suspect, from Umuagba in Ahiazu Mbaise Local Government Area, is currently in custody.

    Confirming the arrest, the police spokesman in the state, Henry Okoye explained that the arrest followed a report lodged at the Division by the deceased’s sister, who alleged that the suspect violently assaulted his wife during a domestic dispute. 

    “Acting promptly on the report, operatives of the Division arrested the suspect,” he added.

     He explained further that during preliminary investigation, the suspect stated that a misunderstanding between him and his wife on December 11, 2025 escalated into a physical altercation, during which the victim collapsed. 

    “She was rushed to Cecilia Hospital, Ogbe, where she was confirmed dead by a medical doctor, he said 

    According to him the suspect has been transferred to the State Criminal Investigation Department (SCID), Owerri, for thorough investigation and prosecution.

    He urged residents to promptly report domestic violence cases to the police, assuring the public of the Command’s resolve to deal decisively with perpetrators.
