NSITF pays N6.2b to Dana crash victims

The Nigeria Social Insurance Trust Fund (NSITF) has said that it has paid about N6.7 billion to British Tobacco in favour of victims of Dana Air crash, which occurred on June 3, 2012.

NSITF also said that the dependants of the victims are currently on the insurance trust fund’s monthly payroll.

Managing Director of NSITF, Mr. Umar Munir Abubakar, disclosed this in Port Harcourt, the Rivers State capital, during an interactive and enlightenment forum on the ‘Employees’ Compensation Act, 2010′, organised by the fund and the Nigeria Employers Consultative Association (NECA) for the South-South and South East geo-political zones.

Abubakar, who also gave a breakdown of compensations the NSITF has paid out to many organisations, industries, individuals and persons with disability, also advised companies to always adopt and adhere to safety rules to avoid accidents and loss of lives.

The NSITF boss expressed regrets that state and local governments in the country have refused to comply with provisions of the Employees’ Compensation Act, more than five years after it became effective in the country.

Abubakar said: “Unfortunately for us, we are having a running battle with state governments and local government councils. They are yet to comply. Unfortunately for us again, some major government parastatals are yet to key in.”

He further recalled that in 2010 when the scheme came on stream, several employers were caught unawares, a development he said, necessitated the shifting of the scheme to 2011 to allow them to start contributing from that year.

Continuing, he stated: “From that time till now, we have registered as many as 33,000 employers in the private sector. To us, that was a great breakthrough. This year alone, we have been able to register no fewer than 9,395 employers.”

He stated further, “Of course, we are not saying that is the end; we still have lots and lots of employers who are yet to comply, especially those who are outside the purview of the Nigerian Employers Consultative Association (NECA).”

Since the project came into existence, Abubakar added that the same 33,000 employers have been registered by the insurance fund into the Safe Workplace Intervention Project (SWIP).

Speaking earlier, the Director-General of NECA, Mr. Olusegun Osinowo, said the association became effective in year 2010 following the passage of the Employees’ Compensation Act by the National Assembly.

Dana crash: ‎23 families seek to amend compensation claims

Twenty-three families of ‎the Dana Air plane crash ‎victims have applied to the Federal High Court in Lagos to amend their compensation claims from the airline.

‎On June 3, 2012, Dana Air’s McDonnell Douglas MD-83 operating as Flight 992 crashed into a two-story building at Iju Railway, Ishaga, a Lagos suburb, killing all 153 people on board.

Justice Mohammed Idris ‎has fixed October 21 to hear the case against Dana Airlines and the Estate of Pilot Peter Simon Waxtan brought by the families.

The judge had earlier ruled on ‎four applications by the plaintiffs, granting all the reliefs sought.

‎The plaintiffs, among others, prayed for an order directing Dana to pay them the statutory advance payment of US $30,000.00 in full or the outstanding due advance payment.

They sought interest on the sum at the rate of 21 percent per annum from July 4, 2012, the 30th day after the air crash and the date on which the payments ought to have been made, until the date of the court’s order and at the rate of 10 percent per annum from the day the order was made till the sums are fully paid.

They also sought the costs of the applications assessed at US$10,000.00 each.

‎The applications were filed on the families’ behalf by a consortium of lawyers, Aviation Attorney Group, led by Oba Nsugbe, (QC, SAN) of Pump Court Chambers.

The consortium also includes; Dr. Babatunde Ajibade (SAN) who is the Managing Partner of the firm of SPA Ajibade & Co; Ajibola Dalley of GRF Dalley & Partners and their foreign colleagues Jim Morris and Rebecca Smith – both of Irwin Mitchell Solicitors in the United Kingdom.

‎The Aviation Attorney Group was formed to pursue, across jurisdictions, the statutory compensation due to the families/beneficiaries of the estates of the Dana Air crash victims.

The defendants, who denied the claims, had sought an order extending the time for them to appeal against the court’s ruling. They also want to stay execution of the ruling.

Nsugbe said they had also filed applications seeking to amend the claims to reflect the specific damages claimed against Dana as original pleadings did not particularise them.

‎‎Section 48 (3) of the Nigerian Civil Aviation Act (NCAA) 2006 requires a carrier to make advance payments of at least $30,000.00 within 30 days from the date of an accident resulting in death or injury of passengers, to the natural person or such natural persons who are entitled to claim compensation.

Dana Air and its insurers are said to have failed to pay the statutory advance compensation of US $30,000 to the families of several victims of the air crash.

In their defence, Dana Air and Stacey Veolette Sellers (who was sued as the personal representative of the Estate of Mr. Peter Simon Waxtan – the late pilot of the air craft) denied liability and disagreed with the interpretations the plaintiffs placed on relevant provisions of the Convention and the NCAA 2006 vis-à-vis their claims.

This was the basis upon which the plaintiffs filed applications and arguments, urging the court to determine certain points of law.

  • Immigration’s border patrol planes grounded

    Immigration’s border patrol planes grounded

The two planes used by the Nigerian Immigration Service (NIS) for border patrol are no longer in operation due to long time abandonment, Minister of Interior Abba Moro was told yesterday.

Managing Director of Dornier Aviation Nigeria (DANA) Ltd Mark Snoxell said yesterday that the planes could still fly for the next 10 years if they were rescuscitated.

He spoke when he visited the minister in Abuja yesterday.

The News Agency of Nigeria (NAN) reported that Moro directed the Comptroller-General, Nigeria Immigration Service, Mr David Parradang, to work out modalities for resuscitating the air border patrol unit of the service.

.He said the resuscitation of the unit was necessary to patrol the country’s borders to address security challenges.

The Minister said illegal immigrants in the country ‘have been identified as perpetrators of various acts of terrorism”.

He said that there was a need also to resume air border patrol as vehicular patrol and deployment of high-tech surveillance equipment was not enough to address the present security challenges.

“We have taken steps to resuscitate our border patrol by setting up a committee to examine our preparations for air border patrol against the existence and operations of our aircraft patrol units.

“The abandonment of these aircraft for some time now has made them unworthy to fly and with the visit of Dornier Aviation, we can start doing something immediately to revive our aircraft operations,” he said

Moro said due to paucity of funds, the Federal Government had adopted Public Private Partnership to protect and maintain its assets all over the country.
