    Ondo: Supreme Court okays hearing of Jegede’s appeal

    The Supreme Court on Tuesday ordered the Court of Appeal to continue hearing on the appeal filed by the Peoples Democratic Party (PDP) governorship candidate in Ondo State, Eyitayo Jegede, challenging the decision of a federal high court to substitute him with the billionaire businessman, Jimoh Ibrahim, as the party candidate for the November 26 governorship election in the state.

    A five-man panel led by the acting Chief Justice of Nigeria, Walter Onnoghen, ordered the court of appeal to continue hearing on the matter.

    The court had last week adjourned indefinitely, hearing on the matter, following an application for stay of proceedings filed at the apex court.

    The Court of Appeal in Abuja has withheld its judgment in the appeal filed by the substituted governorship candidate of the People’s Democratic Party (PDP) in Ondo State, Eyitayo Jegede (SAN).

    Jegede had appealed the decision of Justice Okon Abang of the Federal High Court, Abuja directing the Independent National Electoral Commission (INEC) to substitute his name (Jegede’s) for Jimoh Ibrahim as the party’s candidate for the election scheduled for November 26.

    The Justice Ibrahim Saulawa led three-man special appeal panel, which heard the appeal marked: CA/A/551C/2016 and other appeals relating to the Ondo PDP dispute, had scheduled judgment for 12noon Friday (today) in the Jegede appeal.

    Parties and all in court were however surprised when, upon resumption of proceedings, Justice Saulawa said the judgement and all other issues would be suspended until the Supreme Court decides a motion for stay of proceedings pending before it.

    Justice Saulawa, who cited a fresh motion filed Thursday before the Supreme Court by nine individuals led by the factional Chairman of PDP in Ondo, Biyi Poroye challenging the refusal of the appeal panel to stay proceedings, said his panel will await the decision of the Supreme Court on the pending application for stay of proceedings.

    Jegede and all his supporters, who formed the majority of the court’s audience, were unhappy about the court’s pronouncement.

    ‎Meanwhile, the Supreme Court has fixed next Tuesday for the hearing of the motion for stay of proceedings filed by the nine respondents led by Poroye.

    They are by the motion, seeking the stay of further proceedings by the appeal ‎panel pending the determination by the Supreme Court, of an appeal by the Poroye group against the panel’s ruling granting leave to Jegede, Ahmed Makarfi and Ben Obi to appeal the June 29 judgement and October 14 ruling by Justice Abang.

    Akoko traditional rulers in Ondo State yesterday passed a vote of confidence in the governorship candidate of the Peoples Democratic Party (PDP), Jimoh Ibrahim.

    The monarchs spoke through the Oloba of Oba-Akoko, Oba Adeniyi Adegoroye, when the billionaire businessman visited the area as part of his campaign in the Northern Senatorial District.

    Oba Adegoroye said the monarchs met at Oka-Akoko on Tuesday to deliberate on the political involvement of the Akoko people.

    He said: “At the meeting, we concluded that it is already late for an Akoko man to be the next governor, but we must ensure that we have a political alignment with a candidate who will handover power to us after his tenure.

    “We are very conscious of the fact that if we give our votes to our brothers from the South, its will be easy for us to expect the slot to rotate to the North and particularly, the Akoko part of the North,” the monarch said.

    Ibrahim promised to pass the baton of leadership to an Akoko person after his tenure.

    “If a governor comes from Owo/Ose that automatically puts Akoko in a tight corner, and this part of the state will have to wait for another 16 years before it rotates here again.

    “If Mimiko had picked an Akoko man or woman as his successor, or someone from the Southern Senatorial District; I would not have contested.

    “That is the fight we are fighting now; for equity, fairness and justice to every part of this state.”

    Appeal Court reserves judgment in Jegede’s appeal against Ibrahim

    A Special 3-man panel of the Court of Appeal constituted to hear the appeals on the dispute of governorship candidate of the People’s Democratic Party (PDP) in Ondo State has reserved judgment in the appeal by the substituted candidate of the party, Eyitayo Jegede (SAN).

    The panel, led by Justice Ibrahim Saulawa told parties Wednesday that they would be informed when the judgment was ready.

    Jegede appealed the October 14, 2016 ruling of Justice Okon Abang of the Federal High Court, Abuja, directing the Independent National Electoral Commission (INEC) to substitute Jegede with Jimoh Ibrahim as the candidate of the PDP in the forthcoming governorship election in Ondo State.

    Justice Saulawa’s announcement elicited complaint from the camp of the respondents comprising state’s executive of the PDP in the South West (loyal to the Ali Modu Sheriff leadership of the party), led by Biyi Poroye, Chairman, PDP, Ondo State.

    Their lawyer argued that Jegede’s lawyer was allowed to adopt the appellant’s brief where the respondents were yet to file their reqponsents’ brief as required and to allow the court hear from both sides.

    Respondents’ lawyer, Beluolisa Nwofor (SAN) had argued that the court could not hear the substantive appeal in view of the pending appeal at the Supreme Court.

    He told the Appeal Court panel that his clients have appealed its earlier ruling granting leave to Jegede to appeal and that they have also filed a motion for stay of proceedings before the Supreme Court.

    Nwofor, who tendered certified true copies of the record of appeal and motion for stay of proceedings, urged the court to abide by the long held tradition of deferring to a higher court once an appeal is entered and record of appeal compiled.

    He argued that since their appeal was entered at the Supreme Court and a motion for stay of proceedings also pending before the apex court, the appellate panel has lost jurisdiction to proceed with the appeal by Jegede.

    “We have asked this court to hands off and await the Supreme Court’s decision on our motion for stay of proceedings. This court has lost the jurisdiction to proceed with this appeal. It should await the decision of the Supreme Court.

    Appellant’s lawyer, Wole Olanipekun (SAN) faulted Nwofor’s argument and urged the court to proceed to hear his cleint’s appeal.

    He argued that, for his client, time was of the essence because by the new provision of the Electoral Act, a person, who did not participate in all process of an election cannot challenge its outcome.

    Justice Saulawa however overruled Nwofor, noting that the court had, on November 10, 2016 granted an accelerated hearing in the case, abridged the time within which parties are to file their processes and a departure from the rules.

    Shortly after the judge’s spoke, Olanipekun adopted his client’s appellant’s brief and urged the court to allow the appeal.

    Nwofor, who expressed surprise at the development, said his clients had been shot out. He said the court failed to abide by tradition where appeals are entered.

    As Justice Saulawa announced the reservation of judgment, supporters of Jimoh Ibrahim and Sheriff, who occupied a section of the court, began to murmur.

    Meanwhile the court has adjourned to 12noon today to enable Poroye and other respondents in the appeal by Senators Ahmed Makarfi and Ben Obi to file their respondents’ briefs.

    Makarfi and Obi are appealing the June 29 judgement of Justice Okon Abang of the Federal High Court, Abuja recognising the Sheriff-led National Executive Council of the PDP as the party’s authentic leadership body.

    The court, in two separate rulings Wednesday, refused applications by Ibrahim to be made a party in both appeals.

    The leadership of the Peoples Democratic Party (PDP) in the Southwest has urged  its  members in Ondo State to unite and work for the victory of the party’s governorship candidate, Jimoh Ibrahim, in the November 26 poll.

    Southwest PDP Chairman Makanjuola Ogundipe, in a statement in Ado Ekiti, said members should put their differences behind and commence a serious campaign to sell Ibrahim and his running mate, Ebenezer Alabi, to the electorate.

    Ogundipe maintained that Ibrahim remains the legally-recognised flag bearer for the Ondo governorship poll. He therefore appealed to all members to sink their differences and remain focused to ensure victory for the party.

    He said: “The leadership of our great party in the Southwest congratulates Barr. Jimoh Ibrahim and Hon. Ebenezer Alabi as candidates for governor and deputy governor respectively to the coming governorship election in Ondo State

    “We remind all that it is time for genuine members of our great party, particularly in Ondo State, to put the past behind them and support Ibrahim as the legally recognised candidate, having been validly nominated.

    “As loyal party followers, it’s only expected that we support our party, so that the PDP in Ondo State can return to be stronger, both in service providing and unity in the interest of the people.

    “Our democracy will deepen appreciably, like other advanced democracies, if associated institutions are religiously respected and obeyed by practitioners alike.

    “Nowhere can players disobey rules and regulations and expect a rancour-free engagement; it’s as a result that Nigeria politics is still very much characterised with lawlessness and avoidable violence.

    “The time for internal wrangling is gone; this is the time for serious and conscientious campaign work, as I return a verdict of no victor no vanquished.”

    Jimoh Ibrahim to Jegede: wait for your time

    The governorship candidate of the Peoples Democratic Party (PDP) in Ondo State, Jimoh Ibrahim, yesterday urged his rival, Eyitayo Jegede, who he described as “a brand new governorship candidate” to wait for his time.

    He added that Jegede should continue to learn about politics, until he is fit for the sensitive position.

    According to him, he and other candidates have experiences in the art of politicking and governance, urging Jegede to stay on the queue.

    The Igbotako-Okitipupa-born entrepreneur, who spoke to reporters in Akure, the state capital, said he is in the race to correct the injustice in the state, particularly the way Governor Olusegun Mimiko picked Jegede as his successor.

    Highlighting his programmes, Ibrahim said his first priority would be the payment of all outstanding workers’ salaries.

    He said his administration would prioritise infrastructural and healthcare development coupled with good road network.

    Ibrahim added that if elected, his administration would create an Infrastructural Development Commission (IDC) and the Board of Internal Revenue would become a full-fledged ministry.

    The legal practitioner said he would scrap the Special Duties Ministry and replace it with the Ministry of Employment.

    He said: “By God’s grace, in my early days in government, I will dismantle the orange logo and its structures initiated by the Mimiko administration and replace it with the coat of arms with everything painted in our national colours.”

    Ibrahim described the primary election that picked him as the PDP candidate as the most valid with five aspirants on his side and only two on Jegede’s side.

    Ondo State Peoples Democratic Party (PDP) governorship candidate Jimoh Ibrahim has told Ekiti State Governor Ayodele Fayose to be patient as he will soon know who is the party’s legitimate candidate.

    He said it was too early for him to panic.

    In a statement yesterday, Ibrahim said the Ondo PDP crisis had not degenerated.

    He said: “Fayose is advised to wait till November 27 after the election, as we shall move to Ekiti to enforce the Justice Okon Abang judgment, which also covers the PDP executives in Ekiti State.

    “Our movement to Ekiti will be during the day, so it is better for Fayose to prepare and learn from the experience of Governor Olusegun Mimiko, who was performing in Ondo, until he was distracted by Fayose.”

    The PDP candidate urged Fayose to brace for the reality of the Ondo election, noting that he will triumph in the November 26 poll.

    “Let me remind Fayose that I am not former Governor Kayode Fayemi and it is now payback time to treat Fayose  the way he treated Fayemi.

    “He is equally advised that, this is not an election of prophesy.

    “Since Fayose has predicted that I will not be governor, it simply means he will be invited to attend my inauguration,” Ibrahim said.

    Crisis hits NANS over Jimoh Ibrahim’s award

    An award presented to Mr Jimoh Ibrahim, the Peoples Democratic Party (PDP) candidate in the November 26 Ondo State governoship election has caused a row in the National Association of Nigerian Students (NANS). Some students are alleging that he bought the “Leardship Award”. TEMITOPE YAKUBU reports.

    CRISIS has hit the National Association of Nigerian Students (NANS) over an award presented to Mr Jimoh Ibrahim, the People, Democratic Party (PDP) candidate in the November 26 Ondo State governoship election. Some students believe that he bought the “Leadership Award” in order to get the association’s support in the election.

    But, NANS Senate President Salam Oyejide, who presented the award to Ibrahim, is keeping mum on inducement allegation.

    When CAMPUSLIFE spoke to him on telephone, Salam said he had nothing to say on the allegation. He added: “The award was presented to Mr Ibrahim because of various student-related programmes he has done and his support for education.”

    Salam’s explanation did not go down well with his colleagues, who criticised the NANS leadership for using the platform to feather its nest. They wondered why NANS always gives what they called “frivolous awards” to politicians during elections. The leadership’s latest action, they said, would further weaken NANS’ capability as a pressure group.

    NANS came under criticism during the 2015 elections for the series of awards presented to some politicians. After the  elections, NANS leaders drew the flaks when they presented an award to Senator Buruji Kashamu.

    Ibrahim’s representative was said to have received the award in the Postgraduate Complex the businessman donated to Obafemi Awolowo University (OAU) in Ile-Ife, Osun State, in 2011.

    It was the issue of discussion when CAMPUSLIFE visited OAU. Students are asking the association’s leadership to stop hiding behind the NANS facade to scoop money from politicians.

    They said the association’s activities are against the tradition of students’ unionism.

    According to Moshood Olajide, former Public Relations Officer (PRO) of OAU Students’ Union Security Committee, the NANS’ action is a rape on students’ unionism, adding: “The action of the NANS Senate President is an affront to our collective struggle as students and a rape on the tradition bequeathed to us by the founding leaders. NANS’ awards should go to radicals, not politicians who are oppressing the students. This action has shown that, NANS Senate President was insincere in his manifesto in which he promised to bring back the association’s glory.”

    Moshood pointed out that students expected a body that would lead an agitation for reduction of fees and campaign for good governance. He said students should not see the present crop of NANS leaders as those that would take the association out of the woods.

    “The kind of leadership students expected is not seen in the current crop of leaders. NANS is supposed to be part of the pressure groups  that will strengthen our democracy by fighting income disparity and anti-masses policies. Students are tired of NANS leaders giving frivolous awards to politicians in exchange for money.We are tied of hungry leaders hosting meetings with vice-chancellors to sabotage students’ interests,” he said.

    An education student, who identified himself as Comrade Joe, described the award as an insult to students.

    He said: “I will not be a party to mediocrity and travesty of students’ unionism. I don’t know why somebody would wake up today to give award for something done five years ago. Besides, the Prof Bamitale Omole-led management had honoured Ibrahim for donating the Postgraduate complex. Also, the Faculty of Law presented an award to him for the same reason.

    “Is it that NANS is just waking up after five years? The award is an insult to the collective sensibility of students. NANS leaders need to tell us how much they were paid to create such frivolous award to boost the ego of a moneybag. They are selfish and driven by personal interest, rather than common good.”

    Wole Olubanji, an OAU alumnus and the convener of Alliance of Nigerian Students Against Neo-Liberal Attack (ANSA), described the award as ridiculous and self-serving. He said though NANS could honour anyone for achievements, such award, he said, must be subjected to popular vote among students.

    He said: “OAU Students’ Union leaders, led by the Speaker, Niyi Adewumi, in 1986 honoured the late Gani Fawehinmi with the Senior Advocate of the Masses (SAM). This was a general decision subjected to democratic process. It was a unanimous decision supported by all students.

    “Such award was not controversial, because it was a product of intense debate on the character of the recipient. And whether such award was necessary, reverse is the case in that of Ibrahim. It was a decision of a few students, who are looking for the politician’s money.”

    It was gathered that members of the NANS Senate have not convened any sitting since they were elected months ago. This fueled the insinuation that the NANS Senate President may have acted alone in giving the award to Ibrahim.

    Gafar Fatoyinbo, an Education student, criticised the NANS leadership for what he called its insensitivity, noting that there were many events calling for NANS’ attention.

    He said: “Weeks ago, the management of Kwara State Polytechnic expelled SUG Welfare Director for challenging the school authorities on students’ welfare. Ladoke Akintola University of Technology (LAUTECH) has been closed down for over four months, while over 23 students were suspended by the University of Lagos (UNILAG). There have not been serious  efforts by NANS to address these issues. We have an association that is effective in turning itself to an appendage of politicians, rather than being being a platform for students to fight oppression.”

    Lekan Igbasan, a 200-Level Philosophy student, said the award stood logic on the head, observing that the recipient’s democratic credential was questionable. He cited Ibrahim’s decision to contest for governor under a factionalised party, adding that the PDP candidate’s antecedent as a bad manager   showed that he would be dictatorial and anti-masses.

    He said: “All these actions are against the ideals of unionism. Such a person (Ibrahim) should not be honoured by any student. NANS should stop giving politicians awards and concentrate on addressing the plight of students.”

    CAMPUSLIFE gathered that some members of NANS executive present during the ceremony left immediately the  award was conferred on the politician to avoid any untoward situation.

    The All Progressives Congress (APC) candidate in the forthcoming Ondo State governorship election, Rotimi Akeredolu was on Monday confident that he can win the two Peoples Democratic Party (PDP) aspirants, Jimoh Ibrahim and Eyitayo Jegede, put together.

    He spoke with State House correspondents after he met with President Muhammadu Buhari along with Plateau State Governor, Simon Lalong at the Presidential Villa, Abuja.

    Akeredolu said: “l can always tell you, people who know me, they know that I talk most times with some confidence, let me assure you here that by the grace of God, we will win the election in Ondo state.

    “I can assure you I would have been happier facing both of them together, if Eyitayo Jegede was chosen as candidate and Ibrahim as his deputy, I will still win.

    “Infact Jegede happens to be a friend, Ibrahim too. Jimoh Ibrahim went to Ife, so we have known ourselves for long. I have no fear about both of them. We know that we are going to win this election and I have no doubt,” he added

    When asked to speak on efforts to settle the rift between him and the National Leader of the APC, Asiwaju Bola Tinubu, he denied any rift with Tinubu.

    He said: “I don’t have any rift with him, since the primaries you would see that as leader of the party, he has not said anything about it. He has accepted the primaries and we are moving on. So, I don’t have any rift with him at all and we are moving on.”

    He said that his party in the state has already called on the security agencies in Ondo to be up and doing in order not to allow miscreants take over the state in the name of protests.

    He said: “Because for instance as a governor you encourage lawlessness or people in the guise of protest because what the PDP has is a problem within the party, that should not lead to demonstration outside and you know that people are not demonstrating for any reason but because they have been more or less paid to come and do it.

    “What we said is don’t allow miscreants to be out. Nobody can control the end of such demonstration. So it’s not that we are afraid, but we fear for the life and property of the people of Ondo state.” He stated

    Speaking on the visit to the President, Lalong said: “A few weeks ago I was given the responsibility of leading the campaign on behalf of the National Executive for the Ondo election. And the candidate since election at the primaries have not come to be presented to the leader of our party, that is Mr President.

    “So today we came in with the candidate and to confirm to the President that APC has only one candidate unlike other parties that are fighting about who is their candidate.

    “We have only one candidate and that candidate is Chief Akeredolu Rotimi (SAN).” He said
    He was optimistic that the APC will win the election.

    He said: “Well that is not a problem to APC, since inception you knew what happened in Kogi, you knew what happened in Edo, we won the elections. It was as if it was going to be very difficult for us but we won the elections.

    “Today again we are going into Ondo, all the mistake we made in other states we have corrected them, we are seeing a very smooth election, not only a smooth election but the credibility of the candidate itself is something worth selling,” he said.

    The governor also faulted the visit of the out-going Ondo State governor, Olusegun Mimiko, to President Buhari last Friday.

    According to him, Mimiko should have concentrated on resolving the crisis that erupted in his state.

    He said: “Let me say it was even wrong for them to start running to Mr. President to help them solve the problem of PDP in their party. Mr. President is the President of Nigeria and he is not a member of PDP. Even when we have problems in APC, we don’t run to Mr. President.

    “If he has a problem in his state, he is the governor, let him stay there and resolve the matter. Its a matter between PDP and PDP and those matters are in court. So why should you run to the President. Is the President the chief judge of Nigeria?” He queried

    He went on: “He is not the INEC chairman either. Well Mr. President is a loyal party man. So he is answerable to the party although the president of Nigeria.”

    On the response of President Buhari to the visit, Lalong said: “He has also confirmed that he has seen the candidate and is also praying for a successful election in Ondo state.”

    Appeal court reserves ruling on Makarfi’s motion against Jimoh Ibrahim

    The Court of Appeal Abuja division yesterday evening reserved in the motion filed by a factional Chairman of the Peoples Democratic Party, Ahmed Makarfi, and the faction’s Secretary, Ben Obi, seeking leave to appeal against the Federal High Court’s judgment which recognised Jimoh Ibrahim as the PDP’s governorship candidate in Ondo State.

    A three-man panel of the court presided over by Justice Jumai Sankey announced the reservation of ruling after entertaining arguments from parties.

    The Independent National Electoral Commission (INEC) on Thursday, acting on the June 29 judgment of Justice Okon Abang and another enforcement judgment of the same judge on October 14, dropped Eyitayo Jegede’s name and replaced it with that of Ibrahim.

    Yesterday’s proceedings, which witnessed the hearing of the motion jointly filed by Makarfi,  Obi, and others, lasted about six and a half hours.

    Makarfi and Obi filed their motion in the appeal CA/A/155/2016 seeking an extension of time to appeal and the leave to appeal as interested parties against the June 29.

    Jegede also filed similar motion in his appeal numbered CA/A/155C/2016, but was adjourned till Tuesday for hearing to enable the respondents filed their responses.

    The motions by Makarfi, Obi and Jegede were necessitated by the fact that they were not parties to the suit at the Federal High Court and failed to appeal within the statutory 90 days within which they ought to do so.

    Makarfi and Obi’s motion argued by their lawyer, Dayo Akinlaja (SAN), was opposed by the lawyer to the respondents, including the Biyi Poroye-led faction of the PDP in Ondo State, Alex Izinyon (SAN).

    Poroye’s faction which produced Ibrahim as the party’s candidate belonged to the Ali Modu Sheriff, while Jegede belonged to Makarfi faction.

    PDP’s lawyer, Olagoke Fakunle (SAN), also opposed the motion.

    But INEC’s lawyer, Mr. Nelson Anih, said the commission would remain neutral.

    A mild drama however played out when a lawyer representing the Ahmed Makarfi’s leadership of the PDP, Robert Emukperho, made attempt to identify the appeal and other processes he filed for the PDP.

    Fakunle, who claimed to also be appearing for the PDP asked that the court strike out the processes filed by Emukperho.

    Justice Sankey adjourned hearing of the processes by Emukperho and Fakule’s motion, asking the court to strike them out till today.

    Sheriff, Makarfi and Obi were present in court on yesterday.

    Meanwhile, Jegede withdrew his motion before the Court of Appeal in Abuja seeking to restrain the Independent National Electoral Commission over his candidacy in the forthcoming November 26 election.

    The Chairman of the Makarfi-led faction of the PDP in Ondo State, Mr. Clement Faboyede, and the Secretary, Chief Oyedele Ibine, also withdrew their joint motion for stay of execution yesterday.

    Their lawyer, Akinlaja, told the Justice Jumai Shankey-led three-man appeal panel that the withdrawal of the motions for stay of execution had been overtaken by the event of the INEC’s decision to substitute Jegede’s name with that of Jimoh Ibrahim late on Thursday.

    While Jegede’s motion was filed on October 25 in the appeal numbered CA/A/551C/2016, Faboyede’s was filed on October 14 in the appeal numbered CA/551A/2016.

    While earlier withdrawing Faboyede’s motion, Akinlaja said the motion had become stale in view of the action the INEC took on Thursday.

    He said, “We have a motion filed on October 14, 2014 seeking stay of execution and other injunction.

    “But in view of the pre-emptive action taken by the 10th respondent (INEC) in doing exactly what the applicant (Faboyede) sought to stop by substituting a candidate that has already been submitted, the application has become stale,” Akinlaja said.

    But when it was the turn of Jegede’s case, Akinlaja was reluctant to withdraw the motion for stay of execution.

    Rather he urged the court to order INEC to reverse the substition of Jegede’s name with that of Ibrahim.

    On whether his application was proper in view of the fact that his client’s motion, seeking the leave to appeal as an interested party was yet to be heard, he cited section 30 of the Court of Appeal Rules to argue that an application to appeal also constituted a proper appeal.

    He however agreed  to withdraw the motion when he realised the stance of the appeal panel.

    The court then struck it out but refused to grant the prayer of the some of the respondents’ lawyers for an award of cost against the applicant.
