    A Lagos-based chieftain of the All Progressives Congress (APC), Mr. Olatunji Bello, has expressed optimism that Nigeria would fulfil its destiny under President Bola Ahmed Tinubu.

    In his Independence message, the ex-Lagos State Commissioner for the Environment and Water Resources described Tinubu as an unusual homo sapien with inexpressible supernatural endowment that enabled him to surmount and wriggle out of problems. He said has   manifested in the inspirational landmark feat straddling his academic, corporate and political trajectory, which remained indelible and had immortalised him in the eternal hall of fame.

    According to him, these are formidable and uncommon sterling endowments that stand Asiwaju Tinubu shoulder high above others. He is ready to deploy them to lift our great nation from the woods to popular global acclaim.”

    Bello described Tinubu as the best thing to happen to Nigeria “at this crucial and critical phase of its existence. He is a special gift from God, whose type appears only occasionally in generations, and whose wisdom is amazingly deep and esoteric that Nigeria can only toy with him at its own peril, just as Ghana did to Nkrumah and suffered the consequences for several years, and Nigerians to Chief Obafemi Awolowo for which we languish today in the backwaters.”

    He called on Nigerians irrespective of tribe, ethnicity, religion and sex to rally together in support of the President in the onerous bid to navigate the nation to its divinely- ordained destiny.

    “Asiwaju Tinubu is divinely-ordained by God. Therefore, no power or force on earth can stop him. Let his unrepentant adversaries be quick in recognising this so that they do not labour in futility,” the veteran lawyer and journalist said.

    As Nigeria celebrates her 63rd independence anniversary under the leadership of President Bola Ahmed Tinubu, it is important therefore, to acknowledge that it obviously not yet Uhuru for the most populous black nation. It is however, worthy of note that transformative strides of the former Lagos Governor across all sectors are beginning to yield the desired results.

    In his less than four months of presiding over the affairs of Nigeria, 

    President Tinubu had come up with well thought-out policies that are targeted at correcting entrenched institutional abuses, systemic anomalies and to also free-up resources for developmental projects. Chief of these policies was the termination of the hemorrhaging fuel subsidy and the multiple foreign exchange windows. The president has since assumption of office been strategically waging relentless wars on insecurity, oil theft and had also gone ahead to reverse the trend of reckless borrowing; which was sadly the norm of the previous administration. 

    Commendably, President Tinubu has mustered the political will to deal decisively with the disturbing issues of institutional abuse and endemic corruption. He had gone a step further to appoint Jim Obazee as a Special Investigator to probe the activities of the Central Bank of Nigeria and other related entities.

    President Tinubu has equally been making giant strides to reposition Nigeria for Foreign Direct Investments as well as strengthening the nation’s relations with other countries of the world. 

    Tinubu, recently gave an inaugural speech at the 78th session of the United Nations General Assembly (UNGA), where he emphasized the need for Africa nations to overcome the constraints of foreign exploitation and unlock its vast potential. He also took advantage of the global session to canvass mutually beneficial investments for Nigeria. President Tinubu also went ahead to undertake the historic ringing of the closing bell at NASDAQ in New York, United States. The event was part of the proceedings at the executive business dialogue organised by the United States Chamber of Commerce, Nigerian Exchange Group Plc and Nigerian Investment Promotion Council.

    Meanwhile, what could be gleefully described as an independence day gift to Nigerians by President Tinubu was the composition of a formidably young, dynamic and visionary cabinet. It is quite heartwarming that the appointed  ministers have since hit the ground running by coming up with policies 

    that had evidently marked radical departure from the old order and also brought positive impacts on Nigerians. 

    In line with the ‘Renewed Hope’ agenda of President Bola Tinubu, the minister of Interior, Hon. Olubunmi Tunji-Ojo has already made a bold statement that a new Nigeria is possible. The former parliamentarian has in less then one month done what could be described as the impossible by clearing the backlog of 204,000 international passports through the Nigeria Immigration Service (NIS).

    He simply achieved this feat by providing leadership and removing bureaucratic bottlenecks impeding  Nigerians from acquiring  international passports and other immigration documents. 

    It is a general knowledge that prior to the inauguration of Tunji-Ojo as the Minister of Interior, the issue of 

    renewal and obtaining of new passport was a huge embarrassment to Nigeria as a nation. Before Tunji-Ojo stepped in to clear the passports backlog, Nigerian seeking to renew and obtain new international passports had been subjected to endless waiting time of as long as one year by the Nigerian Immigration Service (NIS). However, this is now a thing of the past as Nigerians seeking to obtain new passports now readily get it done in less than two weeks, as against the old order.

    Undoubtedly, what seems like a superman performance by Tunji-Ojo has not only brought huge relief to Nigerians, it has equally elicited appreciative testimonies from thousands of youthful and aged Nigerians. In addition, the visionary  

    Tunji-Ojo has also put measures in place for a seamless partnership between the Interior Ministry and Ministry of Humanitarian Affairs and Poverty Alleviation. The ingenious collaboration is strategically aimed at addressing the issues of illegal migration, human trafficking, child labour as well as the provision of vocational skills at correctional centres. 

    More so, the Interior Minister has ingeniously come up with measures to expand the scope of the National Fire Academy located at Sheda in Abuja. This novel plan is to allow usage of the fire academy for the training of private sector players, so as to ensure that fire safety becomes personal affairs. Ultimately, Tunji-Ojo hopes to ensure that every institution, such as commercial, educational, social and recreational centres would have their certified fire and safety personnel.

    ‘Tinubu keeping promise on economy’

    Centre for Policy Advocacy and Transparency (CPAT) has said President Bola Tinubu is keeping his promise to revive the economy.

     CPAT,  in a statement by its Executive Director, Mary Odoma, applauded Tinubu and Nigerian National Petroleum Company Limited for the steady rise in the nation’s revenue.

     The centre said the latest disbursement from the Federation Account Allocation Committee (FAAC) is the highest in a long time.

     It commended NNPCL‘s Managing Director, Mele Kyari, for paying an interim dividend of N14.657 billion to states as derivation revenue.

    Odoma noted this is a result of foreign exchange gains with sharing to federal, state and local governments surging to N1.1 trillion in September.

     Of distributable revenue, she said it comprises distributable statutory revenue of N357.398 billion, distributable Value Added Tax (VAT) revenue of N 321.941 billion, Electronic Money Transfer Levy (EMTL) revenue of N14.102 billion, Exchange Difference revenue of N 229.568 billion and Augmentation of NN177.092 billion.

    According to Odoma, this feat was made possible due to the fuel subsidy removal. 

    She noted the President and Kyari have set the country on a path to greatness by ending the “scandalous” subsidy regime.  

    “The latest figures from the Federation Account Allocation Committee (FAAC) show the highest allocations to federal, state and local governments this year,” Odoma said.

     “N1.1 trillion in September alone. Staggering! This confirms that the nation is on the right track. President Tinubu pledged to address business unfriendly fiscal and monetary policies, especially the multiplicity of taxes.

    “His preference for a market-driven economy is well known, particularly the growing quest to maximise revenue growth for developmental purposes.

     “In his quest to remodel the economy to bring about growth and development through job creation, food security and an end to extreme poverty, he has charted a course of action targeted at achieving a higher GDP growth, which would in turn enhance significant reduction in unemployment”.

    The Chicago State University (CSU) has responded to the request by former vice president Atiku Abubakar in line with an Illinois, United States (U.S.) court order.

    In its response, the CSU insisted that it does not keep copies of diploma certificates issued to students.

    It also confirmed that President Bola Ahmed Tinubu graduated from the school in 1979.

    The CSU said Tinubu graduated in 1979 with a bachelors degree in Business Administration.

    It, however, said that after diligent search it was able to find some but not give the names because of privacy concerns.

    It further said that it could not find that of Tinubu which Atiku claimed was presented by the president to INEC.

    The university said it found some diploma certificates with the same font as the one being queried by Atiku.

    Tinubu mourns over death of Emeritus Prof Umaru Shehu

    President Bola Tinubu expressed shock and deep sadness over the passing into glory of a foremost Nigerian educationist and one of the pioneer medical doctors from Northern Nigeria, Emeritus Professor Umaru Shehu, CFR, on Monday, October 2.

    Born in 1930 in Maiduguri, Borno State, the nonagenarian was 92 when he passed away.

    According to a statement issued by his Special Adviser on Media and Publicity, Ajuri Ngelale, President Tinubu described Emeritus Professor Shehu’s death as a big blow to the country, saying that his death had closed a glorious chapter of illustrious service to Nigeria, Nigerians, and humanity as a whole.

    He said: “Emeritus Professor Shehu was a giant, even among that legendary generation of pioneering indigenous professionals in our country, and the story of his life is saturated with many first, golden steps across the realms of medical practice, school administration, and humanitarian services.

    “The renowned Professor of Medicine has always served Nigeria meritoriously and bestowed on all Nigerians a sense of pride with his indelible breakthroughs and innovative approaches to the administration of health and medical education around the world. Nigeria was indeed blessed to have him as both a patriotic son and as a worthy global representative in his fields of endeavour.”

    Trained at the defunct University College-Ibadan, the University of Liverpool and the University of London, among others, Emeritus Professor Shehu spent a lifetime straddling Nigeria’s medical and higher education institutions, in addition to several remarkable engagements on the global stage.

    The legendary academician served variously as a Deputy Vice-Chancellor, Vice Chancellor and Sole Administrator of the Ahmadu Bello University, Zaria; the University of Nigeria, Nsukka; and the University of Maiduguri, respectively. He successfully taught and mentored generations of medical practitioners, both in Nigeria and in the United Kingdom, and served at different times as the Country Coordinator of the World Health Organization (WHO) in Nigeria and Ethiopia.

    President Tinubu shared his profound condolences with the people and Government of Borno State, the deceased statesman’s family, the Nigerian medical community, and so many others who are grieving around the world over the colossal loss of this Nigerian icon, mentor, father, son, and dedicated professional. 

    The president also prayed for the repose of the soul of the deceased academician and statesman.

    President Bola Tinubu congratulated the former Chief of Army Staff and Chief of Defense Staff, General Ipoola Alani Akinrinade (rtd), on the occasion of his 84th birthday anniversary on October 3.

    President Tinubu’s goodwill message to General Akinrinade was contained in a statement issued by his Special Adviser on Media and Publicity, Ajuri Ngelale, on Monday, October 2.

    The president offered his heartfelt tribute to the highly esteemed elder statesman for his remarkable and enduring contributions to the advancement of Nigeria, both during his military service and as a civic leader, following his retirement from active duty.

    Recalling General Akinrinade’s excellent service to the nation during his time serving as an Honourable Minister in the Federal Ministries of Agriculture, Water Resources, Industries, and Transport, the President emphasized that the General’s relentless dedication to the public good is a most worthy example for future generations of Nigerians to emulate.

    The President affirmed: “His selfless service to our country has greatly contributed to national development.”

    Tinubu okays more relief packages for workers, others

    Ahigh-level meeting between government and Labour yesterday might have averted the planned  workers strike over the removal of petrol subsidy and its attendant pains.

    Labour, which shunned an invitation by government on Friday, insisting on the strike call for tomorrow, returned to the table yesterday.

    At the end of the four-hour meeting, more relief packages were approved for federal workers and other categories of Nigerians by the Federal Government.

    President Bola Ahmed Tinubu’s broadcast rolled off what turned out eventually to be gains for workers on the country’s 63rd Independence anniversary day.

    The agreement at the meeting include:

    * N35,000 provisional wage award for all categories of federal workers

    *freezing of VAT payment on diesel for six months; and

    * N25,000 each to 15 million households for three months (October to December)

    Leaders of the Nigerian Labour Congress (NLC) and the Trade Union Congress (TUC) agreed to the terms and promised to get back to the organs of the unions ahead of another meeting with government.

    The unions last week  put their affiliates on notice to begin the indefinite strike today to protest the economic hardship triggered by the removal of petrol subsidy.

    Yesterday’s meeting was presided over by the Chief of Staff to the President, Femi Gbajabiamila.

    Gbajabiamila clarified the N25,000 provisional wage increment unveiled by President Tinubu in his Independence Day anniversary broadcast (which was raised to N35,000 after the meeting).

    He said: “There was a lot of chatter on Twitter about the issue of low-income workers only falling into the category of the wage bill. They spotted that and we communicated that to Mr. President and he quickly agreed that all categories of workers will be given the wage bill. There’s nothing like low-income, mid-income or high-income. I think that’s worthy of clarification tonight.

    “A lot of issues were addressed; issues that concern the Nigerian worker, the average Nigerian worker. I can’t begin to reel them out here. But I am happy to say that after four hours, we have reached certain agreements that are for the benefit of the Nigerian worker.

    “Agreements on wage bill, agreements on committees on salary increment, CNG buses, on several other things, I believe both TUC, NLC and government side?

     ”Hopefully, we expect that Labour will call a meeting of their various branches and executive tomorrow to present the agreements that have been reached, and we pray and we believe and we hope that the strike will be called off on Tuesday.

    “So, I want to once again, thank Labour for taking time out on a good Sunday like this one when they should be with their families to come and discuss in the interest of the workers.”

    In a statement after the parley, Information and National Orientation Minister, Mohammed Idris, provided more details of the agreements and resolutions reached by both sides.

    Idris said: “The parties noted the following: The Federal Government has announced N25,000 only (later adjusted to N35,000) as provisional wage increment for all treasury-paid federal government workers for six months.

    “The Federal Government is committed to fast-tracking the provision of Compressed Natural Gas (CNG) buses to ease public transportation difficulties associated with the removal of PMS subsidy.

     ”The Federal Government commits to the provision of funds for micro and small-scale enterprises. VAT on diesel will be waived for the next six months.

    “The Federal Government will commence payment of N75, 000 to 15 million households at N25, 000 per month, for a three-month period from October-December 2023.”

    He added that following discussions at the meeting, resolutions were reached, which included facts that “the issues in dispute can only be resolved when workers are at work and not when they are on strike.

    “Labour unions argued for higher wage award and the Federal Government team promised to present their  request to President Bola Tinubu for further consideration.

    “A sub-committee to be constituted to work out the details of implementation of all items for consideration, regarding government interventions to cushion the effect of fuel subsidy removal.

    “The lingering matter of Road Transport Employees Association of Nigeria (RTEAN) and National Union of Road Transport Workers (NURTW) in Lagos State needs to be addressed urgently and Lagos State Governor, Babajide Sanwo-Olu, who participated virtually, pledged to resolve the matter.

    “NLC and TUC will consider the offers by the Federal Government with a view to suspending the planned strike to allow for further consultations on the implementation of the resolutions above”, the statement said.

    NLC President Joe Ajaero and the acting President of the TUC, Tommy Etim Okon, however said a decision to rescind the strike plans would be made after meetings with their various organs.

    They both expressed hope that a resolution would be reached, following the meetings and promises from government.

    Last night, the NLC summoned an emergency NEC meeting to review the agreement.

    In a statement, the Congress General Secretary, Emmanuel Ugboaja, said NEC members will meet virtual by 11am today.

    Ajaero said: “I don’t have much to say than the Chief of Staff has said. We’ve been meeting and we’ve looked at almost all the issues, all the promissory notes from the government and we’ll look at how to translate them to reality and to be workable. Then, we’re going to take those promises to our organs, of course you know these people here cannot just wake up and review and call off action.

    “So, like he said, we’re hopeful that our organs will have a look at them and give us a fresh mandate on what next to do. So it’s a simple one”, Ajaero said.

    TUC’s acting President, Okon, said: “Let me on behalf of the TUC also point out to the fact that we’ve had series of conversations surrounding the issue raised and we do hope that by tomorrow we are going to get across to our organs so that we can also look at it and cross-fertilise ideas and see the way forward. I’m sure we’re coming back again tomorrow for that.”

    Governor AbdulRazak AbdulRahman of Kwara State and Chairman of the Nigeria Governors Forum (NGF) and Governor Dapo Abiodun of Ogun State, participated virtually in the meeting, chaired by Gbajabiamila.

    Others in attendance were ministers Wale Edun (Finance and Coordinating Minister of the Economy); Idris (Information and National Orientation); Simon Lalong (Labour and Employment); Nkeiruka Onyejeocha (State, Labour and Employment); Abubakar Atiku Bagudu (Budget and Economic Planning); Dr. Betta Edu (Humanitarian Affairs and Poverty Alleviation); Doris Uzoka-Anite (Industry, Trade and Investment); Dr. Folasade Yemi-Esan (Head of Service of the Federation) and the National Security Adviser (NSA) Mallam Nuhu Ribadu.

    The Labour delegation was led by Ajaero, TUC Deputy Dr. Tommy Etim Okon, NLC General Secretary, Emma Ugboaja and TUC General Secretary, Nuhu Toro, among others.

    • ‘I have  a heart that feels and eyes that see’

    On this solemn yet hopeful day, let us commend our founding fathers and mothers.  Without them, there would be no modern Nigeria. From the fading embers of colonialism, their activism, dedication and leadership gave life to the belief in Nigeria as a sovereign and independent nation.

    Let us, at this very moment, affirm that as Nigerians, we are all endowed with the sacred rights and individual gifts that God has bestowed on us as a nation and as human beings. No one is greater or lesser than the other. The triumphs that Nigeria has achieved shall define us. The travails we have endured shall strengthen us. And no other nation or power on this earth shall keep us from our rightful place and destiny. This nation belongs to you, dear people. Love and cherish it as your very own.

    Nigeria is remarkable in its formation and essential character. We are a broad and dynamic blend of ethnic groups, religions, traditions and cultures. Yet, our bonds are intangible yet strong, invisible yet universal. We are joined by a common thirst for peace and progress, by the common dream of prosperity and harmony and by the unifying ideals of tolerance and justice.

    Forging a nation based on the fair application of these noble principles to a diverse population has been a task of significant blessing but also serial challenge. Some people have said an independent Nigeria should never have come into existence. Some have said that our country would be torn apart. They are forever mistaken. Here, our nation stands and here we shall remain.

    This year, we passed a significant milestone in our journey to a better Nigeria. By democratically electing a 7th consecutive civilian government, Nigeria has proven that commitment to democracy and the rule of law remains our guiding light.

    At my inauguration, I made important promises about how I would govern this great nation. Among those promises, were pledges to reshape and modernize our economy and to secure the lives, liberty and property of the people.

    I said that bold reforms were necessary to place our nation on the path of prosperity and growth.  On that occasion, I announced the end of the fuel subsidy.

    I am attuned to the hardships that have come. I have a heart that feels and eyes that see. I wish to explain to you why we must endure this trying moment. Those who sought to perpetuate the fuel subsidy and broken foreign exchange policies are people who would build their family mansion in the middle of a swamp.  I am different. I am not a man to erect our national home on a foundation of mud. To endure, our home must be constructed on safe and pleasant ground.

    Reform may be painful, but it is what greatness and the future require. We now carry the costs of reaching a future Nigeria where the abundance and fruits of the nation are fairly shared among all, not hoarded by a select and greedy few. A Nigeria where hunger, poverty and hardship are pushed into the shadows of an ever fading past.

    There is no joy in seeing the people of this nation shoulder burdens that should have been shed years ago. I wish today’s difficulties did not exist. But we must endure if we are to reach the good side of our future.

    My government is doing all that it can to ease the load. I will now outline the path we are taking to relieve the stress on our families and households. 

    We have embarked on several public sector reforms to stabilize the economy, direct fiscal and monetary policy to fight inflation, encourage production, ensure the security of lives and property and lend more support to the poor and the vulnerable.

    Based on our talks with labour, business and other stakeholders, we are introducing a provisional wage increment to enhance the federal minimum wage without causing undue inflation. For the next six months, the average low-grade worker shall receive an additional Twenty-Five Thousand naira per month.

    To ensure better grassroots development, we set up an Infrastructure Support Fund for states to invest in critical areas. States have already received funds to provide relief packages against the impact of rising food and other prices.

    Making the economy more robust by lowering transport costs will be key. In this regard, we have opened a new chapter in public transportation through the deployment of cheaper, safer Compressed Natural Gas (CNG) buses across the nation. These buses will operate at a fraction of current fuel prices, positively affecting transport fares.

    New CNG conversions kits will start coming in very soon as all hands are on deck to fast track the usually lengthy procurement process. We are also setting up training facilities and workshops across the nation to train and provide new opportunities for transport operators and entrepreneurs. This is a groundbreaking moment where, as a nation, we embrace more efficient means to power our economy. In making this change, we also make history.

    I pledged a thorough housecleaning of the den of malfeasance the CBN had become. That housecleaning is well underway. A new leadership for the Central Bank has been constituted. Also, my special investigator will soon present his findings on past lapses and how to prevent similar reoccurrences. Henceforth, monetary policy shall be for the benefit of all and not the exclusive province of the powerful and wealthy.

    Wise tax policy is essential to economic fairness and development. I have inaugurated a Committee on Tax Reforms to improve the efficiency of tax administration in the country and address fiscal policies that are unfair or hinder the business environment and slow our growth.

    To boost employment and urban incomes, we are providing investment funding for enterprises with great potential. Similarly, we are increasing investment in micro, small and medium-sized enterprises.

    Commencing this month, the social safety net is being extended through the expansion of cash transfer programs to an additional 15 million vulnerable households.

    My administration shall always accord the highest priority to the safety of the people. Inter-Service collaboration and intelligence sharing have been enhanced. Our Service Chiefs have been tasked with the vital responsibility of rebuilding the capacities of our security services.

    Here, I salute and commend our gallant security forces for keeping us safe and securing our territorial integrity. Many have paid the ultimate sacrifice. We remember them today and their families. We shall equip our forces with the ways and means needed to perform their urgent task on behalf of the people,

    We shall continue to make key appointments in line with the provisions of the Constitution and with fairness toward all. Women, Youth and the physically challenged shall continue to be given due regard in these appointments.

    May I take this opportunity to congratulate the National Assembly for its role in the quick take-off of this administration through the performance of its constitutional duties of confirmation and oversight.

    I similarly congratulate the judiciary as a pillar of democracy and fairness.

    I also thank members of our dynamic civil society organizations and labour unions for their dedication to Nigerian democracy. We may not always agree but I value your advice and recommendations. You are my brothers and sisters and you have my due respect.

    CSU ordered to release Tinubu’s non-privileged documents to Atiku

    A United States District Court in the Northern District of Illinois has directed the Chicago State University (CSU) to produce non-privileged documents on President Bola Ahmed Tinubu to ex-Vice President Atiku Abubakar. 

    But the court said it will not take a position on Atiku’s claims on  the authenticity of the documents, which Tinubu submitted to the Independent National Electoral Commission (INEC) to contest the last presidential election. 

    The decision, rendered on September 30 by Justice Nancy Maldonado, overruled the objection raised by Tinubu against the September 29 order by Magistrate Jeffrey Gilbert and proceeded to affirm Gilbert’s ruling directing the CSU to comply with Atiku’s request made on August 2 for the release of some documents relating to Tinubu’s academic records in the school.

    The order reads: “Respondent CSU is directed to produce all relevant and non-privileged documents in response to Requests for Production Nos. 1 through 4 (as narrowed by Judge Gilbert and adopted here) in Mr. Abubakar’s subpoena, by 12:00 p.m. (noon) CDT, on Monday, October 2, 2023. 

    “The Rule 30(b)(6) deposition of CSU’s corporate designee must be completed by 5:00 p.m. CDT on Tuesday, October 3, 2023. Given the October 5, 2023, filing deadline before the Supreme Court of Nigeria, the Court will not extend or modify these deadlines.” 

    On Atiku’s other prayers, the court said it will not take a position on the authenticity of the documents, which President Tinubu submitted to INEC to contest election. 

    The judge said:” The Court therefore, finds that the “for use in” statutory requirement under § 1782 is satisfied. 

    “The court reiterates, as mentioned at the outset, that in reaching this finding, the court is not taking a position on the merits of any of Mr. Abubakar’s underlying claims as to the authenticity of the diploma submitted to the INEC, President Tinubu’s education and graduation, or the truth of what is or is not shown in any other CSU documents that have been produced in the Nigerian proceedings.

    “Nor should the Court’s opinion be read as taking any position on any of the broader claims as to the validity of the election or what the documents and discovery from CSU might or might not show.

    “ The court simply finds that Mr. Abubakar has cleared the relatively low hurdle of showing that the documents he seeks could be relevant to his claims (either proving them or disproving them) and could potentially be presented to the Supreme Court of Nigeria.”

    Atiku had challenged Tinubu’s election before the Presidential Election Petition Court (PEPC) through a petition in which he merely claimed that Tinubu was not qualified to have contested the election, without providing any particulars of his alleged non-qualification, a defect Tinubu raised in his reply to the petition.

    He however, attempted to introduce fresh evidence in his response to Tinubu’s reply by calling as a witness an Abuja-based lawyer, Mike Enahoro-Ebah, through whom he tendered some documents he claimed were obtained from CSU about Tinubu.

    The PEPC, in its judgment on September 6, rejected the fresh evidence Atiku attempted to introduced on the grounds that they were not filed along with the petition, a decision he appealed, among other grounds, before the Supreme Court.

    Before the PEPC judgment, Atiku had on August 2, applied to the US to compel the CSU to allow him access to Tinubu’s academic records, which he claimed, was needed to boost his appeal at the Supreme Court.

    In the September 30 judgment, Justice Maldonado found, among others, that Tinubu did not prove that the Nigerian Supreme Court can no longer obtain additional evidence from Atiku under “exceptional circumstances.”

    The court added: “Here, while there is evidence of the Court of Appeal’s non-receptiveness to the ‘non-qualification’ evidence, there is nothing in the record, other than rhetoric, from which the court can make a determination as to whether the Supreme Court of Nigeria will ultimately be receptive to any additional evidence Mr. Abubakar seeks to introduce. 

    “It is true that Mr. Abubakar himself  has admitted that the ‘exceptional circumstances’ standard for the submission of additional  evidence is ‘demanding.’ And it may be, as President Tinubu repeatedly suggests, that Mr. Abubakar will ultimately be unsuccessful in convincing the Supreme Court of Nigeria to consider such new evidence in light of the holding of the Court of Appeal. 

    “But again, President Tinubu has not contested that the mechanism exists for Mr. Abubakar to try to make the argument to the Supreme Court of Nigeria that there are exceptional circumstances that justify the introduction of the evidence he is seeking from CSU. 

    “There is simply no evidence to suggest that  the Supreme Court of Nigeria must necessarily reach the same result as the Court of Appeal. 

    “Further, this court would be improperly intruding into Nigerian law if it made any determination or prediction as to how the Supreme Court might rule on the ultimate question of whether to adopt the Court of Appeal’s approach, or whether to allow the evidence under exceptional circumstances.

    “To do so would require the court to improperly consider the ultimate admissibility of the evidence sought, which it may not do.”

    In further affirming the findings by Magistrate Gilbert, Justice Maldonado noted that Gilbert “found that the discovery requests were reasonably tailored to obtain information for possible use in support of Mr. Abubakar’s appeal to the Nigerian Supreme Court, and that Mr. 

    Abubakar’s interest in obtaining the discovery outweighed President Tinubu’s privacy rights in the materials, because he had put his diploma at issue by submitting it to the INEC. 

    “Judge Gilbert ordered that the application be granted, though he did limit the scope of one of Mr. Abubakar’s discovery requests.”

    “Specially, Judge Gilbert narrowed Mr. Abubakar’s fourth document request above, excluding the request for any and all communications concerning the Orr Documents because it would call for time-consuming and burdensome electronic discovery that was particularly infeasible in light of the looming court deadlines.”
